AN ORDINANCE ANNEXING TO THE CITY OF TIGARD LANDS OF
COMMERCE DEVELOPMENT COMPANY, INC., (annexation #2)
In Se6._ 35, T1S, TR1W, W.M., WASHINGTON COUNTY, OREGON
WHEREAS, the owners of the hereinafter described lands have
petitioned the City of Tigard to annex the same to the City, and
have filed consent to said annexation with the City Recorder under
date of the _ 27—day of November, 1967; and
WHEREAS, the lands hereinafter described and proposed to be
annexed are contiguous to the corporate limits of the City of Tigard
and are not within the corporate limits of any city and lie wholly
within the County of Washington, State of Oregon, and are, in all
respects, qualified to be annexed to the City of Tigard; and
WHEREAS, By Ordinance No.67-69 duly enacted by the City
Council of Tigard on the 27 day of November, 1967, the City
Council of Tigard did electt t.o dispense with submitting the annexa-
tion proposal to the registered voters of the City of Tigard, and
did by said ordinance set Monday the 18 day of December , 1967
at the hour of 8:00 p.m. at the City Hall, Tigard, Orogon, as the
time and place for public hearing by the Council of said annexation
proposal; and
WHEREAS, said hearing of December 18, 1967 was duly
publicized by notice published onca each week for two successive
weeks, or three publisi.ings in all, to-wit: On the 30 day of
;lcvecnber ,1967, the 7 day of December , 1967 and the 14 day
ofecefb,r , 1967, in the Tigard Times, a newspaper of general
circulation and published in the City of Tigard, Oreon; that an
affidavit of said publication is on file herein and that notice of
said hearing was further given by posting; in four public and conspic-
uous places within the City of Tigard for a like period and that the
affidavit of the City Recorder with respect to said posting is on
file herein; and
WHEREAS, the hearing on said proposal was duly and regularly
held at the City Hall, City of Tigard, on December 18 , 1967
at the hour of 8:00 p.m., whereat all interested persons and regis-
tered voters of the City desiring to be heard, were heard, and said
hearing was duly closed; and
WHEREAS, it appears that all statutory requirements for the
annexation of the following described area to the City of Tigard have
received full compliance and that said area may be lawfully annexed
to the City of Tigard,
NOW, THEREFORE,
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: That all of ,the following described lands be, and the
same are, hereby annexed to the City of Tigard, and the
boundaries of the City of Tigard be, and they, are, hereby extended
to include the following described lands within the said boundaries:

Beginning at the SW corner of the D.C.Graham D.L.C.#52, TIS,
R1W,W.M., Washington County, Oregon, and running thence East along
the South line of said D.L.C. 1007.9 -feet to an iron pipe; thence
North 0°28' E. 843.9 feet to 'an iron pipe on the East line of that
certain tract of land conveyed to Andrew Wormsborg by deed recorded
on page 9 of Vo1.201 Washington County, Oregon, Deed Records, which
point is the true place of beginning of the herein described tract;
thence from the above described true place of beginning S 85058, W
447.5 feet to a point in County Rd.No.179, which point is on the
Northwesterly line of said Wormsborg tract; thence N 40000! E along
said northwesterly line and in said County Rd. 294.1 feet to a point;
thence S 740201E 268.4 feet to an iron pipe on the East line of
said Wormsborg tract; thence S 0°28' W 121.3 feet to the place of
beginning.
Section 2: That the Recorder of the City of Tigard be, and she is
T�'_._ her,eby directed, within 10 days from the date hereof,
to make and submit to the Secretary of State of Oregon:
a. A certified copy of this ordinance of annexation .
b. A certified copy of the statement of consent of
the landowners in the territory annexed.
c. A certified copy of Ordinance No.67-69 whereby the
City Councii declared that no election is required
in the City,
and to file herein the acknowledgment of the Secretary of State of
said filing.
Section 3: That the Recorder of the. City of Tigard be, and she is
hereby directed, within 10.day; from the date hereof, to
file with each of the Department of Revenue and Taxation and the
Department of Records and Elections of the County of Washington,
the following:
a. A certified copy of this ordinance of annexation
b. A certified copy of Ordinance No.67-69
and that a copy of this Ordinance be directed to the Office of the
Washington County Surveyor, and to file herein the acknowledgments
of d Departments of said filings.
Section 4: The annexation hereby ordained shall be effective on the
date of filing with the Secretary of State of Oregon the
copies of proceedings as in Section 2 hereof required to be filed,
and from and after said date the hereinabove described and annexed
territory shall be and remain a part of the City of Tigard,
PASSED: By the Council, by unanimous vote of all Council members
present, after being read three times by number and
title only, this 18 day of.December 1967
