Tigard-Tualatin School District - Arbor Day Planting 2011 0 ' X000 l 00L Memorandum of Understanding Between the Tigard-Tualatin School District and the City of Tigard Introduction In celebration of Arbor Day 2011,the City and the Tigard-Tualatin School District (ITSD)will be planting over 300 trees at the Metzger Elementary,Templeton Elementary,and Twality Middle School campuses.This expanded planting effort has been made possible through close collaboration with Kraig Sproles (Principal of Metzger Elementary School),Todd Robson (Principal of Templeton Elementary School),Rick Patrick (Principal of Twality Middle School),TTSD staff,City of Tigard staff,and local contractors. The planting palette includes native and ornamental trees chosen for their low water and maintenance requirements. The trees will be provided with automatic drip irrigation until the roots become established. This tree planting partnership will provide beauty,wildlife habitat, stormwater management,and shelter from the sun and wind for students and neighbors of the schools. Pugpose The City of Tigard (City) and the Tigard-Tualatin School District (District) recognize that there are areas of mutual interest,which,when pursued cooperatively support each entity's ability to plant and maintain trees on District property in the City of Tigard. This Memorandum of Understanding defines the roles of the City and District with respect to furthering their cooperative efforts to enhance the City of Tigard with additional trees. The City recognized the value of planting and establishing trees on District property to increase the size and quality of the City's tree canopy, the District recognizes the need to provide maintainenance to the trees after planting so that the health, safety,and longevity of the trees is maximized.Thus, on this 23rd day of March, 2011 these parties enter into this Memorandum of Understanding, the intent of which is to further City and District cooperation. Toward this goal the District will: • Periodically monitor the health of the newly planted trees on Attachments 1, 4, and 7, during the first three years after planting. • Contact the City if any of the newly planted trees on Attachments 1,4, and 7,begin to die during the first three years after planting. • Periodically monitor the functioning of the newly installed irrigation systems on Attachments 2, 5, and 8, during the first three years after planting. • Contact the City if the newly installed irrigation system on Attachments 2, 5, and 8, should become damaged or destroyed,or otherwise fail to function properly. • Provide and purchase irrigation water when needed,inlcuding during the summer months, for the newly planted trees on Attachments 1,4, and 7, during the first three years after planting. Irrigation will be controlled by the District through a handheld unit provided by the City. The City will provide training on the use of the irrigation system if requested by the District. •Allow the City to secure the valve boxes housing the newly installed battery operated irrigation controllers on Attachments 2, 5, and 8, for three years after installation. •Allow the City to retrieve the battery operated irrigation controllers of the newly installed irrigation system on Attachments 2, 5, and 8, three years after installation. •Replace any trees that die within the first three years after planting if the cause of death is determined by the City to be from lack of maintenance or intentional removal. Lack of maintenance will be considered to be: o Failure to notify the City if any of the newly planted trees on Attachments 1,4, and 7, begin to die during the first three years after planting. o Failure to notify the City if the newly installed irrigation system on Attachments 2, 5,and 8, should become damaged or destroyed,or otherwise fail to function properly. o Failure to provide irrigation water when needed for the newly planted trees on Attachments 1,4,and 7,during the first three years after planting. •Maintain trees after planting so that the health, safety,and longevity of the trees is maximized. Maintenance of the trees shall conform to tree care industry standards,occur for the life of the trees, and include but not be limited to: o Pruning as needed; o Water management; o Protection during future construction activities within their critical root zones o Pest Control as needed; o Fertilization as needed;and o Removal should the tree(s) become a hazard to people or structures, and pruning is unable to abate the hazard. • Replace any trees with the same species and size on Attachments 1,4, and 7, that die due to lack of maintenance, negligence,or intentional removal. • Exclude and protect students,parents,personnel, and campus visitors from construction areas until planting and irrigation installation is complete. • Hold harmless,indemnify