Ordinance No. 66-47 i\ CITY OF TIGARD, OREGON ORDINANCE N0. 66- 47 _ AN ORDINANCE ORDERING A SPECIAL ELECTION TO BE HELD ON JANUARY 19, 1967, IN AN AREA LYING SOUTH OF AND CONTIGUOUS TO THE CITY OF TIGARD, INCLUDING PINEBROOK TERRACE AND OTHER LANDS, ON THE QUESTION OF THE ANNEXATION THEREOF TO THE CITY 01, TIGARD, DIRECTING THE GIVING OF NOTICE OF SAID ELECTION, DESIGNATING THE POLLING PLACE, PROVIDING FOR THE APPOINTMENT OF JUDGES AND CLERKS OF ELECTION AND OTHER ACTS NECESSARY AND INCIDENT THERETO, AUTHORIZING THE CITY RECORDER TO INCUR NECESSARY EXPENSES AND DECLARING AN EMERGENCY THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section 1: The Council of the City of Tigard finds from an informal poll of residents of the area hereinafter described that a majority of the residents thereof favor annexation to the City of Tigard; that it is in the best interest of all in- terested persons that the qualified voters residing within said area be afforded an opportunity to vote on the question of annexation of said area to the City and in the event the majority of qualified voters voting at the election in this ordinance called for that pur- pos_ shall favor annexation, after hearing duly held within the City as required by law, annexation of said area to the City may be effect- ed by ordinance; that the area within which the election on said annexation proposal is to be held is described on the attached sheet headed Schedule "A", Description, which by this reference is made a part hereof. Section 2: The City Council of the City of Tigard hereby calls an election to be held within the said described territory on, Thwsdag,January 19, 1967, and hereby designates as the polling place within said territory the Tuality Junior High School Building, at 14650 S.W. 97th Avenue, Tigard, Oregon, and the polls shall be open from 8 o'clock A.M. until 8 o'clock P.M., Pacific Standard Time of said day when same shall be closed, and there shall be submitted to the qualified voters of said territory at said time and place the question of annexation to the City of Tigard of all area as herein described and said question shall be set forth on each ballot to be supplied to the qualified voters and proper provision shall be made for voting thereof. Section 3 The City Recorder of Tigard be, and she is hereby, authorized and directed to give due and legal notice of the said election and proposition by publication in the Tigard Times a newspaper of general circulation in the Tigard area, once each as for four successive weeks with five publications in all and by posting ' notices in due legal form in not less than four public and conspicuous places within the territory proposed to be annexed for a like period of time. Each of said notices shall state the proposition, designate the boundaries of the area proposed for annexation, shall invite the registered voters to vote thereon and state the hours during which polls are to be opened and shall likewise designate the polling place as hereinabove set forth. 66-47 �r s 7M: - Section 4; That Dorothy Mages , Dolores Gillmor , Sharon Green and Naomi Dennis _ are hereby designate to serve as a Boar of elect on an Dorothy Mayes is designated as chairman thereof and eacE mem er of said a ect on board shall take and subscribe an oath that he will honestly and faithfully discharge his duties as election Judge or Clark. In the case of absence or inability of any of said judge or clerks to act as such the remaining members of said board present at the prescribed time shall choose a qualified registered voter to act in the absent member's place. Any such substitute shall qualify in like manner by taking and subscribing an oath before entering upon the discharge of his duties as judge or clerk in the election. Section 5: The election shall be conducted as provided by law and the ballots shall be counted, tabulated and canvassed as provided in ORS 222.130, 222.140 and 222.150. Section 6: The City recorder be, and she is hereby, authorized and directed to incur whatever reasonable expenses necessary and proper to carry out the provisions of this ordinance and the City Recorder shall further prepare and make available to the election board a good and sufficient map delineating clearly the boundary of the area involved in the annexation proposition and to take any and all further action necessary to clarify to the election board the qualifications of voters legally eligible to vote upon the annexation proposal. Section 77: Inasmuch as this ordinance ;s necessary for the im- mediate preservation of the public health, peace and safety of whe City of Tigard in this: In order that said proposition may be advertised and placed upon the ballot without undue delay so that it may be voted upon at the time designated herein, this ordinance must take effect immediately; therefore, an emergency hereby is declared to exist and this ordinance shall be in force and effect from and after its passage by the Council. Graham D.L.C. #39 to the most westerly corner of the tract of land conveyed to Henry 0.
