TIGARD CITY COUNCIL
ORDINANCE NO. 10- 1--�
AN ORDINANCE WITHDRAWING TERRITORY FROM THE TUALATIN VALLEY WATER
DISTRICT SUBSEQUENT TO ANNEXATION TO THE CITY OF TIGARD
WHEREAS, frorn 1967 to 1976,the City annexed in to the City of Tigard the tracts of land described in
Exhibits A,B-1 and B-2,attached hereto and Hereby incorporated by reference and depicted on the attached
traps;and
WHEREAS the[facts of land described in Exhibits A,B-1 and B--2 were not withdrawn from the Tualatin
Valley Water District at the time of annexation (October 11, 1967 through January 2, 2976)or at any
subsequent time;and
WHEREAS,the City desires to withdraw from the Tualatin Valley Water District the tracts of land
described in Exhibits A,B-1 and B-2; and
WHEREAS the City currently provides all services to the tracts of land described in Exhibits A,B-1 and B-
2;and
WHEREAS the City and Dist dct both recognize the need to provide legal clarification of the existing
senwice area boundaries, annexations,and any prior agreements known and unknown between the two
parties through the action of formal withdrawal;and
WHEREAS, ORS 222.520 provides that such withdrawals may be processed at any time after annexation to
the City;and
%'VHFREAS,on the 11th and 26th days of August, 2010,and 2nd day of September,2010,the City
published and posted Notices of Hearing as required by ORS 222524(2);and
WHEREAS, on the 14th day of September, 2010, the City held a heating as required by ORS 222.524(1) for
the purpose of hearing objections to the withdrawal and determining whether such withdrawal is in the best
interest of the City.
NOW,THEREFORE,THE CITY OF TIGARD ORDAINS AS FOLLOWS:
SECTION 1: The tracts of land described in Exhibits.A, B-1 and B-2 depicted on the attached neaps are
declared to be withdrawn from the Tualatin Valley Water District.
SECTION 2: The City Recorder shall immediately file a certified copy of this Ordinance-with Metro and
other agencies required by Metro Code.
SECITON 3: This ordinance shall be effective on the 1st day of- duly ,2011,as provided by ORS
222.465.