and defend the City,its officers,agents,and employees from all claims for damages or injuries which may occur as a result of the trees and irrigation system,and/or the planting of the trees and irrigation installation on the attached plans. The City of Tigard will: •Periodically monitor the health of the newly planted trees on Attachments 1, 4, and 7, during the first three years after planting. • Contact the Utility Notification Center at 1(800) 332-2344 at least 48 hours in advance of any utility locate request. The City will verify,locate, and identify,with visible marking,all existing underground utilities in the areas of work and maintain such markings until all work in those areas is complete. If utilities are to remain in place, the Contractor shall provide adequate means of protection during excavation operations. • Select healthy nursery stock, that is well branched, full foliaged when in leaf, free from disease,injury, insects, all weeds, and weed roots. Plant materials must meet requirements of American Standard for Nursery Stock, 1980 Edition,ANSI Z60.1. No cold storage plants will be selected. • Provide exact quantities of named species and varieties of plant material shown on Attachments 1,4, and 7. • Supply and install required topsoil. Topsoil will be representative of the area, fertile, friable, free from rocks,roots, noxious weeds, sticks and other foreign materials harmful to plant growth. • Guy and stake trees as follows: o Wood Tree Stakes: 2x2 S4S,Douglas Fir, 8' lengths, free of knot holes or grain defects, treated with two liberal coats of Olympic stain number 713 finish preservative (two per deciduous tree, three per conifer). o Tree Ties: "Gro-Strait" tree ties as supplied by Alfred Teufel Nursery, Inc.,Portland, Oregon. New 2-ply, '/z",improved garden hose or approved equal. o Guy Wire and Stakes: 12-gauge steel wire,galvanized,use double strand. o Tree Wrap: Provide and install as shown on tree planting detail;refer to drawings. o Additional Requirements: Meet other detail requirements as shown on Attachments 1 and 3. •Provide mulch material per plan that is free from noxious weed seed and all foreign material harmful to plant life. Mulch material will be fir or hemlock bark,medium grind, -1/5 + 3/4" sizes. •Plant trees per Attachments 1, 3,4, 6, 7,and 9 as follows: o Plant trees and shrubs upright and face to give best appearance or relationship to adjacent plants and structures. o Planting operation to begin as soon as weather conditions permit by accepted local practice. o Planting holes shall be excavated twice the size of the tree root ball or root system. Trees to be planted on undisturbed subgrade where possible. o Balled and Burlapped Materials: Loosen and remove carefully twine binding and burlap from top of root balls. Stake or guy trees immediately after planting each tree. o Roots: Cut off cleanly all broken or frayed roots. o Pruning: Prune trees and shrubs to remove damaged branches,improve natural shape and thin not more than 15% of branches. o Backfilling:Place and compact lightly backfill soil mixture carefully to avoid injury to roots, fill all voids. o Watering:When hole is filled, completely soak and allow water to soak away. Fill holes to finish grade and prepare for other work indicated. • Contact the the corresponding school office prior to beginning work,and inform them where and what type of work will be occuring each workday. • Install irrigation for all trees in Attachments 1,4,and 7 per the details and specifications in Attachments 2, 3, 5, 6, 8,and 9. • Keep premises reasonably free from accumulation of debris, equipment and surplus materials. Leave project site in neat and orderly condition. • Hold harmless,indemnify and defend the District,its officers,agents, and employees from all claims for damages or injuries which may occur as a result of the trees and irrigation system, and/or the planting of the trees and irrigation installation on the attached plans. • Contact Bonita Maplethorpe, or her successor in responsibility for this MOU at the District,if deviations are required to this MOU and/or the attached plans and specification. NO deviations shall occur without prior written consent from Ms. Maplethorpe, or her successor for this MOU. It is mutually understood and agreed that: •Additional details, drawings, and specifications that are applicable to this project can be found in the attachments. •The City and District will hold a preconstruction meeting so that construction activities can be coordinated with school activities. This will allow for a minimum of distrubance for either activity. Insurance: •The City of Tigard and District agree to each maintain insurance or self insurance consistent with provisions of the Oregon Tort Claims Act, ORS 30.270 and customary for public agencies of the same size and type.
