ORDINANCE No.67- -7,o
AN ORDINANCE GRANTING A ZONE CHANGE WITH RESPECT TO THE LANDS OF
COMMERCE DEVELOPMENT CO., INC,, in Sec. 35; T1S, R1W, W.M.,
f TIGARD, WASHINGTON COUNTY., OREGON
WHEREAS, the hereinafter described lands, by action of the
City Council of the City of Tigard, Oregon, pursuant to the Zoning
Code of said City, have heretofore been limited in use to those uses
permitted by said Code, under, and have been classified and zoned
for R-7 (Residential) and
WHEREAS, pursuant to prescribed procedures, the owners of
said lands have applied. to the City of Tigard for reclassification of
said property and change of zone thereof to permit the use thereof
for A-2 (Multiple Dwe-Iling) purposes, and said ,pplication has
been duly publicized and public hearing held by the City Planning
Commission on November 2i, 1967 after due and legal notice; and
WHEREAS, the City Planning Commission has recommended approval
of` said zone change to the City Council, and due and legal notice of
City Council hearing having been given by publication in the Tigard
Times, and the City Council having heard same as its regular meeting
Of December 11, 196 _, and the Councilfinding that no public
detriment will result from ;ranting of said petition, and that it is
in the public interest that said zone change be approved, and the
lands re-zoned from R-7 (Residential) to A-2 (Multiple Duelling;
NOW, THEREFORE,
THE CITY OF 'TIGARD ORDAIN:; A5 FOLLOWS:
Section 1: That the following described lands be, and the same are
here
byy zoned as A-2 for use in accordance with the
A-2 (Multiple Dwel�ing) classification of the Zoning Code
of the City of Tigard, which Zoning Code with respect to the A-2
classification is by reference herein made a part heveof:
As set forth on the attached sheet headed
"DESCRIPTION" which by this reference herein
is made a part hereof.
Section 2: This ordinance shall be effective on the 31st day after

PASSED: By unanimous vote of all Council members present, after
being read three times by number and title only,

�. DESCRIPTION
PARCEL I: Beginning at a point on a line parallel with the
south line of the D. C. Graham D.L.C. in Sec. 35, T1S, R1W,
W.M., Washington County, Oregon, 15.25 chains East and 20.39
chains North of the southwest corner of said D.L.C.; thence
N400E 0.62 chains; thence N 880101E 12.37 chains; thence
S 00101E to the south side line of the Oregon Electric Co.'s
right of way and the true place of beginning; thence S520081W
following said south line of said right of way to the southeast
corner of that certain tract conveyed to Gloria Mae Perry in
Deed Book 545, page 463, Washington County, Oregon Deed
Records; thence N 0020' E along the east line of said tract
to the northeast corner thereof; thence N880101E to the east
line of that certain tract conveyed to Conrad E. Anderson and
Irene S. Anderson in Deed Book 254, page 793, said Deed Records;
thence S 0010' East to the true place of beginning;
EXCEPTING THEREFROM that portian conveyed to the
State of Oregon, by and through its State Highway Commission
by deeds recorded in Book 449, page 12 and Book 514, page
239, said Deed Records.
PARCEL II: Part of Sec. 35, TIS, R1W, W.M., Washington County,
Oregon, described as follows:
Beginning at the southeast corner of that tract
conveyed to Cary H. Cotton et ux by Deed Book 361 page 583,
which point bears S 880101W 643.8 feet and S 00201E 466.5 feet
from the southeast corner of Lot 5, Ashbrook Farm; thence
S880101W 100 feet to the southwest corner of said Cotton tract;
thence N 00201W on the west line of said Cotton tract 75 feet;
thence 3880101W a distance of 100 feet to a point on the West
line of that tract conveyed to Conrad E. Anderson et ux by
Deed Book 254, page 793, said point being the northeast corner
of that tract conveyed to Herbert Olson et al by Deed Book
649 page 240 of said County; thence S 00201E on the wrest line
of said Anderson tract and on the wrest line of that tract con-
veyed to Conrad E. Anderson by Deed Book 258, page 279 to the
southwest corner thereof; thence northeasterly on the south-
easterly line of said last mentioned Anderson tract to a point
which bears S 00201E from the place of beginning; thence
013201„1 ar,l,P, with the WEst line of said .Anderson tracts
to the place of beginning.
