We would like to ask you for clarification in two areas: 1 1. Did the $2,000,000 permit application for structural and repair work include all of the requirements per section 3401 through 3405 (Existing Structure) of the Oregon Structural Specialty Code? When was the $2,000,000 permit obtained by Horizon? 2. Sprinkle system. The main "theme" of our conversation was on what items the city considered to be required "code upgrades ". There were two main code related items that were required based on the damage sustained by the structure. These two main items were the requirements out of the Oregon Structural Specialty Code (OSSC) Chapter 34 for substantially structurally damaged buildings and the requirements out of Chapter 9 for substantially damaged Group R2 buildings (the occupancy category that Ash Creek Condominiums falls within). Chapter 34 (Existing Structures) of the OSSC addresses repairs to existing structures. Section 3401.4 and its subsections allows leeway for the continued use of existing materials (section 3401.4.1), and, except for structural repairs or alterations, for the use of like materials for repairs (section 3401.4.2). However, section 3401.4.2 does require that, in general, materials permitted by the current OSSC for new construction shall be used. All materials would be required to be installed per their listing and manufactures installation instructions. As we discussed, section 3405.2 of the OSSC addresses Substantial structural repair of vertical elements of the lateral force resisting system. Once demolition work began, it was determined that the existing walls were not sheathed with plywood and depended on gypsum wall board for lateral force resistance. Furthermore, it was obvious that there was substantial fire and water damage to this element. Based on my site visit the day after the fire and all information provided, It was determined that the building had sustained substantial structural damage. I then requested an evaluation report by a registered design professional as required per section 3504.2.1. The evaluation determined that if the building were repaired to its pre- damaged state, it would not comply with the provisions of the code for wind and earthquake loads. Section 3405.2.3 then requires that the building be rehabilitated to comply with applicable provisions of the OSSC for load combinations, including wind and seismic loads. New structural members and connections were required by the rehabilitation design to comply with provisions of the OSSC for new buildings of similar structure, purpose, and location. No adjustment to the original valuation of the project was provided at the time of this evaluation and no additional permit fees were collected. The valuation provided at the time of permit application for all structural and repair work was $2,000,000. OSSC section 903.2.8 provides the requirements for existing Group R2 structures when substantial damage occurs. Substantial damage is deemed to have occurred when the cost of restoring the structure to its original condition would be equal to or exceed 25% of the assessed value of the structure before the damage occurred. When substantial damage occurs, each unit that is substantially damaged must be provided with an automatic sprinkler system meeting the requirements of NFPA 13R. When more than 50% of the units in a building are substantially damaged, the entire building must be provided with such an automatic sprinkler system. It was determined that this building did sustain substantial damage to more than 50% of the units and thus was required to be provided with an automatic sprinkler system throughout. 2 There were two permits obtained in relation to the required fire sprinkler system. One permit for the system throughout the interior of the structure and one permit for the site work to install the vault and fire supply line from the property line to the building. The valuation provided by the contractor for the interior sprinkler system was $31,600. The valuation provided for the vault and fire supply line was $35,550. The city of Tigard does not distinguish specifically which items and portions of valuations are related to "code upgrades ". We review plans for, and inspect buildings to meet the minimum requirements of the code. All plans submitted for the repairs were reviewed to ensure they meet these minimum requirements. The city would not deny approval of plans or inspections that exceeded the minimum requirements. The valuation submitted are supposed to include the total value of the work, including materials and labor, for which the permit is being issued.
