Ordinance No. 68-14 e 'U CITY OF TIGARD, OREGON ORDINANCE No. 68- AN ORDINANCE SETTING HEARING WITH RESPECT TO PROPOSED ANNEXA- TION OF THE LANDS OF SARAH E. STEELE AND HOWARD S. GASS ET UX, being a part of GRAIIAM ACRES SUBDIVISION in Section 35, T1S,RIW,W.M. WASHINGTON COUNTY, OREGON, AND DIRECTING GIVING OF NOTICE THEREOF. ! WHEREAS, there has heretofore been tiled with tha City Re- corder of the City of Tigard, petition for annexation of certain lands being a part of Graham Acres Subdivision in Sec. 35, T1S.R1W. I W.M. Washington County, Oregon, as hereinafter described; and LWHE S said promises are contiguous to the City of Tigard raaaaauan.�, o u r.. o--- and not within the corporate limits of any other City, and lie wholly within the County of Washington, State of Oregon; and WHEREAS, it appears that said premises may properly be annexed to the City of Tigard without submitting the question to the registered voters of the territory, since the owners thereof, Sarah E. Steele, Howard S. Gass and Margaret A. Gass have by signed petition requested and consented to said annexation; NOW, THEREFORE, THE 01TY OF TIGARD ORDAINS AS FOLLOWS: Section 1: Ti,.;; the City Council of the City of Tigard does hereby elect to dispense with submitting the question of the -annexation of the hereinafter described premises to the registered voters of the City. Section 2: That Monday, the 8thday of April , 196 8 at the hour of 6:00 p.ta., at the City Hall in the City of Tigard, be, and the same is, hereby fixed as the date, time and place for public hearing before the City Council of Tigard of the petition of Sarah E. Steele, Howard S. Gass and Margaret A. Gass for annexation of the hereinafter describedlands to the City of Tigard, and all registered voters of the City may appear at said tjAe and place and be heard on the question of said annexation. Section The City Recorder of the City of Tigard be, and she is hereby, directed to give notice of said bearing by pub - each once each week for two successive weeks, or three publish Ings in all, prior to the date of the hearing, in the Tigard Times, a newspaper of general circulation in the City, and said Recorder be, and she is hereby further directed to post notices of said hear- ing in four public places in the City of Tigard for a like period. AND RUNNING THENCE 9890 34' W a distance of 500.00 feet, to the beginnirr4 point of County Road No. 1765; thence northerly alonrl th(, centerline of, fonvorly Heintz Avec. 182 feet more or less to a point on the south right. of way line of the Beaverton Tigard Highway, said point oeing apnroxinately station 381 + 10; thence Northwesterly, along the south riqht of way line to the West boundary line of the David C. Graham D.L.C.r thence N Oo 27 E; 203 feet to the Northwest corner of Lot 31 Grahan Acres Tract; thence S 890 07' E a distance of 1067.7 feet to a point on the Easterly line of the D.C. Graham D.L.C.; said point also being the Northeast corner of lot 12 of said subdivision; thence, S Oo 17' W along said line 357.14 feet to the Southeast corner of the D.C. Grahag U.L.C. #52; thence S 880 52' W a distar.•'e of 23 ).3 Feet to the true point- of beginning. Section 5: Inasmuch as the hearing of the petition for annexation of the lands herein described should be conducted with the least possible delay, an emergency is hereby declared to exist, and it is declared to be necessary for the peace, health and safety of the City of Tigard that this ordinance become effective upon its passage by the Couiiall and signature by the E4ayor.
