ORDINANCE NO. 53-1
AN ORDINANCE ANNEXING TO THE CITY OF TIGARD, OREGON, PORTIONS OF
LtST�_ 21 and 22 AND OTHER LANDS WITHIN NORTH TIGARDVILLE ADDITION

WHEREAS, a petition for the annexation of the hereinafter
F described lands, in due and legal form, was presented to the City
{
i Council of the City of Tigard on the 12th day of November, 1962;
WW-PRAc� all the owners of the said lands or any portion
thereof by said petition have consented to the annexation of said
j area to theCity of Tigard; and
WHEREAS, the area hereinafter described is contiguous to
the City of Tigard and is wholly within the County of Washington
and none of said area is included within the boundaries of any
other incorporated city; and
y WHEREAS, by Ordinance No. 62-24 duly passed by the City
Council of the City of Tigard on the 26th day of November, 1962, '
the City Council of the City of Tigard did elect to dispense with
submitting the question of annexation of said area to the regis
tered voters, and a hearing was called to be held,on December 17,
1962 at 8:00 p.m. at the Community Hall on Commercial Street in
the City of Tigard, with respect to said petition for the annexa-
tion of the hereinafter described area; and
WHEREAS, notice of said hearing was given by publication
once each week for two successive weeks, or three publishings in
all, prior to said hearing in the Tigard Times, a newspaper of gen-
eral circulation in the City of Tigard, and by posting notice of
said hearing in four public places within the City of 'Tigard, as
more fully appears from the affidavits;of publication and posting

in the records and files of the City of Tigard; and
I.1RE,REAS, a hearing with respect to said petition for annex-
ation was duly and regularly held on December 17, 1962 at 8:00 p.m.
in the Community Hall on Commercial Street in the City of Tigard,
whereat the owners of said premises, JOSEPH BALOGH and MARTHA 0.
BALOGH, appeared by agent in favor of said annexation, and no one
appeared in opposition to said annexation; and
WHEREAS, after due deliberation the City Council of the City

1962, duly passed a motion favoring the annexation of the herein-
after described area;
NOrv, THEREFORE,
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1. That the following described lands of JOSEPH BALOGH
and MARTHA 0. BALOGH be, and the same are, hereby
annexed to the City of Tigard, Oregon, and the boundaries of the
City of Tigard are horc"cy extended to include the following de-
scribed lands;
The blest Half, consisting of one (1) acre, of the follow-
ing described real property: Beginning at the Northeast
corner of Lot 21 of North Tigardville Addition, as des-
ignated upon the amended plat of said addition recorded
and on file in the office of the Recorder of Conveyances
of said county and state, and running thence North 64° 49'
West along the north boundary of said Lot 21, 1.08 chains
to an iron pipe; thence South 16° 00' T4est 7,70 chains to
an iron pipe; thence South760 30' East 2.732 chains to a
point in the center of Fanno Creek from which an iron
pipe on the north bank of Fanno Creek bears North 15° 25'
East 32 links distant; thence North 150 25' East 7.146
chains to an iron pipe in the north boundary of Lot 60 of
said addition; thence North 64° 49' West of said north
boundary of said Lot 60, 1.612 chains to the northeast
corner of Lot 21 and place of beginning;
ALSO, all of said Lot 21 of North Tigardville Addition
as designated upon the amendedplat of said addition
recorded and on file in the office of the Recorder of
s ' Conveyances of said county and state, lying South and
West of the above described real property;
ALSO, all of Lot 22 of North Tigardville Addition as
designated upon the amended plat of said addition

recorded and on file in the office of the Recorder of
Conveyances of said county and SLElt8; C]C(:CUt that tract
conveyed to L.Paul Winn and wife by deed recorded in
Book 247, page 53.
Section 2. That the Recorder of the City of Tigard be, and he is
hereby, directed to make and submit to the Secretary
of State:
a A copy of this Ordinance of annexation
b A copy of the statement of consent of the
landowner of the territory annexed,to-wit:
the -aid petition for annexation containing
said consent
c) A copy of Ordinance No. 62-24 whereby the
City Council of the City of Tigard dispensed
with submitting the question of annexation
to the voters of the City of Tigard
Section 3. That this ordinance shall be effective on the date of
filing with the Secretary of State of the abstract
in Section 2 hereof required to he filed, and from and after said
date the hereinabove described and annexed territory shall be and
remain a part of the City of Tigard.

being read first in full and then by title, this
day of January, 1963.
