Ordinance No. 64-04 CITY OF TIGARD, OREGON ORDINANCE NO. 64- AN ORDINANCE ANNEXING TO THE CITY OF TIGARD, OREGON, LANDS COMPRISING A PORTION OF "FREWING ORCHARD TRACTS". WHEREAS, a petition for the annexation of the hereinafter ..__ described lands, in due and legal form, vas presented to the Ci�y gaiu o, the 13 day of january. 1964; Council of the City of Tl WHEREAS, all the owners of the said lands or any portion thereof by said petition have consented to the annexation of said area to the City of Tigard; and WHEREAS, the area hereinafter described is contiguous to the City of Tigard and is wholly within the Coanty of Washington and none of said area is included within the boundaries of any 'other incorporated city; and WHEREAS, by Ordinance No. 64-1 duly passed by the City gard on the 13th day of January, 1964, Council of the City of Ti the City Council of the City of Tigard did elect to dispense with submitting the question of annexation of said area to the regis- tered voters, and a hearing was called to be held on February 10, 1964 at 8:00 p.m. at the City Hall on Main Street in the City of Tigaed, with respect to said petition for the annexation of the hereinafter described area; and InEREAS, notice of said hearing was given by publication uccessive weeks, or three publishings in once each week for two s all, prior to said hearing in the Tigard Times, a newspaper of general circulation in the City of Tigard, and by posting notic.s of lic places within the City o: Tigard, as said hearing in four pub more fully,appears from the affidavits of publication and posting in the records and files of the City of Tigard; and r page 1 - ORDINANCE No. 64- WHEREAS, a hearing with respect to said petition for annex- ation was duly and regularly held, at the regular meeting of the City Couacil on February 10, 1964 at 8:00 p.m., in theCity Hall on Main Street in the City of Tigard, whereat the owners of said prem- ises, JAMES ,41LLOCK, BETTY M. BA1'i�.ETT, appeared by agennt_ in favor of said annexation, and no one appeared in opposition to said annexation; and •i Of t. f:ity WHEREAS, after due deliberation, file City Coun �- of Tigard, in regular meeting assembled on the 10th day of Feb- tuary, 1964, duly passed a motion favoring the annexation of the kierei;atter described area; NOW, THEREFORE., THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section 1: That the following described lands of JAMS WILLOCK at ux, JOHN C. ANICKER at ux, and LAURENCE A. BART?ETT at ux, be, and the same are, hereby, annexed co the City of Tigard, Oregon, and the boundaries of the City of Tigard are hereby extended to include the following described lands Beginning at the most northerly corner of Tract 4, FPEJING S ORCHARD TRACTS, a duly recorded subdivision, and running thence S.54°27' W. along the northwesterly lines of Tracts 4 and 3 of said subdivision, and said northwesterly lines extended, 772.17 feet; thence S.35° 33' E. 266.46 feet to an iron at the most northerly corner of the tract of land conveyed to M. R. Hine at tax by deed recorded on page 53 in Deed Book 480 Washington County, Oregon, Teed Records; thence S.30°04� E. 210.0 feet to a point on the southeasterly line of the tract conveyed to Everett S. Hall at ux by deed recorded on page 330 in Book 284 of said Deed Records, which point bears 5.54027' vq. 54.0 feet from the most easterly corner thereof; thence S.54°271W. 21.0 feet to the most northerly corner of the lands conveyed to rielvin c. Andrea at ux by deed recorded on page 191 in Book 400 of said Deed Records; thence S.30°04'E. 259.5 feet to the most easterly co9ner of the tract conveyed to ji.11iam H. Parker at ux by deed recorded on page 311 in Book 312 of said Deed Records; thence northeasterly along the southeasterly lines of Tracts 22, 3 and 4 of said FREAING'S ORCHARD TRACTS to the most easterly corner of Tract 4; thence N.43 47'W. 474.5 feet,'more,or less, to the place of beginning. page 2 - ORDINANCE No. 64- Section 2: That the Recorder of the City of Tigard be, and he is hereby, directed to make and submit to the Secretary of State: (1) A copy of this Ordinance of annexation (2) A copy of the statement of consent of the land- owners of the territory annexed, to-wit: the said petition for annexation containing said consent. (3) A copy of Ordinance No. 64-1 whereby the City Council of the City of Tigard dispensed with sub- mitting the question of annexation to the voters of the City of Tigard. Section 3: That this ordinance shall be affective on the date of filing with the Secretary of State of the abstract in Section 2 hereof required to be filed, and from and aft,.: said date the hereiiiab.,�__.w described and annexed territory shall be and remain a part of the City of Tigard.
