Ordinance No. 62-19 ti CITY OF TIGA12D, OREGON ORDINANCE NO. 62 - AN ORDINANCE ADOPTING THE OREGON STATE PLUMBING LAWS AS THE PLUMBING CODE OF THE CITY OF TIGARD, PRESCRIBING QUALIFICATIONS FOR JOURNEYMAN PLUMBER AND FOR THE CONDUCT OF A PLUMBING BUSINESS IN ACCORDANCE WITH OREGON STATE LAW REQUIRING APPLICATION FOP, AND ISSUANCE OF PERMITS FOR PERFOiWNCE OF ANY PLUMBING WORK WITHIN THE CITY OF TIGARD, REQUIRING PLUMBER'S BOND, PROVIDING FOR INSPECTION OF ALL PLUMBING WORK, PRESCRIBING PERMIT AND INSPECTION FEES AND PROVIDING PENALTIES FOR VIOLATION HEREOF, IT IS ORDAINED BY THE COUNCIL OF THE CITY OF TIGARD: Section 1• That the laws of the State of Oregon as set forth in • Chapter 447 Oregon Revised Statutes, and the regula- tions prescribed thereunder with respect to installation and main- tenance of plumbing facilities within the City of Tigard, Oregon, are hereby adopted as the plumbing code of the City, of Tigard and shall have the same force and effect as though herein recited in full, one copy of which shall be maintained at all times at the office of the City Clerk, and one copy at the Office of the City Superintendent. Section 2: That the laws of the State of Oregon as set forth in Chapter 693 Oregon Revised Statutes and the regula- tions of the State Board of Health as promulgated thereunder with respect to the definition and qualification of "journeyman plumber" and "registration to conduct a plumbing business', and all other requirements of competency and qualification as in said Chapter 693 set forth, are hereby adopted as the definitions and required qual- ifications of anyone conducting plumbing work within the City of Tigard as a journeyman plumber or conducting a plumbing business within the City of Tigard. Section 3: it shall be unlawful for any person, firm or corporation, whether acting as principal, servant, agent or employee, to uo or cause to be done, or permit to be done, any plumbing work, or installation of any plumbing materials, whether interior ®r eater- ior, in connection with waste, sewer, or other facilities, through or incident to the use of which any liquid or other substance what- soever shall be discharged into the City's sewers or into any priv- ate securingpools a permittic fromathe officeor eofdtheoCityosal fSuperintendent. first Section 4: Applications for permit shall be on forms prescribed by the City and shall include a description of the work to be done, the location, ownership, occupancy, and actual or prospective use of the premises'upon„anied w*th work lans, to be specifca- foamed, the applications per- be_ _- 'mr- plans, tions,, drawings,;and such other information as the City Superintend- ent may deem necessary and pertinent to a clear understanding of the work to be performed.; PageORDINANCE No. 62 _ r Section S: No plumbing work for which a permit :s required shall be commenced in any building o*remises within the } City until an offi.ial permit covering the work as issued by the , City is posted in a conspicuous place on said building or premises. No person shall remove or deface such permit until the work auth- orized by such permit has been approved in writing by the City Superintendent or his authorized representative. Section 6: No permit shall be issued to any person to construct, install, alter, repair or change any new or existing plumbing in the City of Tigard unless such person shall hold a valid journeyman plumber's certificate of competency issued by the State Board of Health and shall otherwise be qualified as a journey- man plumber as defined in Chapter 693 Oregon Revised Statutes; pro- vided that nothing herein contained shall preclude an owner from A-4-- M. nw., r 1,m'hing work in his own building or on his own prem- ises provided that he shall first obtain a permit as by this orcin- ance required and shall comply with all provisions of the ordinances applicable thereto, the rules and regulation€ of the Oregon State Board of Health and the State Plumbing Code. No permit shad be issued to any person. firm or organization to conduct a plumbing business in the City of Tigard unless such person, firm or organization shall have made applica- tion to the State Board of Health and paid a registration fee to engage in the business, furnish labor and material, or labor only, to install, alter or repair plumbing, and any work performed pur- suant to said permit shall be performed by journeyman plumber as defined in Chapter 693 O.R.S. Section 7: The City Superintendent is hereby designated as plumb- inC inspector and it shall be his duty to inspect all plumbing in the City of Tigard and to require that all plumbing installations conform with the provisions of this Ordinance. The City Superintendent or his designated representative acting as plumbing inspector, is hereby empowered to enter any buildings, premises or structures at any reasonable time for the purpose of Inspecting the plumbing thereon installed. If the City Supe`intendent finds that said plumbing does not conform with the requirements of this Ordinance and the State Plumbing Code, he shall give notice in writing thereof to the owner of the premises, or to the contractor as the case may be, setting forth specifically in what respects said work, or material, does not conform with this Ordinance, and the owner or contractor as the case may be, shall immediately and within a reasonable time bring the plumbing work and materials into conformity with the State Plumbing Lode, provided that nothing in this Ordinance shall be construed as authorizing or permitting the City Superintendent ing installations pre-existing this Ordinance to require any plumb `' to be removed or changed to conform to the State Code except to the �e extent that such action is necessary to protect public health and to conform to the use limitations prescribed for the sewer system of the City of Tigard. (b) A further additional sum computed at the rate of $1.00 for each sewer opening in excess of one, including openings for additional basins, urinals, sinks and other facilities and devises which discharge into the sewer system. Section 11 The City Superintendent shall inspect all work or author- ized by any permit, for the pure ning whether such work conforms to the requirements of this Ordinance. He shall issue a written approval for any work found in conformity therewith, and shall reject all work or materials which are not in conformity herewith. Whenever the Superintendent shall find any plumbing work being conducted or accomplished within any premises or build- ing-,, which shall be deemed defective, leaking or unsanitary, or in violation of ordinances of the City of Tigard, it shall be Us duty to notify the owner of the premises, the contractor, and the person actually performing the work, of such findings, and shall request that the defective work be removed or re-installed in accordance with the requirements of this Ordinance and the Plumbing Cade of the State of Oregon. Such notice shall specify a reasonable time within which such conditions shall be corrected or in which such work 'shall be removed or re-installed, as the case may be.
