Ordinance No. 68-05 CITY OF TIGARD, OREGON ORDINANCE No, 6 8- + AN ORDINANCE SETTING HEARING WITH RESPECT TO PROPOSED ANNEXA- TION OF THE LANDS OF I1. C. HOFFMAN, et ux, AND HOWARD S. GASS, et ux being Tax Lot 700 and a portion of Tax Lot 800 respectively, in j Section 3, T2S, R1W, W.M. WASHINGTON COUNTY, OREGON, AND DIRECTING GIVING OF NOTICE THEREOF. WHEREAS, there has heretofore been filed with the City Re- corder of the City of Tigard, petition for annexation of certain lands in Sec. 3, T2S, 8114, W.M. Washington County, Oregon, as hereinafter describer;; and WHEREAS, said premises are contiguous to the City of Tigard and not within the corporate limits of any other City, and lie wholly within the County of Washington, State of Oregon; and WHEREAS, it appears that said premises may properly be annexed to the City of Tigard without submitting the question to the registered voters of the territory, since the owners thereof, H. C. Hoffman, 0. R. Hoffman; Howard S. Gass, Mar, are� A. «as have by signed petition requested and consented to said an:iexation; NOW, THEREFORE, THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section l: That the City Council of the City of Tigard does hereby elect to dispense with submitting the question of the annexation of the hereinafter described premises to the registered voters of the City. Section 2: That Monday, the il.tinday of :ar<'= , 1963 at the hour of 8:00 p.m., at the City Hall in the City of Tigard, be, and the same is, hereby fixed as the date, time and place for public hearing before the City Council of Tigard of the petition of H. C. Hoffman, et ux; and :3owa:~d S. Section 3: The City Recorder of the City of Tigard be, and she is hereby, directed to give notice of said hearing by pub- lication once each week for two successive weeks, or three publish- ings in all, prior to the date of the hearing, in the Tigard Times, a newspaper of general circulation in the City, and said Recorder be, and she is hereby further directed to post notices of said hear- ing in four public places in the City of Tigard for a like period. No. 37 in Sec. 3, T2S, R1W, W.M. in Washington County, State of Oregon running thence North 240 48' West a distance of 428.7 feet to a point, said point being the southwest corner of that certain tract of land described as parcel II in deed to Jack D. Godwin and wife as recorded in Book 502 Page 179, deed records of Washington County, Oregon; thence North 87 59' East a distance of 180 feet to the southeast corner of said parcel II; thence North 240 44' West along the easterly line of said parcel II a distance of 35 feet; thence North 870 41' East parallel with Fonner Road 120 feet more or less to a point on the easterly line of that tract conveyed to Mary Jane Waldo by deed recorded in Book 502 page 178, deed records of said county; thence North 240 48' West along the easterly line of said Waldo Tract 167 feet more or less to a point on centerline of county road No. 495, thence along center line of said road North 870 59' East a distance of 126.6 feet to a point on center line of said road, thence North 630 38' East along center line of said road a distance of 582.04 feet to a point; thence North 530 35' East along center line of said road a distance of 211.6 feet to a point; thence South 00 57' West a distance of 930.7 feet to a point on the south line of the John L. Hicklin D.L.C. No. 37, thence South 870 13' West along said line to the point of true beginning. i Section 5: Inasmuch as the hearing of the petition for annexation Of the lands herein described should be conducted with F the least possible delay, an emergency is hereby declared to exist, ° and it is declared to be necessary for the peace, health and safety Of the C:.ty of Tigard that this ordinance become effective upon its j passage by the Council and signature by the Mayor.
