Ordinance No. 65-32 CITY OF TIGARD, OREGON ORDINANCE No. 65- 32 AN ORDINANCE GRANTING A ZONE. CHANGE WITH RESPECT TO I NDS OF F. C. KEESLING ET AL, IN SECTION 35, TOWNSHIP 1 SOUTH, RANGE 1 WEST, WILLAMETTE ME" LFT X_N VIASHINGTON COUNTY. OREGON. WHEREAS, the hereinafter described lands, by action of the City Ciuncil of the City of Tigard, Oregon, pursuant to the Zoning Code of sa.d city, have heretofore been limited in use to those uses permitted by said Code under, and have been classified and zoned for, R-7 (Single Family Residential) purposes; and WHEREAS, pursuant to prescribed procedures, the owners of said lands have applied to the City of Tigard for reclassification of said pproperty and change of zone therefor to permit the use thereof for A-2 (Apartment Residential) purposes, and said application was duly ublicized and public hearing held after legal notice thereof on the th day of July, 1964, and thereupon said hearing was continued and the matter was further heard by the City Council of Tigard, Oregon, on July 27, 1964; and 3 WHEREAS, having afforded all interested persons an opportunity to be heard with respect to said application, and the City Council finding that no public detriment will result from the granting of said petition, and that it is in the public interest that said change be approved and the property rezoned from R-7 to -2; NOW, THEREFORE, THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section l: That the lands, as described on the attached sheet headed"DESCRIPTION" and by reference made apart hereof, be, and the same are-hereby, reclassified for multiple dwelling use, and are hereby zoned as A-2 (Apartment Residential), for use in accordance with the A-2 multiple dwelling classification of the Zoning Code of the City of Tigard, Oregon, and subject to all conditions, limitations and requirements thereof, which Zoning Code with respect to the A-2 classification is by reference herein made a part hereof. Secti. t on 2: That this ordinance shall be effective on the 31st day after its enac"ment by the City Council of Tigard, Oregon. Ac Reco der - City of Tigard APPROVED: By the Mayor, this 8th day of November, 1765. _Mayor - City of Ti rd r ORD7JIAI+TCE No. 65- 32 f' DESCRIPTION A tract of land in Sectica 35, Township 1 South, Range 1 West of the Willamette Meridian, County of Washington, State of Oregon, described asfollows: Beginning at a point in the center of the Greenburg-Tigard Road, which point bears South 89°34' West along Donation Land Claim line 968.9 feet, and South 0002' East 1237.5 feet from the Northeast corner of the John Hicklin Donation Land Claim in Sec. 35,TiS, RlW, W.M., and running thence South 0°02' East along the Easterly line of that certain tract of land conveyed to Lou and Grace Rogers by deed recorded in Book 144, page 577 of Washington County,Oregon Deed Records, a distance of 376.35 feet to a point which bears North 0°02' West 282.85 feet from the Northeast corner of the 1.0 acre trait of land conveyed to Myrtle L. Severson by deed recorded in Book 161 on page 91 of said Deed Records; thence North 89°56' West 218.0 feet to the Southeast corner of the James O'Rourke 3.0 acre tract of land as described in Page 191 in Book 123 of said Deed Records; thence West along the South line of said O'Rourke property 218.46 feet to a point on the West line of the Rogers property described in Book 144, page 577; thence South along the West line of said Rogers property 282.85 feet to the Northwest corner of that certain tract con- veyed to Myrtle L. Severson by deed recorded in Book 161, page 91; thence East along the North line of said Severson tract to a point on the East line of said Rogers tract above mentioned; thence North along the East line of said Rogers tract 282.85 feet to the place of beginning. ALSO: Beginning at a point which is located by beginning at the Northeast corner of the John L.Hicklin D.L.C. 54, TIS, R114, W.M.,Washington County,Oregon and running thence West 14.68 chains to a point; thence South parallel with the West line of said claim 30.25 chains to the South line of the North half of said claim, said point being the true point of beginning; thence West along the South line of said North half 6.62 chains; thence North parallel with the West line of said claim 100 feet; thence East parallel with the South line of said North half of said claim 6.62 chains; thence South 100 feet to the place of beginning; EXCEPTING the West 176.05 feet as described in deed to C.E.
