Ordinance No. 68-19 CITY OF TIGARD, OREGON ORDINANCE No.68-_Ij_ Ar ILI' AN ORDINANCE PROVIDING FOR A SPECIAL CITY ELECTION TO BE HELD IN THE CITY OF TIGARD, OREGON, ON MAY 28, 1968, IN CONNECTION WITH THE GENERAL STATE PRI11,1ARY ELECTION, FOR THE PURPOSE OF SUBMITTING TO THE LEGAL VOTERS OF THE CITY OF TIGARD, OREGON, THE QUESTION OF ESTABLISHING A NEW TAX BASE PURSUANT TO SECTION 11, ARTICLE XI, CONSTITUTION OF THE STATE OF OREGON. WHEREAS, the Council of the City of Tigard has determined that . .sufficient funds to properly operate the essential functions of the City of Tigard cannot be macre available within the limits of the presently existing tax base of the City and that there should be submitted to the legal voters of the City the question of establishing a new rax base in accordance with the provisions of Section 11, Article XI, Oregon Constitution; and WHEREAS, pursuant to Section 11, Article XI, Oregon Consti- tution, it is necessary to submit such question of establishing a new tax base to the legal voters of the City at the state-wide primary election to be held on May 28, 1968; NOW, THEREFORE, THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section 1: That it is necessary and in the best interests of the people of the City of Tigard that there be submitted to the legal voters of the City at the regular state-wide primary election to be held and conducted at all voting precincts within the City and throughout the state on May 28, 1968, and as a part thereof, the proposition hereinafter stated in accordance with Section 11, Article XI, Constitution of the State of Oregon. Section 2: That there should be submitted to the legal voters of the City of Tigard voting at each precinct, or part thereof, within the City at the said primary election of May 28, 1968, the following proposition for which purpose the following ballot titlelnumber and form in which the question shall be prin- ted upon the official ballot is prescribed: Submitted to the legal voters by the City Council: For the reason that the amount of taxes that may be levied by the Council of the City of Tigard within the present tax base of the City deter- mined by Section 11, Article XI, Constitution of Oregon, is insufficient to cover the increased costs of personal services, maintenance and oiler- ation of essential city functions, the following proposition is referred to the legal voters: i°Shall the City of Tigard, Oregon, increase its present tax base of $ 24,420.24 by 51 establishing a new tax base in the sum of $89,753.00 to be effective for the fiscal year beginning July 1, 1968711 Page 1 ORDINANCE No. 68-_ _� f Section 3: That the foregoing proposition shall be submitted to the legal voters of the City of Tigard by separate ballot at each precinct, or part thereof, In the City of Tigard, at said primary election of May 28, 1968, and the said election with respect to said proposition shall be conducted by the regu- lar election boards designated to conduct the regular state-wide primary election in said precincts on May 28, 1968. Such election boards regularly designated to conduct said primary election are hereby designated as the election boards to conduct the election with reSpect to the foregoing tax base proposal. Section 4: In all respects the conduct of the election on the tax base proposition shall conform to the procedures established pursuant to law for the conduct of the primary election in said precincts and the polls shall be opened at the same hour and closed at the same hour and all other applicable provisions in accordance with the election laws of the state of Oregon, Section 5: Notice of the City tax base proposal in form substan- tially as hereinafter set forth shall be given by three weekly publications in the Tigard Times on May 9, May lo', and May 23, 1968, and by posting notice substantially in the following form in the following designated places, such posting to be accom- plished not later t.:an May 10, 191)8: (a) At the front door of the City Hall exposed to pub- lic view, Main Street, Tigard, Oregon. (b) In one public place in each voting precinct, or part thereof,, within the City. The City Recorder is directed to cause to have published and posted said notices and shall file in the records of said election an affidavit of posting in usual farm prior to May 15, 1968. The form of notice shall be substantially as follows: NOTICE OF PROPOSAL TO ESTABLISH A NEW TAX BASE CITY OF TIGARD, OREGON TO BE SUBMITTED TO LEGAL VOTERS OF TIGARD AT PRIMARY ELECTION OF MAY 28, 1968 Notice is hereby given that pursuant to Ordi- nance No. 68- enacted by the City Council of Tigard on ljvv, at the stut2-- wide primary election of May 28, 1968, between the hours of 3:00 o'clock A. M. and 8:00 o'clock P.M. at each precinct within the City of Tigard, there will be submitted to the legal voters of the City of Tigard for their approval or rejection the following proposition: For the reason that the amount of taxes that may be levied by the Council of the City of Tigard within the present tax base of the City deter- mined by Section 11, Article XI, Constiution of Oregon, is insufficient to cover the increased costs of personal services, maintenance and oper- ation of essential city functions, the following proposition is referred to the legal voters: Page 2 T ORDINANCE No. 68- Jq "Shall the City of Tigard, Oregon, increase YES its present tax base of $ by establishing a new tax base in the sum of $89,753.00 to be effective for the fiscal NO year beginning July 1, 1968?" The foregoing proposition, if adopted, will establish a new tax base for the City of Tigard pursuant to Section 11, Article XT, Oregon Constitution. The polling places in the City of Tigard for the purpose of submitting the foregoing proposition will be the same as those desig- nated for the state-wide primary election of May 28, 1966, and the election will be conducted in all re- spects by the same election wards as designated and appointed for the state-wide primary election. ` Witness my hand and the seal of the City of Tigard this day of May, 1968. } City Recorder Section 6: That the Council of the City of Tigard deems it unneces- sary for the City of Tigard, or any officer thereof, to furnish the legal voters of the City any tax base election pamphlets containing the text of the proposition or arguments in support of or in opposition to the proposition. Section 7: The City Recorder be and she is hereby authorized and directed to furnish to the Department of Records and Elections of Washington County, Oregon, and to the extant required by the Director of Records and Elections, Washington County, Oregon, furnished to the election boards of each precinct of the City ballots, oallot boxes and all necessary election materials and to take any A and all other and further actions as may be required to give effect to the provisions of this ordinance.
