Ordinance No. 67-54 CITY OF TIGARD; OREGON ORDINANCE No. 67 - ,�` AN ORDINANCE ANNEXING TO THE CITY OF TIGARD LANDS OF H. RUSSELL GOULD et ux, RAYMOND B. EMS et ux, OTTO TEUSCHER & WILFRED T. P.00KE et ux, in Sec.l, T2S, R13,W.M.,WASHINGTON COUNTY, OREGON WHEREAS, the owners of the hereinafter described lands have petitioned the City of Tigard to annex the same to the City, and have filed consent to said annexation with the City Recorder under date of theme_ day of Auxust 1967; and WHEREAS, the lands hereinafter described and proposed to be annexed are contiguous to the corporate limits of the City of Tigard and are riot within the corocrate limits of any city and lie wholly within the County of Washington, State of Oregon, and are, in all re- spects, qualified to be annexed to the City of Tigard; and WHEREAS, by Ordinance No.67-v 7 duly enacted by the City Council of Tigard on the 28 day ofAugust �, 1967, the City Council of Tigard did elect to dispense with submitting the annexation proposal to the registered voters of the City of Tigard, and did by said ordinance set Monday the 19 day of September , 1967, at the hour of 8:00 o'clock p.m. at the City Hall, Tigard, Oregon, ac the time and place for public hearing by the Council of said annexation proposal; and tdHEREAS, said hearing ofSer,tesuer 8, 1967 wag duly publicized by notice published once each weee for two successive weeks, or three publisnings in all, to-wit: On the 31_ day Of u t , 1967, the 7 day of September 19, and the day of Se tember , 19F, , in the Tigard Times, a newspaper of general circulation and published in the City of Tigard, Oregon; that an affi davit of said publication is on file herein and that notice of said hearing was further given by posting in four public and conspicuous places within the City of Tigard for a like period and that the affi- davit of the City Recorder with respect to said posting is on file herein; and WHEREAS, the hearing on said proposal was duly and regularly held at the City Hall, City of Tigard, on �SSelo�tee�mber 18, , 196; at the hour of 8:00 O'clock P.M., whereat all interes-fed persons and registered voters of the City desiring to be heard, were heard, and said hearing was duly closed; and WHEREAS, it appears that: all statutory requirements for the annexation of the following described area to the City of Tigard have received full compliance and that said area may be-lawfully annexed to the City of Tigard: NOW, THEREFORE, TIME CITY OF TIGARD ORDAINS AS FOLLOWS: Section. l: That all of the following described lands be, and the same are, hereby annexed to the City of Tigard, and the bound- aries of the City of Tigard be, and they are, hereby extended to include the following described lands within the said boundaries: Pat 1ORDINANCE No. 67 - �_ z Beginning at the i:iitial point of ROLLING HILLS PLAT 2 a subdivision of record, Washington County, Oregon; thence N88°51'l0'�W.780.42 feet to the Southwest corner of Lot 37 in said subdivision, said lot corner also being on the boundary line of the existing corporate limits of the City of Tigard, Oregon; thence following along said corporate boundary southeasterly 670 feet, more or less, to the Southeast corner of the tract of land conveyed to Raymond B. Ems by deed recorded on P.324 Bk.339 of Washington County, Oregon Deed Records; thence NW 42'30" E 16.2 feet along the South line of the W>W-Graham D.L.C.#39; thence N 0°59'50" E. 24.02 feet to an iron pipe; thence N89037' E. 623.80 feet to an iron pipe set in the WEsterly right-of-way line of County Road No.472; thence S 0030' W. along said right-of-way line 24.02 feet to the South line of said D.L..C.#39; thence N89*371 E. 20 feeto Southeast corner of said claim; thence N 0°303E. along thetEastthe line Of said claim 415.7 feet; thence N89024' W. along theNorth line of that tract of land conveyed to Leo Van Vorst and Betty Van Vorst recorded in Bk-363 p-352 of said Deed Records, and extension a distance of 350.0 feet to a point on the 'Westerly right-of-way line of S.W.74th Avenue; thence N 0059'50" E. 54 feet, more or less, to a point on the South line of said Rolling Hills #2 subdivision; thence N88°51110" W. along said subdivision, a distance of 10 feet to the point of beginning. Section 2: That the Recorder of the City of Tigard be, and she is hereby directed, within 10 days from the date hereof, to make and submit to the Secretary of State of Oregon: a. A certified copy of this ordinance of annexation b. A certified copy of the statement of consent of the landowners in the territory annexed c. A certified copy Of Ordinance t4o.67- 147 whereby the City Council declared that no election is required in the City, and to file herein the acknowledgment Of the Secretary of State of said filing. SectZon 3: That the Recorder of the City of Tigard be, and she is herEby divacted, within 10 days from she date hereof, to file with each of the Department of Revenue and Taxation and the Department of Records and Elections of the County of Wasnington, the following: '. A certified copy of this ordinance of annexation b. A certified copy of Ordinance No.67- 47 and that a copy of this Ordinance be directed to the Office of the Washington County Surveyor, and to file herein the acknowledgments of said Departments of said filings. Section 4: The annexation hereby ordained shall be effective on the date of filing with the Secretary of State of Oregon the copies of proceedings as in Section 2 hereof required to be filed, and from and after said date the hereinabove described and annexed territory shall be and remain a part of the City of Tigard.
