APPLICATION SUMMARY FILE NAME: TIGARD RETAIL CENTER DETAILED DEVELOPMENT PLAN APPROVAL EXTENSION CASE NO.: MISCELLANEOUS (MIS) 2010 -00003 MIS2010 -00003 PROPOSAL: Pacific Realty Associates, L.P. (PacTrust) applied for concurrent review of the concept and detailed development plans for Tigard Retail Center (PDR2008- 00001). The Planning Commission made separate decisions on each plan and approved the concept development plan on February 2, 2009. By final Order No. 2009 -02 PC, dated May 29, 2009, the Planning Commission approved the detailed development plan. The effective date of the detailed development plan is June 17, 2009 and the expiration date is December 17, 2010. The applicant has requested a one -year, one -time extension pursuant to Tigard Development Code Chapter 18.350.C, and a Type II process pursuant to Chapter 18.390.040. APPLICANT/ Pacific Realty Associates, L.P. OWNER: Attn: Mathew Oyen 15350 SW Sequoia Pkwy, Suite 300 Portland, OR 97224 LOCATION: The property is located south of SW Dartmouth Street west of SW 72nd Avenue; Washington County Tax Map 1S136CD, Tax Lot 04200; 2S101BA, Tax Lot 00101; and 2S101AB, Tax Lot 01400. ZONE: C -G (PD): General Commercial District. The C -G zoning district is designed to accommodate a full range of retail, office and civic uses with a City-wide and even regional trade area. Except where non - conforming, residential uses are limited to single - family residences which are located on the same site as a permitted use. A wide range of uses, including but not limited to adult entertainment, automotive equipment repair and storage, mini- warehouses, utilities, heliports, medical centers, major event entertainment, and gasoline stations, are permitted conditionally. (PD): The property has a planned development overlay designation. The urposes of the planned development overlay zone are: 1) To provide a means for property development that is consistent with Tigard's Comprehensive Plan through the application of flexible standards which consider and mitigate for the potential impacts to the City; 2) To provide such added benefits as increased natural areas or open space in the City, alternative building designs, walkable communities, preservation of significant natural resources, aesthetic appeal, and other types of assets that contribute to the larger community in lieu of strict adherence to many of the rules of the Tigard Community Development Code; 3) To achieve unique neighborhoods (by varying the housing styles through architectural accents, use of open space, innovative transportation facilities) which will retain their character and City benefits, while respecting the characteristics of existing neighborhoods through appropriate buffering and lot size transitioning; 4) To preserve to the greatest extent possible the existing landscape features and amenities (trees, water resources, ravines, etc.) through the use of a planning procedure (site design and analysis, presentation NOTICE OF "TYPE I I DECISION M1S2010- 00003 /DETAILED DEVELOPMENT NT PLAN EXTENSION REQUEST PAGE 1 OF 5 of alternatives, conceptual review, then detailed review) that can relate the type and design of a development to a particular site; 5) To consider an amount of development on a site, within the limits of density requirements, which will balance the interests of the owner, developer, neighbors, and the City; and 6) To provide a means to better relate the built environment to the natural environment through sustainable and innovative building and public facility construction methods and materials. MUE: Mixed -Use Employment. The MUE zoning district is designed to apply to a majority of the land within the Tigard Triangle, a regional mixed -use employment district bounded by Pacific Highway (Hwy. 99), Highway 217 and I -5. This zoning district permits a wide range of uses including major retail goods and services, business /professional offices, civic uses and housing; the latter includes multi- family housing at a maximum density of 25 units /acre, equivalent to the R -25 zoning district. A wide range of uses, including but not limited to community recreation facilities, religious institutions, medical centers, schools, utilities and transit- related park- and -ride lots, are permitted conditionally. Although it is recognized that the automobile will accommodate the vast majority of trips to and within the Triangle, it is still important to 1) support alternative modes of transportation to the greatest extent possible; and 2) encourage a mix of uses to facilitate infra- district pedestrian and transit trips even for those who drive. The zone may be applied elsewhere in the City through the legislative process. APPLICABLE REVIEW CRITERIA: Community Development Code Chapters 18.350 and 18.390. SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above Extension Request. The findings and conclusions on which the decision is based are noted in Section IV. SECTION III. COMMENTS FROM PROPERTY OWNERS WITHIN 500 FEET No letters or comments were received from nearby property owners. SECTION IV. APPLICABLE DEVELOPMENT CODE STANDARDS 18.350.030 Administrative Provisions A. Time limit on filing of detailed development plan. The concept plan approval expires after 1 -1/2 years unless an application for detailed development plan and, if applicable, a preliminary plat approval or request for extension is filed. Action on the detailed development plan shall be taken by the Planning Commission by means of a Type III -PC procedure, as governed by Section 18.390.050, using approval criteria