Hall Blvd Tigard, OR 97223 Dear Mr. LaFavre: No formal reply to the 28 February written request for extension of the health/safety issues at 9640 SW Frewing has been received. I have had several telephone contacts on specific code and compliance questions which have been answered in a timely fashion. Since no mention of the extension was made in any of them, I have assumed that the extension has been granted. On February 11, 2002, a plumbing permit for 15 fixtures (the total number present) at a cost of $334.64 was deemed appropriate. In the category of "Other Fixtures" is listed "3 ". In the Remarks: space is the comment "Other fix. is 2 hose bibbs." One more washing Machine connection (total of 3) was added on 4/2/2002 to comply with a desired addition capability. In January 2002, the initial inspection indicated that plumbing fixture venting may be lacking was the main issue. Upon opening walls to begin to correct the issue, originally installed venting was revealed as required by code in the 1950s, 1974s, and 1990s. Properly sized and installed 2" vents and traps for the toilets and shower /tubs were "discovered." Properly installed horizontal 1 1/2 " vent connections to the 2" vent stack from lavatories and kitchen sinks were also discovered. The actual short- comings revealed were narrowed to: the venting had failed to be properly extended through the roof and previous owner modifications in 1990s had installed 1 1/2 ABS vents and drains for washing machine connections. These have been up- graded to 2" vents and drains, connected to existing piping, and extended through the roof. The "back bath" in Apt 4 was replumbed to remove questioned factors, reduce 3" vent to 2" and interconnect, extend through the roof, the vents for shower, toilet, lavatory, and washing machine connection. The consolidation of the building sewer connection was also re -done to simplify its configuration and remove a questionable 3" joint. Supporting the long 3" line and grading to remove sags were added. The buried sewer connection was opened to show the connection of 3" to 4" sizing from the street and re- compute fixtures to assure that 3" sizing is adequate. The water heaters were moved to a place where proper earth -quake banding and relief value extension can be installed. While making this change and walls were opened, hot and cold water piping was also inspected, simplified, piping up- graded when replaced, and the washing machine connection in the bathroom of Apt 4 added. Questioned venting in the house building was resolved by extending the vents into the attic area and connecting to existing 4" stack configuration. Piping supports were reviewed and installed where needed. The washing machine connection in the carport was de- commissioned and machines removed to apartment connections. The indicated rough inspection and approval to cover opened walls are hereby requested. J c 4 Trustee. At the request of your plumbing contractor and with your approval and in your company, I and the City's plumbing inspector, Bill LeFave, visited the above property on Tuesday, January 8 2002, and conducted a "health and safety ",inspection of the plumbing facilities. I made clear in our conversations before and during the inspection that our performing this inspection, identifying code violations, and requiring various repairs would not and does not in any way constitute an approval or endorsement by the City of Tigard of the use of any one or any combination of the existing apartments as individual dwelling units nor does this approve or authorize the current configuration of the property with four units in the main building and two in the second. Specifically, the question of how many dwelling units the property may contain must be determined by the City of Tigard Planning Department through the conversations and negotiations you are currently engaged in with them. Our focus in this inspection has been[sglelyiupon plumbing- issues; particularly upon identifying any plumbing issues that could compromise or trepresent a danget to'the of any occupants of the premises. Our inspection was not exhaustive and it was not intrusive to the structure: it was limited to what we could see of the readily accessible elements of the plumbing system and was further limited in that three of the six apartments were not accessible at the time of our visit. Accordingly, this notifies you that this property is found to be in violation of TMC 14.16.250. one °n Section 14.16.440 of the TMC provides that if a Notice of Violation such as the above is issued and an affected dwelling unit is or becomes vacant, "it shall be unlawful to reoccupy or permit re- occupancy of the unit(s) ... until the necessary permits are obtained, corrections made, and permit inspection approvals given." Allowing such an unlawful occupancy is itself a Class I Civil Infraction subject to penalties of up to $250.00 per violation, per day. In other words, any of the units that are now vacant or that become vacant before these repairs are completed must remain vacant until these violations are all corrected and the property is found to be in compliance with Section 14.16.250: I sent you a copy of Chapter 14 of the Tigard Municipal Code, "Residential Property Maintenance Regulations" on August 15, 2000, and I am enclosing another copy for your review. Please note that compliance with Chapter 14 does not determine or validate the number of dwelling units that may be occupied under the City's zoning regulations. The property may comply with Chapter 14 and still be in violation of zoning restrictions on the number of dwelling units. I urge you to continue your discussions with the City's Planning Department so that the zoning issues can also be resolved.
