MUE: Mixed -Use Employment. The MUE zoning district is designed to apply to a majority of the land within the Tigard Triangle, a regional mixed -use employment district bounded by Pacific Highway (Hwy. 99), Highway 217 and I -5. This zoning district permits a wide range of uses including major retail goods and services, business /professional offices, civic uses and housing; the latter includes multi - family housing at a maximum density of 25 units /acre, equivalent to the R -25 zoning district. A wide range of uses, including but not limited to community recreation facilities, religious institutions, medical centers, schools, utilities and transit - related park- and -ride lots, are permitted conditionally. Although it is recognized that the automobile will accommodate the vast majority of trips to and within the Triangle, it is still important to 1) support alternative modes of transportation to the greatest extent possible; and 2) encourage a mix of uses to facilitate infra- district pedestrian and transit trips even for those who drive. The zone may be applied elsewhere in the City through the legislative process. APPLICABLE DEVELOPMENT CODE STANDARDS 18.340 Director's Interpretations A request for an interpretation shall be made in writing to the Director. The director may develop guidelines to and in the application process. FINDING: On October 22, 2010 the City received an application for a Director's Interpretation from Pacific Realty Associates. The contents of this request are contained in land use file DIR2010- 00006. As part of the request, the applicant requested the interpretation be decided as a Type II procedure, rather than as a Type "I" as set forth in TDC 18.340 and 18.390. The Director shall have the authority to consider the request for an interpretation. The Director shall respond within 14 days after the request is made, as to whether or not the Director will issue the requested interpretation. FINDING: The Director and his designees notified the applicant that an interpretation would be rendered within 14 days of the request. On October 26, 2010 notice was sent to all property owners within 500 feet in preparation of a decision. REQUEST The Tigard Development Code (TDC) 18.340 recognizes that some parts of the TDC may be unclear and do not provide adequate guidance in some situations. It was not possible for the Code's drafters to anticipate all land use circumstances. Sometimes this causes uncertainty for those developing property in Tigard. To address this, the Code authorizes the Director to render an administrative code interpretation to provide greater clarity. On October 22, 2010 the city received a request for an interpretation of TDC Chapter 18.350.030 (Planned Development) regarding the time limit on approval of a Detailed Development Plan (DDP).1 The following section analyzes the request and the applicable circumstances and establishes an appropriate Director's Interpretation. II. ANALYSIS Ambiguity in the Tigard Development Code TDC Chapter 18.350 governs Planned Developments and provides the process for concept plan approval and DDP approval. Within this chapter, Section 18.350.030.A expressly provides an 18- month time limit for Concept Plan approval, but does not assign a time limit on DDP approval unless the pertinent project is phased. Similarly, Section 18.350.030.0 provides criteria for the extension of a concept plan approval, but does not provide extension criteria for a DDP. The chapter is simply silent on the matter. As a result this section presents uncertainty to applicants and landowners when there may be a significant period of time between land -use approval of a DDP and actual construction of the project. 1 The request for an interpretation (DIR2010- 00006) pertains to the Detailed Development Plan approved pursuant to Planning Commission Final Order No. 2009 — 12 (Tigard Retail Center (PDR 2008 -- 00001). 1 of 2 Legislative History The Planned Development chapter of the Tigard Development Code was substantially updated in 2006 (DCA 2006 — 00003) with modifications to both the approval process and criteria. Review of the pertinent legislative record does not reveal a clear intent by decision- makers one way or another regarding the approval of a Detailed Development Plan. This ambiguity predates the 2006 chapter update as the previous code language was also silent on the matter. Consistency with Entirety of Tigard Development Code This absence of a defined approval period is atypical of other discretionary land use approvals, which are subject to expiration if substantial construction is not begun within a specified period of time. Approval periods are in place to ensure development is constructed m a manner consistent with the latest applicable land use regulations, as the re- approval process provides opportunity to examine potential changes in existing conditions or applicable land use regulations or policies. An unlimited approval period of time for a DDP, as requested by the applicant, would be