in Section 18.350.070. Pacific Realty Associates, L.P. (PacTrust) applied for concurrent review of the concept and detailed development plans for Tigard Retail Center (PDR2008- 00001). The Planning Commission made separate decisions on each plan and approved the concept development plan on February 2, 2009. By final Order No. 2009 -02 PC, dated May 29, 2009, the Planning Commission approved the detailed development plan. The effective date of the detailed development plan is June 17, 2009 and the expiration date is December 17, 2010. NO'fICE OF II DECISION MIS2010- 00003 /DETAILED DEVELOPMENT PLAN EXTENSION REQUEST PAGE 2 OF 5 The applicant has requested a one -year, one -time extension of the Detailed Development plan. However, the code does not address the approval period for detailed plans, or the extension of detailed plans. Staff attributes this omission to amendments made to the Planned Development Chapter under DCA 2006 -00003 (Ordinance No 06 -16). Prior to the amendment, detailed plans were reviewed under the Site Development Review Chapter (18.360) or Subdivision Chapter (18.430), which included 1 -1/2 year approval periods with a one -time, one -year extension. The amendment gave the Commission authority to review the detailed plan as a Type III PC process, but did not provide for an approval period or extensions as existed for concept plans. Therefore, the following criteria for a concept plan will be used for the detailed plan extension request, consistent with past practice. Tigard Development Code Section 18.350.030.0 includes the following criteria for extensions: The Director shall, upon written request by the applicant and payment of the required fee, grant an extension of the approval period not to exceed one year; provided that: 1. No changes have been made on the original concept development plan as approved by the Commission; The applicant states that "no changes have been made to the original concept development plan as approved by the Commission on February 2, 2009." Therefore, the request is consistent with this criterion. 2. The applicant can show intent of applying for detailed development plan or preliminary plat review within the one -year extension period; and The applicant applied for concurrent review of the concept and detailed development plans. The Commission made separate decisions on each plan. On May 18, 2009 the Commission approved the Detailed Plan. The effective approval date for PDR2008 -00001 was on June 17, 2009 (Final Order No. 2009- 02 PC) and is valid for an eighteen month period through December 17, 2010. The requested extension would be for one year, or until December 17, 2011. 3. There have been no changes to the applicable Comprehensive Plan policies and ordinance provisions on which the approval was based. The applicable review criteria for Concept Plan review for PDR2008 -00003 are contained in the following Community Development Code Chapters: 18.350 (Planned Developments) 18.520 (Commercial Zoning Districts) 18.620 (Tigard Triangle Design Standards) 18.705* (Access, Egress and Circulation) 18.725 (Environmental Performance Standards) 18.745* (Landscaping and Screening) 18.755 (Mixed Solid Waste & Recyclable Storage) 18.765* (Off -street Parking and Loading Requirements) 18.775 (Sensitive Lands Review) 18.780* (Signs) 18.790 (Tree Removal) 18.795* (Vision Clearance) 18.810 (Street and Utility Improvements) 18.390 (Decision Making Procedures, Impact Study) NOTICF.. I I DECISION MIS2010- 00003 /DETAILED DEVEI.OPMENT PLAN EXTENSION REQUEST PAGE 3 OF 5 To determine consistency with this criterion, the standards addressed in the findings for the approval must be compared to any changes in the applicable standards adopted by the City since the August 29, 2008 application date for PDR2008- 00001. As the Tigard Development Code (TDC) implements the City's Comprehensive Plan, no Comprehensive Plan goals are directly applicable to the decision. Staff reviewed the period since the original application date of August 29, 2008 and found that City Council approved two ordinances applicable to the Tigard Retail Center Final Order: 1) Ordinance No. 09 -13, approved on September 8, 2009, which clarified that the requirements for shared open space facilities (TDC18.350.070.m) are applicable to residential planned developments only, formerly applicable to commercial developments, as well; and 2) Ordinance No. 09 -11 approved on August 11, 2009, which replaced an elevation criterion for bicycle /pedestrian pathways located within floodplains with a requirement for a wildlife habitat assessment. Both of these code amendments pertain to aspects of the subject Planning Commission review for the Detailed Development Plan. However, there were no substantive amendments to the applicable code sections during that period that would have affected the approved plan as discussed below: 18.350 (Planned Developments) For future applications, the shared open space standard would not apply to commercial development, as it had under the current approval. The approved plan provides more open space than would have to be provided for future applications. Therefore, even though there has been a change to the applicable ordinance provision on which the approval was based, the open space provision would not be applicable to future commercial developments. Therefore, the extension may be granted. 