The approved Permit Documents prepared by Nicoli Engineering, Inc. provide two (2) accessible parking spaces at the building's main entrance (see Sheet 1.2 of the Permit Documents). One space (van accessible) is existing and is to be re- striped and reused. An additional new space and aisle was proposed (to the West) adjacent to the existing accessible space. Upon closer examination, the existing slope at the proposed accessible space and aisle is not in compliance with the code required slopes. Due to the site's terrain and the fact that the site has contaminated soils, re- grading the site does not appear to be an option. We have investigated other options, but are unable to find a workable solution, given the limited area and the existing site constraints. The site has twenty six (26) spaces, which are existing and are being modified slightly for the new development. Per the table in Section 1104.1, two (2) accessible spaces are required. OSSC, Section 1101.4, modifications are allowed and may be granted by the building official in accordance with Section 104.9. We are requesting that the additional proposed accessible parking space and aisle be allowed with the non - conforming slope, or eliminated. We are requesting this modification for the following reasons: 1. The twenty six (26) parking spaces and the accessible space and aisle are existing and were approved as part of the previous site improvements (per previous owner). 2. Existing site terrain poses unique site characteristics, which make full compliance technically unfeasible. Appliances shall be accessible for inspection, service, repair or replacement without removal of permanent construction. 306.1 OMSC 8. Smoke detectors shall be installed in return air systems with a design capacity greater than 2000 cfm. Upon activation, the smoke detector shall shut down the air distribution system. Smoke detectors shall be connected to a fire alarm system and shall activate an audible and visible alarm at a constantly attended location. OR In occupancies not required to be equipped with a fire alarm system, actuation of a smoke detector shall activate a visible and an audible signal in an approved location. OMSC 606. 9. Hydronic piping systems shall be designed and installed to permit the system to be drained. Where the system drains to the plumbing drainage system, the installation shall conform to the requirements of the Plumbing Code. OMSC 1206 10. Hydronic piping systems other than ground source heat pump loop systems shall be tested hydrostatically at one and one half times the maximum system design pressure, but not less than 100 psi (689 kPa). The duration of each test shall be not less than 15 minutes. OMSC 1208 11. Every refrigerant- containing part of every system that is erected on the premises, except compressors, condensers, vessels, evaporators, safety devices, pressure gauges and control mechanisms that are listed and factory tested, shall be tested and proved tight after complete installation, and before operation. Tests shall include both the high- and low- pressure sides of each system at not less than the lower of the design pressures or the setting of the pressure relief device(s). The design pressures for testing shall be those listed on the condensing unit, compressor or compressor unit name - plate, as required by ASHRAE 15. OMSC 1108 Mercury Thermostats. The State of Oregon prohibits the installation of thermostats that contain mercury in commercial and residential buildings. "In accordance with ORS 455.355, the disposal of thermostats that contain mercury shall be in accordance with programs established by thermostat manufacturers, their representative or distributor, or by delivery to sites that will ensure that the mercury does not become part of the solid waste stream or wastewater." Floor drains shall not be located within the dear floor space at a lavatory, water doset, urinal, or bathtub or shower. Safety glazing including but not limited to: the following locations: Each unit of glazing shall be permanently identified by the manufacturer. Sec. 2406. Some of these locations are as follows: a. Glazing in an individual fixed or operable panel adjacent to a door where the nearest vertical edge is within a 24" arc of the door in a closed position and whose bottom edge is less than 60" above the floor or walking surface except when there is an intervening wall or other permanent barrier between the door and the glazing. INCIDENTAL USE AREAS 12. This building is provided with an automatic fire-extinguishing system throughout. The City of Tigard reviews the plans and inspects the structure only for compliance with Chapter 11 of the OSSC, which may not include all of the requirements of the ADA. Approved Plans: I set of approved plans, bearing the City of Tigard approval stamp, shall be maintained on the jobsite.
