Ordinance No. 67-53 CITY OF TIGARD, OREGON ORDINANCE No. 67-_9'3 AN ORDINANCE REGULATING THE ERECTION, CONSTRUCTION, ENLARGE- MENT, ALTERATION, REPAIR, MOVING, REMOVAL, CONVERSION, DEMOLITION, OCCUPANCY, EQUIPMENT, USE, HEIGHT, AREA, AND MAINTENANCE OF BUILD- INGS, SIGNS AND/OR STRUCTURES IN THE CITY OF TIGARD, OREGON; PRO- VIDING FOR THE ISSUANCE OF PERMITS AND COLLECTIONS OF FEES THEREFOR; PROVIDING PENALTIES FOR THE VIOLATION THEREOF, AND REPEALING ORDI- NANCES #63-2, #64-3 and #65-10 AND ALL OTHER ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH. THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section 1: This ordinance shall be known as the "BUILDING CODE", may be cited as such, and will be referred to herein as "this Code". Section 2: The Uniform Building Code, 1967 Edition, Volumes I, III and V, published In 1967 by the International Confer- ence of Building Officials, including Chapter 70, appendix of the 1967 Edition of the Uniform Building Code, published by the Inter- national Conference of Building Officials, hereinafter referred to as "The Uniform Building Code", be, and the same is hereby, incor- porated by reference herein to the same legal force and effect as if set forth herein in full, part by part, chapter by chapter, and section by section, under authority of §221.330 O.R.S., which by reference herein is likewise made a part hereof. Section 3: The snow load factor applicable in connection with the design of all structures with respect to which the snow load factor is applied, shall be twenty-five (25) pounds per square foot. Section 4: FEES Notwithstanding the provisions and fees contained in Section 303(a) Uniform Building Code, 1967 Edition, Vol. I (Building Permit Fees), hereinabove referenced, building permit fees are hereby eztaalished as follows. (a) No fees shall be exacted for work undertaken by the City of Tigard; by the State of Oregon, its subdivisions or agencies; by the Federal Govern- ment_ its subdivisions or agencies; by Washington County, or by any school district, if the work be done by such governmental units' own employees. (b) Fees for the issuance of permits for circuses, animal shows, wild west shows or similar exhibi- tions held in tents shall be $100.00 (c) Fees for all other activities conducted within the definitions and purview of the "Uniform Building Code" as hereinabove adopted, shall be computed on Page 1 - ORDINANCE No.67- the basis of the total estimated over-all completed cost of the work at the following rates: Value of the Work Permit Fee $1.00 to $1,000.00 $10.00 $1,001.00 to $25,000.00 $10.00 for the first $1,00Q. plus $3.00 for each additional thousand or fraction thereof, to and includ- ing $25,000, $25,001.00 to $50,000.00 $82.00 for the first $25,000. plus $2.50 for each additional thousand or fraction thereof, to and includ- Ing $50,000, $50,001.00 to $100,000.00 $143.00 for the first $50,000. plus $1.50 for each additional thousand or fraction thereof, to and includ- Ing $100,00.0. $100,001.00 and up $1 .005forfor eachthe additionalOthousa000- nus d or fraction thereof. (d) All persons or organizations undertaking to erect, remodel, alter or modify any structure for which a permit shall be required under the provisions of this Code, and who shall not have obtained a permit for such work prior to the initiation thereof, and for which a stop-work order is issued, shall pay a $25.00 inspection fee to the City of Tigard whether or not a building permit is later applied for and issued. Section 5: r4r%UTPIG OIC BUILDINGS OR STRUCTURES FROM OUTSIDE THTHE CITY All provisions of the Building Code of the City of Tigard as adopted hereby shall have equal force and effect with respect to buildings moved from outside the city limits and relo- cated on any lot or tract within the City limits, to the same extent as for new construction within the City. (a) No building or structure shall be moved from outside the corporate limits of the City of Tigard to any point within the corporate limits of theCity of Tigard, for than purpose of locating same on any lot or tract for occupancy for any purpose, unless an application and permit in the form prescribed by the City of Tigard shall be first filed with the City and a moving permit issued by the City Building Inspector. (b) No moving permit shall be issued by the City. Building Inspector to authorize the locating on any lot or tract within the corporate limits of theCity of Tigard of any building or structure proposed to be moved from outside the corporate limits of the City Page 2 :- ORDINANCE No.67- 13_ �r to within the corporate limits of the City, unless the application �.erein provided shall have been filed, the moving permit fee paid, and the said Inspector shall have determined from a personal inspection that such building or structure proposed to be brought within the City shall be constructed in conformity with the Building Code of theCity of Tigard, including all structural requirements, electrical installations, plumbing installations and other feathres thereof. (c) All buildinC: or structures relocated on any lot or tract within the City of Tigard from any location outside the City of Tigard, shall be established iii strict conformity with the Building Code of the City of Tigard and shall be subject to the inspec- tions required by the Building Code, and same shall not be occupied for any purpose until the standards prescribed by the Building Code shall have been met. (d) There shall be collected from each applicant for a building permit at the time of or prior to the issu- ance of the permit, the moving permit fee of $20.00, which shall include two in3pections by the City Building Inspector, _provided that for each additional inspection in excess of two by the City Building In- spector, the permittee shall pay the additional sum of $5.00. Section 6: FIRE ZONES The definition. of Fire Zones described by Part IV, Chapter 16, Section 1601, Vo =c I of the Uniform Building Code hereinabove referenced, are hereby adopted except that said Section 160l(a) is hereby amended to read as follows: "See.1601(a) Fire Zone:, Defined. For the purpose of this Code, the entire city is hereby declared to be and is hereby established a Fire District and said Fire District shall be known and desig- nated as Fire Zones One, Two, and Three, and shall include such territory or portions of said City as outlined in Ordinance No.67-21 bearing the short title as therein prescribed: 'CITY OF TIGARD ZONING ORDINANCE OF 19671. Whenever in this Code refer- ence is made to any fire zone, it shall be construed to mean one of the fire zones created by said ordinance." Section 7: PENALTIES: The penalties provided by Part I, Chapter 2, Senor, 20.5, Volume I of the Uniform Building Code, as hereinabove adopted, shall be applicable to. violat3:ons of this Ordinance and of the Uniform Building Code; Section 205. reading as follows: "It shall be unlawful for any person, firm, or'cor- poration to erect, construct, enlarge, alter, repair, move, improve, remove, convert or demolish, equip, use, occupy or maintain any building or structure Page 3 - ORDINANCE No.67- - t in the city, or cause the same to be done, contrary to or in violation of any of the provisions of this Code. "Any person, firm, or corporation violating any of the provisions of this Code shall be deemed guilty of a misdemeanor, and each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of this Code is committed, continued, or permitted, and upon con- viction of any such violation such person shall be punishable by a fine of not more than $3000, or by imprisonment for not more than 90 clays, or by both such fine and imprisonment." Section 8: That Ordinances numbered 63-2, 64-3 and 65-10, and any other ordinance or portions of ordinances which shall be inconsistent with the provisions hereof or of the said Uniform Building Code of 1967, as hereinabove adopted, be, and the same are, hereby repealed effective with the effective date of this Ordinance. Section 9: This Ordinance shall be effective on and after the 31st day after its enactment by the City Council of the City of Tigard, Oregon.
