ORDINANCE No.66 - 44
AN ORDINANCE SETTING HEARING WITH RESPECT TO ANNEXATION
PROPOSAL CONCERNING ANNEXATION OF LANDS IN GREENBURG HEIGHTS
WASHINGTON COUNTY, OREGON,
COMMONLY KNOWN AS THE "'TORLAND, et al " ANNEXATION PROPOSAL.
WHEREAS, a petition for the annexation of the hereinafter
described lands to the City of Tigard has been duly filed with the
City Recorder, and each of the owners who has signed said petition
thereby consented to the annexation of his respective premises
without submitting same to a vote; and
WHEREAS, said premises are not within the corporate limits of
any other city and lie wholly within the County of Washington,
State of Oregon, and the whole of said area is continguous to the
City of Tigard, and it appears that of the total of said area more
than two-thirds of the landowners have consented to annexation, and
that the lands owned by said consenting landowners include at least
two-thirds of the total lands of said contiguous territory, and that
said lands represent at least two-thirds of the assessed value of
all real property in said contiguous territory; and
WHEREAS, it appears that said area may be lawfully annexed
to the City of Tigard without submitting the question to the regis-
tered voters of the City,
NOW, THEREFORE,
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section l: That the City Council of the City of Tigard does hereby
propose to annex to the City of Tigard the following
described area:
As described on the attached sheet
by reference made a part hereof.
Section 2: That the City Council of the City of Tigard does hereby
elect to dispense with submitting the said annexation
proposal to the registered voters of the City of Tigard.
Section 3s That Monday, the 12th day of December, 1966; at the hour
of 6.00 P.M., in the City Hall, Tigard, Oregon, be, and
the Aame are hereby fixed as the date, time and place for public hear-
Ing by the City Corncil of Tigard of said proposal for the annexAtion
to the City of Tigard of the area above described, and all registered
voters of the City may at said time and place appear and be heard on
the question of said annexation.
Section 4: That the City Recorder of the City of Tigard, be, and she
is hereby, directed to give notice of said hearing by
publication once each week for two successive weeks, or three publish-
Ings in all, prior to the date of said hearing, in the Tigard Times:, ,

a newspaper of general circulation in the City of Tigard, Oreon;
and the City Recorder further be, and she is hereby, directed to post
notice of said hearing in four (4) public places within the City of
Tigard for a like period.
Section 5: That Ordinance No. 66-42 passed by the Council on
October 17, 1966 setting a hearing with respect to the
annexation proposal herein mentioned, be, and the same is, hereby
repealed.
Section 6: Inasmuch as it is necessary for the peace, health and
safety of the City of Tigard and those interested in the
petition for annexation of said territory, that this matter be heard
with the least possible delay, an emergency is hereby declared to
exist, and this Ordinance shall become effective upon its passage by
the City Council and approval by the Mayor.
PASSED: By the Council, by unanimous vote of all Council members
present, after being read three times by title only
