DIR1990-00004 DATE: 7/16/1990 CODE SECTIONS: 18.42.020 18.98.010 - 18.144.020 ( 1,), 0 ) : I,TOPIC;1 Rooftop Antennas: Commercial Zones INTERPRETATION: Regarding the process necessary to place several panel type antennas on the roof of a commercial building in the City of Tigard; Such a facility is regarded in the Community Development Code as an appendage to the principle structure and it does not require any City land use permits. A building permit is necessary prior to placement of the antennas on the roof. This determination is based upon the provisions of the following Code sections: 1. Section 18.98.010 exempts rooftop "aerials" from the building height requirements of the applicable zone. 2. Section 18.144.020 considers such a rooftop antenna as part of the principle structure and not an accessory structure. 3. Section 18.42.020.B.7 includes telephone transmitters and other related facilities that have a "significant visual impact" as utilities, which are conditional uses in all zoning districts. I find that the proposed antennas are not utility facilities because they have minimal visual impact.
