Ordinance No. 66-06 CITY OF TIGARD, OREGON ORDINANCE NO.66- 6 1, AN ORDINANCE ANNEXING TO THE CITY OF TIGARD, OREGON, LANDS OF Air-King Mfg. Corp. et al, in Section 2 ,T2S, R1W, W.M., Washington County, Oregon, COMMONLY KNOWN-TS—TRE "BURNHAM STREET ANNEXATION". WHEREAS, a petition for the annexation of the hereinafter described lands, in due and legal form, was presented to the City Council of the City of Tigard on the 10th day of January, 1966; and WHEREAS, all the owners of the said lands or any portion thereof by said petition have consented to the annexation of said area to the City of Tigard; and WHEREAS, the area hereinafter described is contiguous to the City of Tigard and is wholly within the County of Washington and none of said area is included within the boundaries of any other incorporated city; and WHEREAS, by Ordinance No.66- duly passed by the City Council of the City of Tigard on the 10th day of January, 1966, the City Council of Tigard did elect to dispense with submitting the question of annexation of said area to the registered voters, and a hearing was called to be held on the 14th day of February, 1966 at 8:00 p.m. at the City Hall on Main Street in the City of Tigard, with respect to said petition for the annexation of the hereinafter described area; and WHEREAS, notice of said hearing was given by publication once each week for two successive weeks, or three publishings in all, prior to said hearing, in the Tigard Times, a newspaper of general circulation in the City of Tigard, and by posting notice of said hearing in four public places within the City of Tigard, as more fully appears from the affidavits of publication and posting in the sF records and files of the City of Tigard; and Page 1 ORDINANCE No. 66 6 WHEREAS, a hearing with respect to said petition for annexa- tion was duly and regularly held, at the regular meeting of the City { Council on February 14, 1966 at 8:00 P.M. in the City Hall on Main Street in the City of Tigard, whereat the owners of said premises, AIR-KING MFG. CORP., TOM L. BARRETT, ALICE E. BARRETT, GEORGE E. SPARLING, HENRY 0. ENNEN and BERNICE L. ENNEN, appeared by agent in favor of said annexation, and no one appeared in opposition to said annexation; and WHEREAS, after due deliberation, the City Council of the City of Tigard, in regular meeting assembled on February 14, 1966, duly passed a motion favoring the annexation of the hereinafter described area; NOW, THEREFORE, THE CITY OF TIGAR.D ORDAINS AS FOLLOWS: Section 1: That the lands of AIR-KING MFG. CORP., TOM L. BARRETT and ALICE E. BARRETT, GEORGE E. SPARLING, HENRY O. ENNEN and BERNICE L. ENNEN be, and the same are, hereby annexed to the City of Tigard, Oregon, and the boundaries of the City of Tigard are hereby extended to include the said lands, as described on the attached sheet headed "DESCRIPTION" which by reference herein is made a part hereof. Section 2: That the Recorder of the City of Tigard be, and she is, hereby directed to make and submit to the Secretary of State; within 10 days from date hereof, the following: (1) A copy of this Ordinance of annexation, duly certified (2) A certified copy of the statement of consent of the landowners in the territory annexed (3) A certified copy of Ordinance No.66- Z whereby the City Council declared that no election is re- quired in the City, and to file herein the acknowledgment of the Secretary of State of said fi,lang. Section ;: That the REcorder of the City of Tigard be, and she is hereby directed, within 10 days From date hereof, to file witl each of the Department of Revenue and Taxatlon and the Departmey'tff Records and Elections of the County of Washington, the following: ,� (1) A certified copy of this Ordinance of annexation (2) A certified copy of Ordinance No'.66- , _ . and that a copy of this Ordinance be directed to the Office ofthe Washington County Surveyor, and to file herein the acknowledgments of said Departments of said filings. Page 2 - �RDINANCE No.66- 6 Section 4: That the annexation hereby ordained shall be effective on the date of filing with the Secretary of State of Oregon the copies of proceedings as in Section 2 hereof required to be filed, and from and after said date the hereinabove described and annexed territory shall be and remain a part of the City of Tigard.
