ORDINANCE No. 68- 25
AN ORDINANCE ANNEXING TO THE CITY OF TIGARD LANDS OF
SARAH E, STEELE AND HOWARD S. GASS et ux, being a part .;f GRAHAM
ACRES SUBDIVISION in Section 35, T1S, R1W, W.M.
WASHINGTON COUNTY, OREGON
WHEREAS, the owners of the hereinafter described lands have
petitioned the Cty of Tigard to annex the same to the City, and
have filed consent to said annexation with the City Recorder under
date of the _ _day of , , 1968; and
WHER1rAS, the lands hereinafter described and proposed to be
annexed are contiguous to the corporate limits of the City of Tigard
and are not within the corporate limits of any city and lie wholly
within the County of Washington, State of Oregon, and are, in all
respects, qualified to be annexed to the City of Tigard; and
WHEREAS, By Ordinance No. 68- 14 duly enacted by the City
Council of Tigard on the t1. day of1968, the City
Council of Tigard did elect to dispense wxt sting the annexa-
tion proposal to the registered voters of the City of Tigard, and
aid by said ordinance set Monday the 8 day of , 1968
at the hour of 8:00 p,:a, at the City Ham, Tigard,Oregon, as the
titre and place for public hearing by the Council of said annexation
proposal; and
WHEREAS, said hearing of April. 8, 1.96P., was duly
publicized by notice published once each wee or two succesal.ve `
weeks, or three publishings in all, to-wit: On the _2gday of
March 1968, the day of March 1968 and the Q
day ori � x�, 1 ,} n the TigardTimes, a �,ra newspaper of gen
circular on an pu shed in the City of Tigard, Oregon; that an
affidavit of said publication is on file herein and that notice of
said hearing was further given by posting in four public and conspic-
uous places within the City of Tigard for a like period and that the
affidavit of the City Recorder with respect to said posting is on
file herein; and
WHEREAS, the hearing on said proposal was duly and regularly
held at the City Hall, City of Tigard, on April 8 1961
at the hour of 8:00 p.m., whereat all interested persons and regis-
tered voters of the City desiring to be heard, were heard, and said
hearing was duly closed; and
WCEREAS, it appears that all statutory requirements for the
annexation of the following described area to the City of Tigard have
received full compliance and that said area may be lawfully annexed
to the City of Tigard,
NOW, THEREFORE, � .
THE CITY OF TIGARD ORDAINS AS FOLLOWS:

As set forth on the attached sheet headed Exhibit "A",by reference
made a part hereof.
Section 2 That the Recorder of the City of Tigard be, and she is
hereby directed, within 10 days from the date hereof,
y to make and submit to the Secretary of State of Oregon:
a. A certified copy of this ordinance of annexation
b. A certified copy of the statement of consent of
the landowners in the territory annexed

C. A certified copy of Ordinance No. 68-14 whereby
the City Council declared that no election is
required in the City,
and to file herein the acknowledgment of the Secretary of State of
said filing.
Section 3: That the Recorder of the City of Tigard be, amd she is

to file with each of the npnartmAnt of Revenue and Taxation and the
Department of Records and Elections of the County of Washington,

a. A Certified copy of this ordinance of annexation

�r.. Washington County Surveyor. and to file herein the acknowledgments
of said Departments of said filings.

section 4: The annexation hereby ordained shall be effective on
May 29, 1968 aftei filing with the Secretary of State of Oregon the
piesofproceedings as in Section 2 hereof required to be filed,
and from and after said date the hereinabove described and annexed
territory shall be and remain a part of the City of Tigard.

EXHIBIT "A"
Beginning at the Northeast corner of the John L. Hicklin D.L.C.
No. 54 IN SECTION 35, TIS, R1W, W.M. AND RUNNING THENCE 5890 34' W a
distance of 500.00 feet, to the beginning point of County Road No.
1766; thence northerly along the centerline of, formerly Heintz Ave.,
162 feet more or less to a point on the south right of way line of the
Beaverton Tigard Highway, said point being approximately station 381
+ 10; thence Northwesterly, along the south right of way line to tha
West boundary line of the David C. Graham D.L.C.; thence N OO 27' E'-
203 feet to the Northwest corner of Lot 31 Graham Acres Tract; thence
S 890 07' E a distance of 1067.7 feet to a point on the Easterly line
of the D.C. Graham D.L.C.; said point also being the Northeast corner
of lot 12 of said subdivision; thence, S 00 17' W along said line
357.14 feet to the Southeast corner of the D.C. Graham D.L.C. #52;
thence S 88O 52' 14 a distance of 230.3 feet to the true point of
beginning.
