Ordinance No. 67-59 i CITY OF TIGARD, OREGON ' ORDINANCE No.6?--4 AN ORDINANCE DETERMINING THE FINAL COST OF STREET IMPROVE- MENTS IN THE "S. W. MAIN STREET IMPROVEMENT DISTRICT"; DETERMINING THE PORTION OF SAID COST TO BE BORNE BY THE PROPERTIES BENEFITED BY i SAID IMPROVEMENTS; RATIFYING AND ADOPTING THE FINAL APPORTIONMENT AND ASSESSMENT OF SUCH PORTION OF THE COST TO THE RESPECTIVE LOTS, PARTS OF LOTS AND PARCELS 0�K LAND WITHIN THE ASSESSMENT DISTRICT ACCORDING' TO THE SPECIAL AND PECULIAR BENEFITS ACCRUING THERETO FROM THE IMPROVEMENT; DISPOSING OF REMONSTRANCES FILED WITH RESPECT TO THE DEFICIT ASSESSMENT THEREOF; SPREADING THE ASSESSMENT; DIRECTING THE CITY RECORDER TO ENTER ALL ASSESSMENTS, INCLUDING INITIAL AND DEFICIT ASSESSMENTS, AS A SEPARATE LIEN AGAINST EACH TRACT IN A SEPARATE LIEN DOCKET OF THE CITY; DECLARING SAME TO BE A LIEN ON THE RESPECTIVE PROPERTIES UNTIL PAID; AND DECLARING AN EMERGENCY. THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section 1: THE COUNCIL FINDS that by resolution duly adopted by the City Council on February 3.3, 1967, the City of Tigard declared an intention to construct certain improvements within an area known as the "S.W.MAIN STREET IMPROVEMENT DISTRICT", and thereby approved plans and specifications for the work and set a public hear- ing with respect thereto, and said hearing was duly held on March 6, 1967. Section 2: THE COUNCIL FURTHER FINDS that by Ordinance No.67-23 duly adopted by the City Council on March 13, 1967, objections and remonstrances to the said improvement were overruled, and the City Administrator and the City Engineer were directed to proceed with the work and a contract was duly authorized with Dale's Sand and Gravel with a total bid price of $87,014.30, and based on said esti- mated contractual cost of the work and other costs incident thereto, the City Recorder was directed to give nc�ice to the property owners of the spreading of the assessment. Seciion 3: THE COUNCIL FURTHER FINDS that notice of the assessment against each property for its proportionate share of the cost thereof was duly and regularlygiven to each property owner in the manner required by Ordinance No.62-6 of the City of Tigard. Section 4: THE COUNCIL FURTHER FINDS that at its regular meeting of June 26, 1967, the Council considered all objections to the assessment filed thereagainst and same were duly considered and adjusted or overruled, and the City Recorder was thereby directed to enter against each and all of said lots the proportionate amount of the assessment thereagainst and to record the same in the Lien Docket of the City in the manner provided by Ordinance No.62-6, and all of said matters were duly recorded, ratified and confirmed by Ordinance No.67-33 duly passed by the City Council on June 26, 1967, whereby the Council further reserved the right to adjust the assess- ments on a proportionate basis with respect to any greater or lesser cost of the total work than as estimated. Section 5: THE COUNCIL FURTHER FINDS that said work as awarded to Dale's Sand and Gravel was thereafter diligently prose- cuted and, during the course of performance, additional work at an Page 1 - ORDINANCE No:67- j_ 4 increased cost was necessarily authorized and ordered, due to changed ! conditions and the latent instability of the ground disclosed by excavation, such extra work being ordered on a unit-price basis under the bidding schedule of the contract, bringing the completed total 4_. final cost of construction and other costs of the project to the sum of $131,040.51, of which $26,000. as previously authorized represents the contribution from public funds, leaving a net total balance to be assessed against the properties in the sum of $105,040.51 as compared to the total estimated cost of $86,059.47 previously apportioned and i assessed against the properties. Section 6: THE COUNCIL FURTHER FINDS that pursuant to Section 8 of Ordinance No.62-6, the initial assessment having been made on an estimated cost basis, the City Council must now provide for a deficit assessment for the additional cost, and the City Engineer has submitted a proposed schedule of re-assessment upon the respective tracts within the assessment diwtrict for the proportionate share of the deficit. Section 7: THE CITY COUNCIL FURTHER FINDS and hereby determines that the City Recorder has heretofore mailed, or personally delivered, to the oviners of each lot-, part of lot or parcel of land proposed to be further assessed, a notice of said deficit assessment, which notice stated the amount of the initial estimated assessment, the amount of the deficit assessment, and the amount of the total final assessment with respect to each property, and also stating the date by which time any objection shall be filed with the City Recorder and requiring that such objections shall state the grounds therefor. Section 8: THE CITY COUNCIL FURTHER F114DS that at its regular meeting of October 9, 1967 the deficit assessments and all ob- jections thereto filed with the City Recorder were duly considered, and the City Council does hereby further find ar.d determine that said assessments were properly apportioned according to the special and peculiar benefits accruing to each lot, part of lot or parcel within said improvement district, a.yid each tract as designated on the attached appottionment schedule be, and the same is hereby, assessed and charged with the initial aasess!nent and a deficit assessment, and the total thereof, as shown on the line opposite each tract on the attached Schedule "A", to the extent not heretofore paid, shall constitute a lien thereagainst from and after the passage of this ordinance and entry thereof in the City Lien Docket as hereinafter provided. Section 9: The City Recorder be, and she is hereby, directed to enter each and all of said lots, parts of lots or parcels and the amount of assessment tnereagaznsc., as Nh::.,n by the attached Schedule "A", in the Lien Docket of the City separate from other prior or subsequent aosessments, and the same shall constitute a lien against each respective, lot, part of lot or parcel and bear interest at 6% per annum until paid. Section_ 10: Inasmuch as it is necessary for the preservation of the public peace, health and safety of the people of the City of Tigard that this ordinance take effect immediately in order that final provision may be made for payment of the cost of con- struction of said improvements and the final determination of the assessments therefor, an emergency is hereby declared to exist and Page 2 - ORDINANCE No.67- S x, this ordinance shall be effective upon its passage by the Council and signature by the Mayor.
