Ordinance No. 63-11 GITY 'OF TIGARD, OREGON ORDINANCE N0. 63 - II AN ORDINANCE GRANTING A ZONE CHANGE WITH RESPECT TO LANDS Q� =ERTSOipS INC., WrcH USPEGI TO LOTS 22, 23, 25, 26, .37, 38 AND THE NORTHEASTERLY 60 FEET OF LOT 27, HOFFARBER TRACTS AREAS the hereinafter g described lands, by action of the Code of said cCouncil ityhehaveyof heretofore,beenglimitedsinnuse)tohthoseing assifd and uses permitted bysaid,Code nWPundnZ3 and have been c and R-5 (SinglelFamily Residen- ® zoned for, d- .. � --- tial)purposes; and WHEREAS, pursuant to prescribed procedures. the owner of ""— sa3d lands has applied to the City of Tigard for reclassification of said property and change of zone thereof to permit the use thereof for C-2 (General Commercial) purposes, and said application was duly publicized and public hearing held by the Planning and Zoning Commission of the City of Tigard, after legal notice there- of, or. the 29th day of August, 1963; and WHEREAS, having afforded all interested persons an oppor tunny to be heard with respect to said application and the City Planning and Zoning Commission finding that no public detriment will result from the granting of said petition, and that it is in the public interest that said change be approved and the property re- zoned from A-2 and R-5 to C-2; and WHEREAS, no remonstrances having been filed or appeals taken with respect to the recommendation of the City Planning and Zoning Commission for the granting of said application, and the City Council of the City of Tigard having duly considered the same at its regular meeting of September 9, 1963, and due and legal notice hav- ing been given as prescribed by the City Council with respect to-a hearing of the matter by the City Council of Tigard, Oregon and said hearing having been held on the 9th day of September, , and there being no appearances or remonouncilefindin sththe at tgrant- ing-of said application, and the City g he zone change petitioned for is not adverse to the public interest, health, or comfort and convenience of the public, and is consistent with the preservation of the public peace, safety, morals, order and priblic welfare, and that said change should be approved; NOW, THEREFORE, THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section 1: That the following described lands be, and the same are hereby, reclassified for •geaeralccoameftial-_use, and are hereby zoned as C-2 (General Commercial), for use in accordance with the C-2 classification of the Zoning Code of the Page 1 - ORDINANCE NO. 63 - �. City of Tigard, Oregon, and subject to all conditions, limitations and requirements therea£, which Zoning Code with respect to the C-2 classification is by reference herein made a part hereof: Lots 22 23 25, 26, 37 38 and the northeasterly sixty (i0) eet of Lot 17, HOFFARBER TRACTS, in Washington County, Oregon, Section 2: This ordinance shall be effective on the 31st day after its enactment by the City Council of Tigard.
