Ordinance No. 66-10 CITY OF TIGARD, OREGON ORDINANCE No. 66 - 10 AN ORDINANCE ANNEXING TO THE CITY OF TIGARD LANDS OF HOWARD S. GASS and MARGARET A. GASS, being a part of Lot 24, NORTH TIGARDVILLE ADDITION, WASHINGTON COUNTY, OREGON WHEREAS, the owners of the hereinafter described lands have petitioned the City of Tigard to annex the same to the City, and have filed consent to said annexation with the City Recorder under date of the 14th day of February , 1966; and WHEREAS, the lands hereinafter described and proposed to be annexed are contiguous to the corporate limits of the City of Tigard and are not within the corporate limits of any city and lie wholly within the County of Washington, State of Oregon, and are, in all re- spects, dualified to be annexed to the City of Tigard; and WHEREAS, by Ordinance No.66-9 duly enacted by the City Council of Tigard on the 14th day of February , 1966, the City Council of Tigard did elect to dispense with submitting the annexation proposal to the registered voters of the City of Tigard, and did by said ordinance set Monday the 14th day ofMarch ,1966, at the hour of 8:00 o'clock p.m. at the City Hall, Tigard, Oregon, as the time and place forpublichearing by the Council of said annexation proposal; and WHEREAS, said hearing of March 14,_1966 was duly publicized by notice published once each week for twe successive weeks, or three publishings in all, to-wit: On the 2.4'th day of ZQJ 1956, the ' rtd. day of k5etn March and the 1Qth ay of March_, 1966, in the Tigard Times, a newspaper of general circulation and published in the City of Tigard, Oregon; that an affi- davit of said publication is on file herein and that notice of said hearing was further given by posting in four public and conspicuous places within the City of Tigard for a like period and that the affi- davit of the City Recorder with respect to said posting is on file herein; and WHEREAS, the hearing on said proposal was duly and regularly held at the City Fall, City of Tigard, on Ma,,,.h 74 1966 at the ho_�r of 8:00 O'clock P.M., whereat all interested persons and registered voters of the City desiring to be heard, were heard, and said hearing was duly closed; and WHEREAS, it appears that all statutory requirements for the annexation of the following described area to the City of Tigard have received full compliance and that said area may be lawfully annexed to the City of Tigard, NOW, THEREFORE, THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section l: That all of the following described lands be, and,the same are, hereby annexed to the City of Tigard, and the bound aries of the City of Tigard be, and they are, hereby extended to include the following described lands within the said boundaries: Page 1 - ORDINANCE N0.66 - l0 t f Ef k 4 That part of Lot 24 in NORTH TIGARDVILLE ADDITION, Wash- ington County, Oregon described as follows: Beginning at the Northeasterly corner of that tract of land conveyed to Howard S. Gass et ux in Book 579, page 67, Deed Records of Washington County; thence North 57054'West along -' the Northerly line of said tract a distance of 128.7 feet to an angle point; thence continuing along the North line of said tract North 74°56' West a distance of 21.3 feet to a point; thence South 47002'West parallel to the Southeasterly line of said Gass tract a distance of 320 feet to a point; thence South 42°58'East a distance of 149 feet, more or less, to a point on the Southeasterly line of said Gass tract; thence North 47002' East along the Southeasterly line of said Gass tract, a distance of 368 feet, more or less, to the point of beginning. Section 2: That the Recorder of the City of Tigard be, and she is hereby directed, within 10 days from the date hereof, to make and submit to the Secretary of State of Oregon: a. A certified copy of this ordinance of annexation b. A certified copy of the statement of consent of the landowners in the territory annexed C. A certified copy of Ordinance No.66--9 whereby the City Council declared that no election is required in the City, and to file herein the acknowledgment of the Secretary of State of said filing. Section 3: That the Recorder of the City of Tigard be, and she is hereby directed, within 10 days from the datehereof, to file with each of i;he Department of Revenue and Taxation and the Department of Recorda and Elections of the County of Washington, the following: a. A certified copy of this ordinance of annexation b._ A certified copy of Ordinance No.66-9 , and that a copy of this Ordinance be directed to the Office of the Washington County Surveyor, and tofile herein the acknowledgments of said Departments of said filings. Section 4: The annexation hereby ordained shall be effective on the date of filing with the Secretary of State of Oregon the copies of f?roreedings as in Section 2 hereof required to be filed, and freve described and annexed cm and Fafter said date the hereinab territory shall be and remain a part of the City of Tig^rd.
