{� AN ORDINANCE SETTING HEARING WITH RESPECT TO PROPOSED ANNEXA-
TION OF THE LANDS OF COMMERCE DEVELOPMENT COMPANY, INC.
In Sec. 35, T1S, R1W, W.M. (annexation #2)
WASHINGTON COUNTY, OREGON, AND DIRECTING GIVING OF NOTICE THEREOF.
WHEREAS, there has heretofore been filed with the City Re-
corder of the City of Tigard, petition for annexation of certain
lands in Sec. 35, T1S, R1W, W.N. ,
Washington County, Oregon, ^s hereinafter described; and
WHEREAS, said promises are contiguous to the Citv of Tigard
and not vithin the corporate linins of any other City, and lie
wholly within the County of Washington, State of Oregon; and
WHEREAS, It appears that said premises may properly be
annexed to the City of Tigard without submitting the question to
the registered voters of the territory, since the owners thereof,
COMMERCE DEVELOPMENT COMPANY, INC.
have by signed petition requested and consented to said annexation;
NOW, THEREFORE,
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section ': That the City Council of the City of Tigard does hereby
elect to dispense with submitting the question of the
annexation of the hereinafter described premises to the registered
rooters of the City.
Section 2: That Monday, the 18 day of December , 196 7 at the
hour of 8:00 p.m., at the City Hall in the City of
Tigard, be, and the same is, hereby fixed as the date, time and place
for public hearing before the City Council of Tigard of the petition

for annexation of the hereinafter described lands to the City of
Tiaq,,.ar and all registered voters of the Cit: may appear at said
Tigard,
time and place and be heard on the question of said annexation.
Section 3: The City Recorder of the City of Tigard be, and she is
hereby, directed to give notice of said hearing by pub
1lcation once each week for two successive weeks, or three publish
ings in all, prior to the date of the hearing, in the Tigard Times, r
a newspaper of general circulation in the City, and said Recorder
be, and she is hereby further directed to past notices of said hear-
ing in four public places in the City of Tigard for a like period.
Section 4: That the area proposed to be annexed be, and the same

Beginning at the SW corner of the D.C.Oraham D.L.C.#52, TlS,

the South line of said D.L.C. 1001.9 feet to an iron piP6; thence
North 0028' E. 843.9 feet to an Iven pipe on the East line of that
certain tact of land conveyed to Andrew Wurmsborg by deed recorded
s. on page 9 of Vol.201 Washington County, Oregon, Deed Records, which
point is the true place of beginning of the herein described tract;
thence from the above described true place of beginning S 85058' W
447.5 feet to a point in County Rd.No.179, which point is on the
Northwesterly line of said Worm4boxg tract; thenee N 40000 E along
said northwesterly '.%.;_ and in said Court r,Rd. 294.1 feet to a point;
thence S 740201 a '3.4 feet to an iron pipe on the vast line of
aa id Wormsborg tract; thence S 0028" W 121.3 feat to the place of
beginning.

Section 55: lnasmu4h as the hearing of the petition for annexation
of the lands herein described should be conducted with
the least possible delay, an emergency is hereby declared to exist,
and it is declared to be necessary for the peace, health and safety
of the City of Tigard that this ordinance become effectiveuponits
n passage by the Council and signature by the Mayor.
PASSED: By the Council, by unanimous vote of all Council members
_ present, after being read three times by number and
title only, this 27 day of November 196 7.
