Ordinance No. 66-26 CITY OF TIGARD, OREGON ORDINANCE No. 66 - 26 AN ORDINANCE ANNEXING TO THE CITY OF TIGARD LANDS OF A.G.A,PROPERTIES, INC,, BEING PART OF Lot 5, AND ALL OF Lots 6, 23 and 24, FREWING ORCHARD TRACTS, WASHINGTON COUNTY, OREGON WHEREAS, the owners of the hereinafter described lands have petitioned the City of Tigard to annex the same to the City, and have filed consent to said annexation with the City Recorder under date of the 15 day of April , 1966; and t WHEREAS, the lands hereinafter described and proposed to be annexed are contiguous to the corporate limits of the City of Tigard and are not within the corporate limits of any city and lie wholly within the County of Washington, State of Oregon, and are, in all re- spects, qualified to be annexed to the City of Tigard; and WHEREAS, by Ordinance No.66- 22 duly enacted by the City Council of Tigard on the 25 day of April , 1966, the City Council of Tigard did elect to dispense with submitting the annexation proposal to the registered voters of the City of Tigard, and did by said ordinance set Monday the 23 day of May , 1966, :t the hour of 8:00 o'clock p.m. at the City Hall, Tigard, Oregon, as the time and place for public hearing by the Council of said annexation proposal; and WHEREAS, said hearing of May 23 1966 was duly publicized by notice published once each week£r two su'ecessive weeks, or three publishings in all, to-wit: On the 5 day of Ma , 1966, the 12 day of May , 1760, and the 19 day of ;Ra !966, in the Tigard Times, a newspaper of general circu al tion and published in the City of Tigard, Oregon; that anafPi- davit of said publication is on file herein and that notice of said hearing was further given by posting in four public and conspicuous places within the City of Tigard for a like period and that the affi- davit of the City Recorder with respect to said posting is on file herein; and WHEREAS, the hearing on said proposal was duly and regularly held at the City Hall, City of Tigard, on May 23 1966 at the hour of 8:00 O'clock P.M., whereat all interes ed persons and registered voters of the City desiring to be heard, were heard, and said hearing was duly closed; and WHEREAS, it appears that all statutory requirements for the annexation of the following described area to the City of Tigard have received full compliance and that said area may be lawfully annexed to the City of Tigard, NOW, THEREFORE, THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section 1: That all of the following described lands be, and the same are, hereby annexed to the City of Tigard, and the bound- aries of the City of Tigard be, and they are, rereby extended to Include the following described lands within the said boundaries: NO* 1 - ORDTNANCE No. 66 - 26 Beginning at a point on the Southeasterly line of Lot 5, Frewing Orchard Tracts, according to the duly recorded plat thereof, which is 269,2 feet Southwesterly from the most Easterly corner of said Lot 5; thence Southwesterly following the Southeasterly line of .;° Lots 5, 6, 23 and 24, Frewing Orchard Tracts, to the most southerly corner of Lot 24; thence Northwesterly along the Southwesterly line of said Lot 24, to the most Westerly corner thereof; thence Northeast- erly along the Northeasterly line of said Lots 24, 23, 6 and 5 to a point on the said line, which is 271.2 feet from the most Northerly corner of said Lot 5; thence Southeasterly and parallel to the North- easterly line of said Lot 5 to the place of beginning, being part of Lot 5, and all of Lots 6,•23 and 24 of said Frewing Orchard Tracts, SAVE; AND EXCEPT therefrom a strip of land along the South- easterly side 13.5 feet in width and running from the North line of the "deeded road" shown on the plat of Frewing Orchard Tracts to the Northeasterly line of the tract hereby described. Section 2: That the Recorder of the Clt,y of Tigard be, and she is hereby directed, within 10 days from the date hereof, to make and submit to the Secretary of State of Oregon: a. A certified copy of this ordinance of annexation b. A certified copy of the statement of consent of the landowners in the territory annexed C. A certified copy of Ordinance No.66- 22 whereby the City Council declared that no election is required in the City, and to file herein the acknowledgment of the Secretary of State of said fling. Section 3: That the Recorder of the City of Tigard be, and she is hereby directed, within 10 days from the date hereof, to file vi?.th each of :he Department of Revenue and Taxation and the Department of Records and Elections of the County o1' Wasnington, the following: a. A certified copy of this ordinance of annexation b. A certified copy of Ordinance No.66- 22 , and that a copy of this Ordinance be directed to the Office of the Washington County Surveyor, and to file herein the acknowledgments of said Departments of said filings. Section 4: The annexation hereby ordained shall be effective on the date of filing with the Secretary of State of Oregon the copies of proceedings as in Section 2 h4reof required to be filed, and from and after said date the hereinabove described and annexed territory shall be and remain a part of the City of Tigard.
