Ordinance No. 67-38 CITY OF TIGARD, OREGON ORDINANCE No.67- :8 AN ORDINANCE RATIFYING AND CONFIRMING ALL PRIOR PROCEEDINGS WITH RESPECT TO THE "S. W. MAIN STREET IMPROVEMENT DISTRICT; CON- FIRMING PRIOR DETERMINATION HERETOFORE MADE THAT THE PROPERTIES ABUTTING UPON S. W. MAIN STREET ARE SPECIALLY BENEFITTED AND DECLAR- ING THAT THE TOTAL ESTIMATED COST OF THE WORK BEING UNDERTAKEN, EXCEPT FOR THE SUM OF $26,000., SHALL BE APPORTIONED AND ASSESSED TO THE SAID PROPERTIES; DISPOSING OF OBJECTIONS TO THE SAID ASSESSMENTS AFTER HEARING THEREOF; RATIFYING AND ADOPTING THE APPORTIONMENT AND ASSESSMENT OF THE ESTIMATED COST TO THE RESPECTIVE LANDS WITHIN THE ASSESSMENT DISTRICT ACCORDING TO THE SPECIAL AND PECULIAR BENEFITS ACCRUING THERETO FROM THE IMPROVEMENT; SPREADING THE ASSESSMENT; DIRECTING THE CITY RECORDER TO ENTER ALL ASSESSMENTS IN A SEPARATE LIEN DOCKET OF THE CITY; RESERVING THE RIGHT TO ADJUST THE ASSESS- MENTS ON A PROPORTIONATE BASIS WITH RESPECT TO ANY GREATER OR LESSER COST OF THE TOTAL WORK THAN AS ESTIMATED AND DECLARING SAME TO BE A LIEN ON THE RESPECTIVE PROPERTIES UNTIL PAID; AND DECLARING AN EMERGENCY. THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section 1: The Council finds that by resolution #7 adopted on May 22, 1967, the Council directed that construction oz improvements within S. W. Main Street Improvement District as described in Ordinance No.67-23 be performed by contract with DALE'S SAND AND GRAVEL COMPANY, INC., and the said construction is now underway. Section 2: The Council further finds that the total cost of the work plus the engineering and other costs estimated for the total work project is the sum of $ 112,0211 , and the Council further finds and hereby determines that of the said total estimated cost the sum of $26,000. is the amount to be paid by the City includ- ing a contribution of $6,000. by Washington County in recognition of the general benefits of said improvement, and that =he remaining sum of $ 86,059.47 is the estimated amount that shall be assessed to the properties specially benefitted on a front-foot basis, and all of said frontage shall bear all of said remaining cost of said improvement subject to adjustment by increase or decrease upon final completion of the work. and Section 3: The Council further finds/hereby determines that the apportionment of said estimated cost of said improve- ment upon each lot, part or parcel as prepared by the City Engineer, as set forth in the attached schedule entitled"Main Street Improve- which reference herein is made part hereof, is IlltiII{. Assessment, n by of+++--� apportioned and assessed according to the special_ and peculiar bene- fits accruing to each part and parcel from the said improvement. Section 4: The Council further finds and hereby determines that the City Recorder of Tigard has heretofore mailed or caused to be personally delivered to the owner of each lot proposed to be assessed, a notice of preliminary assessment, which notice stated the amount of the estimated assessment proposed on that property and also stated a date by which time objections should be filed with the City Recorder and requiring that any such objections shall state the grounds therefor. Page 1 ORDINANCE No.67- 3$ r. 4, �.., Section 5: The Council further finds that at its regular meeting of June 26, 1967, the City Engineer's estimates of assessments and all objections thereto filed with the City Recorder within the time thereby limited, were duly considered and adjusted or overruled, and the City Council does hereby determine that the said assessments are properly apportioned according to the special and peculiar benefits accruing to each parcel within said S. W. MAIN STREET IMPROVEMENT! DISTRICT, and each lot, parcel or part of lot as designated on the attached apportionment schedule, be, and the same is, hereby assessed and charged with the total sum shown on the line opposite each thereof and same shall constitute a lien thereagainst from and after the passage of this Ordinance and entry thereof in the City Lien Record as hereinafter provided, subject to adjustment by increase or decrease in recognition of the final cost of said project when known. Section 6: The City Recorder be, and she is, hereby directed to enter each and all of said lots, parts of lots or parcels and the amount of assessment thereagainst, as shown by the attached schedule, in the Lien Docket of the City separate from other prior or subsequent assessments and same shall constitute a lien against each respective lot, part of lot or parcel and bear interest at 6% per anmmn until paid. Section 7^ Inasmuch as it is necessary for the preservation of the public: peace, health and safety of the people of the City of Tigard that this ordinance take effect immediately in order that final provision may be made for payment of the cost of construction of said street improvement and the final determination of the assess- ments therefor, an emergency is hereby declared to exist and this ordinance shall be effective upon its passage by the Counbi.l and signature by the Mayor.
