Ordinance No. 68-29 CITY OF TIGARD, OREGON ORDINANCE No. 68- 2_ AN ORDINANCE ANNEXING TO THE CITY OF TIGARD LANDS OF JAMES J. PRAGGASTIS; JOHN G. DAVISON AND MARY C. DAVISON in Sec. 1, T2S, R1W, W.M. _WASHINGTON COUNTY, OREGON WHEREAS, the owners of the hereinafter described lands have petitioned the City of Tigard to annex the same to the City, and have filed consent to said annexation with the City Recorder under date of the 2nd day of April 1968; and WHEREAS, the lands hereinafter described and proposed to be annexed are contiguous to the corporate limits of the City of Tigard and are not within the corporate limits of any city and lie wholly within the County of Washington, State of Oregon, and are, in all respects, qualified to be annexed to the City of Tigard; and WHEREAS, By Ordinance No. 68-18 duly enacted by the City Council of Tigard on the Sth day of A,,.;1 , 1968, the City' Council of Tigard did elect to dispense w �s xtting the annexa- tion proposal to the registered voters of the City of Tigard, and 968 did by said ordinance set Monday the 13 day of Mav at the hour of 8:00 p.m. at the City HaIT,Tigard, Oregon, as the time and place for public hearing by the Council of said annexation G proposal; and WHEREAS, said hearing of May 13 1968 was duly publicized by notice published once eac wee or two successive weeks, or three publishings in all, to-wit: On the 25thday of �A ri�l , 1968, the 2nd day of rfa ,—PSB and the 9th ad y of 'Ma, the Tigarimmes, s newspaper of general- circulat-1on a�n-dpublished in the City of Tigard, Oregon; that an affidavit of said publication is on file herein and that notice of said hearing was further given by posting in four public and conspic uous places within the City of Tigard for a like period and that the affidavit of the City Recorder with respect to said posting is on file herein; and WHEREAS, the hearing on said proposal was duly and regularly opened at the City Hall, City of Tigard, on May 13th, 1968 at the hour of 8:00 p.m., and in the absence of a quorum of the Council, the Mayor continued and adjourned the hearing until May 15, 1965, 8:00 p.m. WHEREAS,said hearing was reopened and reconvened an May 15, 1968 at 8:00 p.m. and was duly held and all interested persons and registered o-tArA of the City desiring to be heard, were heard, and said hearing was duly closed; and WHEREAS, it appears that all statutory requirements for the annexation, of the following described area to the City of Tigard have received full compliance and ,that said area may be lawfully annexed to the City of Tigard, NOW, THEREFORE, THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section 1: That all of the following described lands be, and the same are, hereby annexed to the City of Tigard, and the boundaries of the City_of Tigard be, and they are, hereby extended to include the following described lands within the said boundaries: PAGE 1 - ORDINANCE No. 68- 29 The following described real property. situate •.n the County of Washington and Sta of Oregon, described as .lows; Beginning at the stone marking the Southwest corner of the Peter Halter 10 acre tract in the W. W, Graham Donation Land. Claim #39, In Section 1, Township 2 South, Range 1 West, Willamette Meridian; thence West 10 feet to a pipe; thence North 340.3 feet to a pipe : f bwag nn ng of the tract herein described; thence at the true pQISSt Ge. a,�y+...s+ continuing North 318.35 feet to the center of the county road (from which a pipe bears South 20.0 feet) ; thence South 890 11' West along the center of the county road, 334.8 feet; thence South 313.3 feet, more or less, to a pipet thence East 334.7 feet to the true point of beginning; EXCEPT rights of the public in and to that part of the herein described promisee lying within the boundaries of roads and highways. Section2: That the Recorder of the City of Tigard be, and she is hereby directed, within 10 days frotr the date hereof, to ;Hake and submit to the Secretary of State of Oregon: a. A certified copy of this ordinance of annexation' b. A certified copy of the statement of consent of the landowners in the territory annexed C. A certified copy of Ordinance No, 68-19 whereby the City Council declared that no election is required in the City, and to file herein the acknowledgment. of t;e SecrGtWry of State Qf said filing. Section 3: That the Recorder of the City of Tigard be, &ad she is hereby directed, within 10 days from the date hereof, to file with each of the Department of Revenue and Taxation and the Department of Records and Elections of the County of Washington, the following: a. A certified copy of this ordinance of annexation b. A certified copy of ordinance No. 68- 18 and that a copy of this Ordinance be directed to the Office of the Washington County Surveyor, and to file herein the acknowledgwents ofsaidDepartments of said filings.
