Ordinance No. 67-04 CITY OF TIGARD, OREGON ORDINANCE No. 67 - 4 AN ORDINANCE ANNEXING TO THE CITY OF TIGARD LANDS OF A. E. DuMars and Leota R. DuMars in Sec. 34, T1S, R1W, W.M. 3 WASHINGTON COUNTY, OREGON WHEREAS, the owners of the hereinafter described lands have petitioned thq City of Tigard to annex the same to the City, and have filed consent to said annexation with the City Recorder under date of the 21 day of November , 1966; and WHEREAS, the lands hereinafter described and proposed to be annexed are contiguous to the corporate limits of the City of Tigard and are not within the corporate limits of any city and lie wholly within the County of Washington, State of Oregon, and are, in all re- spects, qualified to be annexed to the City of Tigard; and WHEREAS, by Ordinance No.66-16 duly enacted by the City Council of Tigard on the 28 day of November , 1966, the City Council of Tigard did elect to dispense with submitting the annexation proposal to the registered voters of the City of Tigard, and did by said ordinance set Monday the 9th day of3anuary , 1967, at the hour of 8:00 o'clock p.m. at the City Hall, Tigard, uregon, as the time and place for public hearing by the Council of said annexation proposal; and WHEREAS, said hearing of January 9._1967 — was duly publicized by notice published once eac�r two successive weeks, or three publishings in all, to-wit: On the 22 day of December 1966, the 29 day of December 19To, and the 5 eday—Of nuary, _day_ in the Tigard Times, a nowspap.^^.r of general circuion and published in the City of Tigard, Oregon; that an affi- davit of said publication is on file herein and that notice of said hearing was further given by posting in four public and conspicuous places within the City of Tigard for a like period and that the affi- davit of the City Recorder with respect to said posting is on file herein; and WHEREAS, the hearing on said proposal was duly and regularly held at the City Hall, City of Tigard, on Januar,�y 9. , 1967 at the s hour of 8:00 O'clock P.M., whereat all intera persons and registered f '.,he City wing t P voters o� �.,.� ice,+ desiring 0 b_.heard, were heard, and said hearing was duly closed; and WHEREAS, it appears that all statutory requirements for the annexation of the following described area to the City of Tigard have received full compliance and that said area may be-lawfully annexed to the City of Tigard, NOW, THEREFORE, THE CITY OF TIGARD ORDAINS AS FOLLOWS: J( Section l: That all of the following described lands be, and the same are, hereby annexed to the City of Tigard, and the bound- aries of the City of Tigard be, and they are, hereby extended to include the following described lands within the said boundaries: fte I °' ORDINANCE No. 67 y. _ Beginning at an iron pipe in fence corner at the Northeast corner of that certain ten acre tract of land conveyed by deed from Catherine Phelan to Anna M. Barber and recorded in Book 120, page 135, Deed Records of Wash- ington County, Oregon, and running thence South along the Easterly line of said tract 660 feet to an iron pipe on the Southerly line of a 40 foot road as it existed in January 1965 and passing over an iron pipe on the Northerly line of said road; thence WEst along the Southerly line of said 10- acre tract which is also the Southerly line of a 40-foot road as it existed in January 1965; 330 feet? thence North 661.5 feet to an iron pipe in fence line on the Northerly line of hereinbefore mentioned 10-acre tract; thence Easterly 330 feet to the place of beginning; being in the Southwest Quarter of Section 34, Township 1 South, Range 1 West, of the Will- amette Meridian, Washington County, Oregon. Section 2: That the Recorder of the City of Tigard be, and she is hereby directed within 10 days from the date hereof, to make and submit to the Secretary of State of Oregon: a. A certified copy of this ordinance of annexation b. A certified copy of the statement, of consent of the landowners in the territory annexed C. A certified copy of Ordinance No.66-46 whereby the City Council declared that no election is required in the City, and to file herein the acknowledgment of the Secretary of State of said filing. Section 3: That the Recorder of the City of Tigard be, and she is hereby directed, within 10 days from the date hereof, to file with each of the Department of Revenue and Taxation and the " Department of Records and Elections of the County of Washington, the following: a. A certified copy of this ordinance of annexation b. A certified copy of Ordinance No.66- 46 , and that a copy of this Ordinance be directed to the Office of the Washington County Surveyor, and to file herein the acknowledgments of said Departments of said filings. Section 4: The annexation hereby ordained shall be effective on the date of filing with the Secretary of State of Oregon the copies of proceedings as in Section 2 hereof required to be filed, and from and after said date the hereinabove described and annexed territory shall be and remain a part of the City of Tigard.
