Ordinance No. 67-35 CITY OF TICAPD, OZEGON ORDINAINCE No. C7 - 35 AN ORDINANCE ANNEX{',i TO THE CITY OF TT_CP.RD LANIDS OF LAWRENCE M. BASTIAN et ux and JOHN A. GLAUBKE et ux, t. in See. 34, T1S, R1W, W.M., WASHINGTON COUNTY, OREGON rlilE]FEAS, the owners of the hereinafter described lands have petitioned the City of Tigard to anlex the same to th-, City, and have filed concent to said annexation with the City Recorder tinder date of the 24 day of April , 1967; and WFlERE.S, the lands hereinafter described and proposed to be annexed are contiguous to the corporate limits of the City of Tigard and are not within the corporate limits of any city and lie wholly within the County of 'Washington, State of Oregon, and are, in all re- spects, qualified to be annexed to the City of Tigard; and WHEREAS, by Ordinance PIo.t7-26 duly en=cted by the City Council of Tigard on the 24 dsy of Apri h___, 19t7, the City Council of Tigard did elect to dispense with ;;ut7,ltting the annexation proposal to the registered voters of the City of TigardI and dict by said ordinance set Monday the 22day of May 1967, at the hour of 8:00 o'clock p.m, at tie City Hall, Tigard, Oregon, as the time and place for public hearing by the Council of said annexation proposal; and laERE,"', said hearing of May 22, 1967 was duly publicized by notice published once e ch weel for treo successive weeks, or three publishings in all, to-wit: Or. the 4 clay of MaV ' 1967, the -11 day of May 8 1907, and the 1day of May: , 1967, in the Tigard Times, a rayspape: of general circulation an published in the City of Tigard, Ore�-on; that an affi- davit of said publication is on file herein and thatnoticeof said `hearing was further given by posting in four public and conspicuous places within the City of Tigard for a like period and that the affi- davit of the City Recorder with respect to saidpostingis on file herein; and WFERE AS, the hearing on said proposal was duly and regularly held at the City Hall, City of Tigard, an May 22 19c`7 at the hour of 8:00 O'clock P.M., whereat all ia'-Z ed reoi oer ons and registered voters of the City desiring to be heard, were heard, and said hearing was duly closed; and WHEREAS, it appears that all statutory rc:quirc:cents for the 2xnexation of tte following described area to the City of Tigard have received full compliance and that said area -may be lay.,fully annexed to the City of Tigard, NOW, TtIEREFORE, THECITY O: TIGARD ORDAINS A3 FOLLOWS: Section 1: That all of the folloi•ring described lands be, and the same arc, hereby annexed to the City of Tigard, and the bound- aries of the City of Tigard be, and they are, hereby e;:tended to include the following described lands within the said boundaries: 1' - ORDINANCE No. 6 7 - 35 rz Beginning at a stake on the South line of the N112 of John L,Hicklin DLC CPn Sec.34, T1S,R114,W.M.,Washington County, Oregon, at the Southwest of tract conveyed to Henry Tiedemann et ux as described on page 390 in Bk.450,Washington County, Oregon, Deed Records and which southwest corner is said to bear 23.065 chains East from the southwest corner of said N1/2 of'said DLC; thence North along the west line of said Tiedemann tract, 25.0 feet to the north line of the corporate limits of the City of Tigard, and true beginning point of the tract herein described; thence continuing North along said west line 972,0 feet to the northwest corner ( thereof; thence East along the centerline of said N1/2 of said DLC 1268.0 feet, more or less, to the center of Fanno Creek; thence Southerly in the center of said Creek 20,0 feet to the northwest corner of Parcel 1, of the tract conveyed to Lester G. Mock et ux as described on page 86 in Bk. 492,. said Deed Records; thence continuing Southerly in said Creek, 95,0 feet, more or less, to the southwest corner of said Mock tract; thence S:66°441E. 212,4 feet to an iron pipe at the southeast corner of said Mock tract; thence continuing; S.66044tE, 20.0 feet,more or less,to the center of Tiedeman Road; thence Southwesterly in center of said Road, 664.0 feet-,more or less,to a point 50.0 feet distant northerly, when measured at right angles from the easterly extension of the north lire of tract conveyed to Clarence B. Baney et ux as described on page 234 in Book 381, said Deed Records; thence westerly, southerly and westerly along said north line of said Corporate Limits to the true place of beginning. Section 2: That the Recorder of the City of Tigard be, and she is hereby directed, within 10 days from the ::ate hereof, to make and submit to the Secretary of State of Oregon: a. A certified copy of this ordinance of annexation b. A certified copy of the statement of consent of the landowners in the territory annexed C. A certified copy of Ordinance No.67-26 whereby the City Council declared that no election is required In the City, and to file herein the acknowledgment of the Secretary of State of said filing. Section 3: That the Recorder of the City of Tigard be, and she is hereby directed, within 10 days fro . ,. e date hereof, to "ile with each of the Department of Revenue and Ta,-ation and the Department of Records and Elections of the County of Vlasnington, the following: a. 1 certified copy of this ordinance of annexation b. A-certified copy of Ordinance No.67-26 , and that a copy of this Ordinance be directed to the Office of the Washington County Surveyor, and to file herein the acknowledgments of said Departxents of said filings. Section 4: The annexation hereby ordained shall be effective on the date of filing with the Secretary of State of Orcron the copies of proceedings as in Section 2 hereof reauir•sd to be filed, and from and after said date the hereinabove described and annexed territory shall be and remain a part of the City of TIGard.
