Ordinance No. 63-13 CITY OF TIGARD, OREGON ORDINANCE No. 63- f-a_ AN ORDINANCE PROVIDING FOR THE ISSUANCE AND SALE OF SEWER BONDS OF THE CITY OF TIGARD IN THE AMOUNT OF $150,000.00 AND DECLARING AN Et�:iGENCY. WHEREAS, an amendment to the Charter of the City of Tigard, designated as Section 41 of Chapter IX, authorizing the construction, reconstruction, repair, operation and maintenance of sewer disposal th •within aria outside the corporate facilities and a sewer system, - L� limits of said City, and authorizing a bond issue to finance the t�.w .,,„nae of submitting same, and calling a special election Lo p--,--- the proposed charter amendment to the voters, was passed by the City Council of Tigard on the 10th day of June, 1963, designated "Ordinance 63-7", and said proposed charter amdndment was duly and regularly submitted to the voters at an election held in said City on the first day of July, 1963, and of the total of 221 votes cast, 169 ballots were in favor, and 52 ballots were against said charter amendment, and thus a clear majority of the voters favored the said charter amendment and the issuance of bonds in the sum of $150,000. for the purposes above stated; and WHEREAS, pursuant to said authorization of the legal voters and to meet the deadline established by the federal government with respect to participation by way of federal grant in the cost of said sewer system and disposal facilities, it is necessary that immediate action be taken to offer said bonds for sale to provide funds wherewith to defray the cost thereof; NOW, THEREFORE, THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section 1• That general obligation sewer bonds of the City of Tigard Oregon shall be issued in sU00a00feach,nto be total sum of $150,060.00 'in denominations of $1, designated "Sewer Bonds - Series 1963", and running consecutively Page 1 - ORDIONCE No. 63- IF 3 L_ AN E from 1 to 150, said bonds to be dated December 1, 1963 and to mature as follows: NMaturity Date Number Amount 1 to 8, inc. $ 8,000. Section 2: All bonds payable after December 1 1971 shall be subject to redemppt on ILn numm ca or er on any interest due date on and after December 1 1971 Section 3: All bonds shall be sold at par plus accrued interest from date thereof to date of delivery, and all bonds shall be signed by the Mayor and countersigned by the Recorder of the City of Tigard, Oregon, and the coupons attached thereto shall bear the facsimile signatures of the said officers of the City. Section 4: The full faith and credit of the City of Tigard, Oregon shall be and is hereby pledged to each successive holder of each of said bonds for the prompt and punctual payment - of the principal and ini:.rest thereof as and when same shall become due, and in addition thereto, the City of Tigard, Oregon herebyy covenants and agrees with each successive holder of each of said bonds and coupons, that the City of 'Tigard does pledge to the pay ment thereof the net revenue derived from the operation and use of the City's sewer systems and the -sale of sewer service therefrom subject only to pre-existing outstanding sewer bonds and the require- c` ments for payment thereof. Section 9: All of the net operating revenues derived from the sewer system of the City of Tigard shall be utilized to pay interest chargee and serial m.;turities of principal of said bond issue, subject only to the requirements of principal and interest of pre-existing'outstanding bonds of said City with respect to which said revenues have heretofore been pledged. Net operating revanues are hereby defined as the gross operating revenues from the city sewer system, less operating and maintenance expenses thereof. Section 10: It is hereby declared and adjudged that existing con- ditions are such that the immediate enactment of this orAinance is necessary for the preservation of the peace, health and safety of the Cit q of Tigard, Oregon to avoid serious disruption of sewer service ;thin said City and it is hereby declared that an emergency exists and that this ordinance shall become effective immed- iately upon its passage by the Council and its approval by the Mayor.
