Ordinance No. 65-16 CITY OF TIGARD, OREGON ORDINANCE NO. b5 - le, AN ORDINANCE GRANTING A ZONE CHANGE WITH RESPECT TO THE LANDS OF VANCE R. LEE and RALPH PETERS, being PORTIONS OF Lots 37 and 38, NORTH TIGARDVILLE ADDITION WASHINGTON COUNTY OREGON. WHEREAS, the hereinafter described lands, by action of the City Council of the City of Tigard, Oregon, pursuant to the Zoning Code of said city, have hretofore been limited in use to those uses permitted by said Code under, and have been classified and zoned for, A-2 (Multiple Dwelling) purposes; and WHEREAS, pursuant to prescribed procedures, the owners of said lands have applied to the City of Tigard for reclassification of said property and change of zonee thereof to permit the use thereof for 0-2 (General Commercial) purposes, and said application has been duly, publidized and public hearing held by the City Planning Commission on May 20, 19b5 , after due and legal notice; and WHEREAS, the City Planning Commission has recommended approval of said zone change to the City Council, and due and legal notice of City Council hearing having been given by publication in the Tigard Times, and the City Council finding that no public detriment will result from the granting of saidpetition, and that it is in the public interest that said zone change be approved, and the property rezoned from A-2 (Multiple Dwelling) to C-2 (General Commercial); NOW, THEREFORE, THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section 1: That the following described lands be, and the same are hereby, reclassified for general commercial use, and are hereby zoned C-2 (General Commercial) for use in accordance with the C-2 commercial classification of the Zoning Code of the City of Tigard, and subject to all conditions, limitations and requirements thereof, which Zoning Code with respect to the C-2 classification is by reference herein made a part hereof: PARCEL I: Beginning at a point on the East line of Lot 37, North gardville Addition, Washington County, Oregon, 16.5 feet from the Northeast corner thereof,running thence North- westerly on a line parallel with and 16.5 feet distant from the North line of said lot, 125 feet; thence Northeasterly on a line parallel with the Easterly line of said Lots 37 and 38, on the Southeasterly line of that tract conveyed to Ray E. Christensen et ux by deed recorded in Bk.273, p.439, Deed Records, 65 feet; thence Southeasterly parallel with the North line of said Lot 37 and the Southwesterly line of that property conveyed to Ray E. Christensen et ux by deed re- corded in Bk,262, page 837, and to Roger L. Hawley et us by deed recorded in Bk.349, p.586, Deed Records, 125 feet to the East line of Lot 38 of said Addition-;thence South- easterly along said East line of said Lots 38 and 37, 65 feet to beginning point, and being a par*_- of Lots 57 and 38. North Tigardville Addition as shown by the duly recorded map and plat thereof; less that portion thereof conveyed to the State of Oregon by deed recorded in Bk.184 at page 337, Washington County Deed Records. Page 1 - Ordinance No. 65 - 16„r.�_ PARCEL II: Beginning at an iron pipe on the Northerly property line of the relocated state highway in Lot 38, North Tigardville Addition, Washington County, Oregon, said iron pipe being North 45019' East 48.5 feet and thence North 44041' West 6.76 feet from the northeast corner of Lot 37 and going thence North 44041' West 118.24 feet to an iron pipe at the Northwest corner of the Chrietensen lot; thence South 53048' East 45.0 feet to an iron pipe; thence South 44041' East 73.92 feet to an iron pipe on the Northerly property line of the State Highway; thence South 45045'30" West 7.0 feet along said Highway property line to the true point of beginning. PARCEL III: That part of Lots 37 and 38, North Tigardville Addition, according to the duly recorded plat thereof, Washington County, Oregon, described as follows, to-wit: BeRianing at a point on the Easterly line of said Lot 37 which is Southwesterly 16.5 feet from the wast Easterly corner thereof and running thence Northwesterly, parallel with the Northerly line of said Lot 37, 125.0 feet to the most Westerly Southeast corner of that tract con- veyed to Roger L. Hawley and Dorothy F. Hawley, husband and wife, by deed recorded in.Bk.246, p.141, Deed Records of Washington County, Oregon, said SoutherlyaDruer being the true point of beginning of the tract hereby conveyed; thence Northeasterly, parallel withthe Easterly line of said lots to the Northerly line of Lot 38; thence North westerly to the most Northerly corner of Lot 38; thence Southwesterly, along the Westerly line of said lots to a point 16.5 feet Southerly.from the most Westerly corner of Lot 38 and thence Southeasterly parallel with and 16.5 feet Southwesterly of the Southerly line of Lot 38 to said true point of beginning. Section 2: This ordinance shall be effective on the 31st day after its enactment by the City Council of Tigard, Oregon PASSED By unanimous Mote of all Councilmembers present, after being read three times by title only, this 14th day of June, 1965.