18.775 (Sensitive Lands Review) The applicant's narrative states and plan set shows that the development is wholly outside of the adjacent Red Rock Creek Floodplain. Therefore, even though there has been a change to the applicable ordinance provision on which the approval was based, the amended language for pathways within floodplains would not be applicable to future applications. Therefore, the extension may be granted. Based on this review, staff concurs with the applicant and finds that no substantive, applicable changes have occurred to the Tigard Development Code on which the approval was based. Conclusion The Applicant has submitted a written extension request and paid the application fee. The criteria for an extension has been met as indicated in the findings, above. Therefore, the Applicant is granted an extension for PDR2008 -00001 not to exceed one year, or until December 17, 2011. SECTION V. Appeal: The decision of the Director (Type II Procedure) or Review Authority (Type II Administrative Appeal or Type III Procedure) is final for purposes of appeal on the date that it is mailed. Any party with standing as provided in Section 18.390.040.G.1. may appeal this decision in accordance with Section 18.390.040.G.2. of the Tigard Community Development Code which provides that a written appeal together with the required fee shall be filed with the Director within ten (10) business days of the date the notice of the decision was mailed. The Planning Commission made separate decisions on each plan and approved the concept development plan on February 2, 2009. By final Order No. 2009 -02 PC, dated May 29, 2009, the Planning Commission approved the detailed development plan. NOTICE OF TYPI DECISION MIS2010- 00003 /DETAILED DEVI LOPMENT PLAN EXTENSION REQUEST PAGE 2 OF 5 The applicant has requested a one -year, one -time extension of the Detailed Development plan. However, the code does not address the approval period for detailed plans, or the extension of detailed plans. Staff attributes this omission to amendments made to the Planned Development Chapter under DCA 2006 -00003 (Ordinance No 06 -16). Prior to the amendment, detailed plans were reviewed under the Site Development Review Chapter (18.360) or Subdivision Chapter (18.430), which included 1-1/2 year approval periods with a one -time, one -year extension. The amendment gave the Commission authority to review the detailed plan as a Type III PC process, but did not provide for an approval period or extensions as existed for concept plans. Therefore, the following criteria for a concept plan will be used for the detailed plan extension request, consistent with past practice. Tigard Development Code Section 18.350.030.0 includes the following criteria for extensions: The Director shall, upon written request by the applicant and payment of the required fee, grant an extension of the approval period not to exceed one year; provided that: 1. As the Tigard Development Code (TDC) implements the City's Comprehensive Plan, no Comprehensive Plan goals are directly applicable to the decision. Staff reviewed the period since the original application date of August 29, 2008 and found that City Council approved two ordinances applicable to the Tigard Retail Center Final Order: 1) Ordinance No. 09 -13, approved on September 8, 2009, which clarified that the requirements for shared open space facilities (TDC18.350.070.m) are applicable to residential planned developments only, formerly applicable to commercial developments, as well; and 2) Ordinance No. 09 -11 approved on August 11, 2009, which replaced an elevation criterion for bicycle /pedestrian pathways located within floodplains with a requirement for a wildlife habitat assessment. Both of these code amendments pertain to aspects of the subject Planning Commission review for the Detailed Development Plan. However, there were no substantive amendments to the applicable code sections during that period that would have affected the approved plan as discussed below: 18.350 (Planned Developments) For future applications, the shared open space standard would not apply to commercial development, as it had under the current approval. The approved plan provides more open space than would have to be provided for future applications. Therefore, even though there has been a change to the applicable ordinance provision on which the approval was based, the open space provision would not be applicable to future commercial developments. Therefore, the extension may be granted. 18.775 (Sensitive Lands Review) The applicant's narrative states and plan set shows that the development is wholly outside of the adjacent Red Rock Creek Floodplain. Therefore, even though there has been a change to the applicable ordinance provision on which the approval was based, the amended language for pathways within floodplains would not be applicable to future applications. Therefore, the extension may be granted. Based on this review, staff concurs with the applicant and finds that no substantive, applicable changes have occurred to the Tigard Development Code on which the approval was based. Conclusion The Applicant has submitted a written extension request and paid the application fee. The criteria for an extension has been met as indicated in the findings, above. Although the extension request is answered by the City by letter without notice, the issue is discoverable. Given the attention of interested parties, we thought this opportunity would be helpful. Gary Tigard Development Code Section 18.350.030.0 includes the following criteria for extensions: The Director shall, upon written request by the applicant and payment of the required fee, grant an extension of the approval period not to exceed one year; provided that: 1.
