ORDINANCE No. 68- 28
AN ORDINANCE ANNEXING TO THE CITY OF TIGARD LANDS OF
FRANKLIN E. CRESMER, EVA T. CRESMER, AND KATHERINE Z. O'NEIL
being Lot 12, Frewing's Orchards Tracts
Sec 2 T2S Rlw, w.M, WASHINGTON COUNTY, OREGON
WHEREAS, the owners of the hereinafter described lands have
petitioned the City of Tigard to annex the same to the City, and
have filed consent to said annexation with the City Recorder under
date of the 12thday of April , 1968; and
WHEREAS, the lands hereinafter described and proposed to be
annexed are contiguous to the corporate limits of the City of Tigard
and are not within the corporate limits of any city and lie wholly
within the County of Washington, State of Oregon, and are, in all
respects, qualified to be annexed to the City of Tigard; and
WHEREAS, By Ordinance No. 68-24 duly enacted by the City
Council of Tigard on the 22 day of A ril , 1968, the City
Council of Tigard did elect to dispense with submitting the annexa-
tion proposal to the registered voters of the City of Tigard, and
did by said ordinance set Monday the 13th day of 1968
,s at the hour of 8:00 p.m. at the City Hall, Tigard, regon, as the
time and place for public hearing by the Council of said annexation
proposal; and
WHEREAS, said hearing of M was duly

weeks, or three publishings in all, to-wit: On the 25 day of
1968, the 2nd day of May ,�58 and the
aye of , Tin the Tigard Times, a newspap>:- of general
circula-tro-n--a-n-a--p-u-Slished in the City of Tigard, Oregon; that an
affidavit of said publication is on file herein and that notice of
said hearing was further given by posting in four public and conspic-
uous places within the City of Tigard for a like period and that the
affidavit of the City Recorder with respect to said posting is on
r,. file herein; and
WHEREAS, the hearing on said proposal Was duly and regularly
opened at the City Hall, City of Tigard, on May 13th, 1968 at the hour
of 8:00 p.m., and in the absence of a quorum of the Council, the Mayor
continued and adjourned the hearing until May 15, 1968, 8:00 p.m.
WHEREAS, said hearing was reopened and reconvened on May 15, 1968
at 8sO0 p.m, and was duly held and all interested persons and registered
voters-of t.,.e City desit'ihq to be heard, were heard, and said hearing
was duly closed; and
WHEREAS, it appears that all statutory requirements for the
annexation of the following described area to the City of Tigard have
received full compliance and that said area may be lawfully annexed
r to the City of Tigard,
NOW, THEREFORE,
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: That all of the following described lands be, and the
same are, hereby annexed to the City of Tigard, and the
boundaries of the City of Tigard be, and they are, hereby extended
to include the following described lands within the said boundaries:

Lot 12, Frewing's Orchard Tracts, a subdivision of record in
the SW 1/4 of Sec. 2, T2S, R1W, W.M., Washington County, Oregon i
Section 2: That the Recorder of the City of Tigard be., and she is
hereby directed, within 17 days from the date hereof,
to make and submit to the Secretary of State of Oregon:
a. A certified Buoy of this ordinance o_ annexation
b. A certified coo;, of the statement of consent oc
the landowners in the territory annexed
C. A certified copy of Ordinance No. 68- 24 whereby
the City Council declared that no election is
required .in. the City,
and to file herein the ac:.nowledgment of the Secretary of State of
said filing.
_Section 3: That the Recorder of the City of Tigard be, and she is
hereby directed, within 10 mays fror the date hereof,
to file with each of the Depariarent of Revenue and 'taxation and the
Department of Records and Elections of the County of Washington,
the following:
a. A certified copy of this ordinance of annexation
b. A certified copy of Ordinance No. 68- 24
and that a copy of this Ordinance be directed to the Office of the
Washington County Surveyor, and to file herein the acknowledgnents
of said Departments of said filings.
Section 4: The annexation hereby ordained shall be effective on
"Mav_29, 1968 after filing with the Secretary of State of Oregon the
copies of proceedings as in Section 2 hereof required to be filed,
and from and after: said date the hereinabove described and annexed
territory shall be and remain a part of the City of Tigard.
PASSED: By the Council, by unanimous vote of all Council
members present, after being read three tines by
