Ordinance No. 65-05 CITY OF TIGARD, OREGON ORDINANCE No. 65- f AN ORDINANCE ANNEXING TO THE CITY OF TIGARD LANDS OF A. J. POULIN ET AL IN SECTIONS 2, 10 and 11, TOWNSHIP 2 SOUTH, RANGE 1 WEST W.M., WASHINGTON COUNTY, OREGON, COMMONLY REFERRED TO AS THE "S. W. PACIFIC HIGHWAY ANNEXATION" WHEREAS, petitions by owners for the annexation of certain lands within the boundaries of an area located within Sections 2, 10 and 11 T2S, R1W, W.M.' Washington County, Oregon lying in the near proximity of S. W. Pacific Highway were duly Wed with the City Recorder�_ id sa ,area�*being legally described on the attached sheet headed DESCRIFILON and by reference made a part hereof; and WHEM-,S, none of the tracts and ownerships lying within said area so described are within the corporate limits of any other city but lie wholly wihin the County of Washington, State of Oregon and the whole of said area is contiguous to the City of Tigard, and the owners of various tracts within said area consented to said annexa- tion; and WHEREAS, Helen Steinke, Director of Revenue and Taxation of Washington County, Oregon, has duly certified that the total area lying within the boundaries described on the attached sheet headed "DESCRIPTION", by reference made apart hereof, comprises 72.58 acres of which 56.70 acres are in ownerships of persons who have consented to the annexation of said area to the City of Tigard; and that the consenting ownerships represent78.12% of the total area described or the attached sheet headed "DESCRIPTION";that said Director of Rev- enue and Taxation has further certified that the total assessed value of assessable real property within the boundaries of the area pro- posed to be annexed, according to the current year°s assessment rolls of Washington County, Oregon, is $167,200.00, and that the assessed value of the ownerships consenting to the annexation is the sum of $116,800.00, and thus the consenting ownerships represent 69.86% of the total assessed valuation; and said Director of Revenue and Taxa- tion further certified that of a total of fifty (50) tract ownerships with the area so described, 35 owners are included among those con- senting, and that 70% of the total owners of the lands within said area have consented to the annexation proposal; and WHEREAS, in addition to the foregoing, consent to annexation sof all cribed8onathe attachedeific sheetHheaded "ihway DESCRI Lhin the ION", wasodulyrde- scribed with the City Recorder on March 15, 1965, prior to the hearing of said proposal; and due and regular consent to annexation has been additionally received from John Reamish with respect to Tax Lot 1100 2S1 -2CC having an assessed valuation of $2,480.00 and comprising 1.09 acres; and WHEREAS, by Ordinance No. 65-3 duly enacted by the City Council on the 8th day of February, 1965, the City Council of the city of Tigard did elect to dispense with submitting the annexation proposal;to the registered voters of the City of Tigard and did thereby set Monday, the 15th day of March, 1965 at the hour of 8:00 0Iclock P.M. at the City Hall, Tigard, Oregon, as the time and place page 1 ORDINANCE No. 65- S_ __ for public hearing by the Council of said annexation proposal, at which time and place all registered voters of the City could appear and be Beard on the queetion of annexation; and WHEREAS, by said Ordinance No. 65-3 the Council of the City of Tigard did proclaim its intention to annex to the City of Tigard all area lying within the boundaries set forth on the attached sheet headed 'DESCRIPTION, said proposal to provide that beginning with the first fiscal year after annexation takes place the rate of taxa- tion for City purposes on the property in said area proposed to be annexed shall be according to the following ratios: (a) Fiscal year 1965-66 - 25% ratio of the highest rate of taxation applicable for such year for city purposes to other property within the City. (b) Fiscal year 1966-67 - 50% ratio-of the highest ■ ra*e of taxation applicable for such year for city purposes to other property within the City. (c) Fiscal year 1967-68 - 75% ratio of the highest rate of taxation applicable for such year for city purposes to other property within the City. (d) Beginning with the fiscal year 1968-69 and thereafter said area shall be subject to the same rate of taxation applicable each year for city purposes to other property in the City. WHEREAS, pursuant to said Ordinance No.65-3, the said hearing to be held on Monday March 15, 1965 at 8:00 p.m., was drily publi- cized by notice published once each week for two successive weeks or three'publishin s in all, to-wit: on February 25, 1965, March 4,1965 and March 11, 1965, in the Tigard Times, a newspaper of general cir- culation and published in the City of Tigard,` Oregon; that an affi- davit of such publications was duly filed herein, and that notice of said hearing was further given by posting in four public places wthin the City of Tigard for a like period, the affidavit of post- in' of said notice being on file herein; and WHEREAS, the hearing on said annexation proposal as so publi- cized was duly and regularlyheld at the City Hall, City of Tigard, on March 15, 1965 beginning at S:OO p.m., whereat those registered voters and other interested persons desiring to be heard were heard both in support of and against said proposal, and said hearing was duly closed; and WHEREAS, it appears that all`statutory requirements for the annexation of the area described on the attached sheet headed "DESCRIPTION" and by reference made a part hereof have been fully_ met and that said area may lawfully be annexed to the City of Tigard by action of the City Council thereof, NOW, THEREFORE, THE CITY OF TIGARD ORDAINS AS FOLLOWS: Page 2 - ORDINANCE No. b5- Section 1: That all lands lying within the boundaries set forth on the attached sheet headed "DESCRIPTION" by reference made a part hereof, be, and the same are hereby, annexed to the City of Tigard, and the boundaries of the City of Tigard be and the same are hereby, extended to include all of said lands Included within the said boundaries. Section 2: That the rate of taxation for City purposes on allrop- erty thearea hereby annexed to the City of Tigard shall be according to thefollowing (a) Fiscal year 1965-66 - 25% ratio of the highest rate of taxation applicable for such year for city purposes to other property within the City. %+-7 piece! year 1966-67 - 507 ratio of the highest ��+� I?aA'' for �. rate of taxation applicable fur such ,__ city purposes to other property within the City. Section 3: That the Recorder of the City of Tigard be, and she is hereby directed, within 10 days from the date hereof, to make and submit to the Secretary of State of Oregon: -a. A certifiad copy of this ordinance of annexation b. A certified copy of the statement of consent of the lando*�mers in the territory annexed c. A certixied copy of ordinance No. 65-3 whereby- -- City Council declared that no election is required in the City and to file herein the acknowledgment of the Secretary of State of said filing. _- Section 4: That the Recorder of the City of Tigard be, and she is hereby directed, within 10 days from the slate hereof, to file with each of the Department of Revenue and Taxation and the Department of Records and.Ellections of the County of %ashington, the following: a. A certified copy of this ordinance of annexation b. A certified copy of Ordinance No. 65-3 and to file herein the acknowledgments.of said Departments of said filings.
