Ordinance No. 65-27 CITY OF TIGARD, OREGON OhUINtf CE !JO. 65- 27 AN ORDINANCE SETTING HEARING WITH P.ESPECT TO ANNEXATION PROPOSAL CONCERNING ANNEXATION OF LANDS IN SECTIONS 10, 11, 15, 21 and 22 TOWNSHIP 2 SOUTH, RANGE 1 WEiT, W.II., C01MONLY KNOWN AS "THE TUALATIN-RIVER SOUTHWEST ANNEXATION PROPOSAL" WHEREAS, a petition for the annexation of the hereinafter described lands to the City of Tigard has been duly filed with the City Recorder, and each of the owners who has signed said petition thereby consented to the annexation of their respective premises without submitting same to a vote; and WHEREAS, said premises are not within the corporate limits of any other city and lie wholly within the County of Washington, State of Oregon, and the whole of said area is contiguous to the City of Tigard, and it appears that of the total of said area more than two-thirds of the landowners have consented to annexation, and that the lands owned by said consenting landowners include at least two-thirds of the total lands of said contiguous territory and that said lands represent at least two-thirds of the assessed value of all real property in said contiguous territory; and WHEREAS, it appears that said area may be lawfully annexed to the City of Tigard without submitting the question to the regis- tered voters egistered-voters of the City, NOW, THEREFORE, THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section 1: That the City Council of the City of Tigard does hereby propose to annex to the City of Tigard all area lying within the boundaries a- set forth on the attached sheet headed "DESCRIPTION" which by reference herein is made part hereof,said annexation proposal to provide that beginning with the First fiscal year after annexation takes effect, the rate of taxation for city purposes 6n said Droperty in said area proposed to be annexed shall be according to the following ratios: (a)_ Fiscal year 1966-67 - 25`/, ratio of the highest rate of taxation aFplicable for such year for city purposes to other property within the City. (b) Fiscal year 1967-68 - 50% ratio of the highest rate of taxation applicable for such year for 'i city purposes to other property within the City. (c) Fiscal year 1968-69 - 751 ratio of the highest rate of taxation applicable for such year for �w city purposes to other property within the City. (d) Beginning with the fiscal year 1969-70 and thereyfter said area shall be subject to the same rate of taxa tion applicable nisch year for city purposes to other property in the City. 41 { Page 1 - ORDINANCE NO. 65 - 27 Section 2: That the City Council of the City of Tigard does hereby elect to dispense with submitting the said anne_sation proposal to the registered voters of the City of Tigard. Section 3: That Monday, the 25th day of October, 1965, at the hour of 8:00 o'clock p.m., in the City Hall, City of Tigard, Oregon, be, and the same are hereby fixed as the date, time and place for public hearing by the City Council of Tigard of said pro- posal for the annexation to the City of Ticard of the area described on the attached sheet headed "DESCRTPTION"Vand by reference made a part hereof, and all registered voters of the City may at said time and. place appear land be heard on the question of said annexation. Section 4: That the City Recorder of the City of Tigard be, and she is hereby, directed to give notice of said hearing by publication once each week for two successive weeks, or three pub- lishings in all, prior to the date of said hearing, in the Tigard Times, a newspaper of general circulation in the City of Tigard, Oregon; and the City Recorder further be, and she is hereby directed to post notice of said hearing in four (4) public places within the City of Tigard for a like period. Section 5: Inasmuch as it is necessary for the peace, health and safety of the City of Tigard and those interested in the petition for annexation of said territory, that this matter be heard with the least possible delay, an emergency is hereby de- clared to exist, and this Ordinance shall become effective upon its passage by the City Council and approval by the Mayor.