inconsistent with the entirety of the Tigard Development Code. Consistency with Purpose of the Planned Development Chapter An unlimited approval period, as requested by the applicant, is contrary to the stated purpose of the Planned Development Chapter. TDC Subsection 18.350.010.A.1 states one purpose of a DDR is "to provide a means for property development that is consistent with Tigard's Comprehensive Plan through the application of flexible development standards which consider and mitigate for the potential impacts to the City." Without a mechanism to require a reassessment and update of a DDP as time progresses, an applicant could in theory develop property using approval criteria and impact mitigation measures several decades out of date. Precedents for Interpretation A DDP is distinct from most other land use approvals in that the applicant and City are required to invest a substantial amount of resources to produce and evaluate a unique proposal that responds to site - specific conditions. As a result, an 18 -month time period may not be of sufficient time to reasonably implement and vest such an approval. The Planned Development chapter already addresses this by allowing a DDP to propose phases of development (TDC 18.350.030.D), providing a maximum approval period of seven years for all phases combined. While the chapter as a whole does not address a timeframe for a non - phased development, a precedent for a seven year approval period does exist in the code. III. INTERPRETATION Detailed Development Plan approval by the Planning Commission shall be effective for a period of seven years from the date of approval, unless otherwise stated through a condition of approval in a specific land use decision. The Detailed Development Plan approval shall lapse if: 1. Substantial construction of the approved Detailed Development Plan has not begun within a seven year period; or 2. Specifically, as explained in more detail below, we are requesting an interpretation that the TDC currently provides that DDP approvals have no expiration date. II. INTERPRETATION ANALYSIS TDC Chapter 18.340 provides a process to resolve ambiguities within the TDC through a request for a Director's Interpretation. While there are no specific approval criteria applicable to such request, the procedure involves making a written request for an interpretation to the Director. TDC Section 18.340.020.A. The Director has the authority to consider the request for an interpretation and may issue the requested interpretation. TDC Section 18.340.020.8. Notwithstanding provisions of the TDC which may allow a lesser level of review procedures, PacTrust requests that this request be subject to review under Type II procedures. For the reasons set forth below, PacTrust respectfully requests an interpretation that DDP approvals do not expire. 1. TDC Chapter 18.350 does not provide a time limit for DDP approval. TDC Chapter 18.350 governs Planned Developments and provides the process for concept plan approval and DDP approval. TDC Section 18.350.030.A. expressly provides a time limit for concept plan approval, but does not provide any time limit on DDP approval. Specifically, that section states as follows: "Time limit on filing of detailed development plan. The concept plan approval expires after 1 -1/2 years unless an application for 37881- 0008/LEGAL 19399054.2 1 detailed development plan and, if applicable, a preliminary plat approval or request for extension is filed. Action on the detailed development plan shall be taken by the Planning Commission by means of a Type III -PC procedure, as governed by Section 18.390.050, using approval criteria in Section 18.350.070." Consistent with the above provision, the TDC similarly provides express time limitations on other discretionary land use approvals where, as with the concept plan, the apparent intent of the governing body is to limit the duration of such approvals. See, e.g., TDC Section 18.330.020.E; 18.360.030C; 18.420.030.B. Notably, the TDC does not contain a similar or any other express time limit for DDP approval. And, when read as a whole, applicable or relevant provisions of the TDC indicate that DDP approval does not expire as a matter of policy. 2. The intent and implementation of the PD overlay designation reinforces intent that DDP approval has no expiration. The planned development designation is an overlay zone applicable to all zones. TDC Section 18.350.020.A. Unless otherwise applied to a specific site by advance mapping, the planned development overlay zone is applied concurrently with the approval of the detailed plan. TDC Section 18.350.020.C(3). Specifically, the TDC provides, in pertinent part, as follows: "The planned development overlay zone shall be concurrently approved if the detailed development plan is approved by the Planning Commission. The zoning map shall be amended to indicate the approved planned development designation for the subject development site. The approval of the planned development overlay zone shall not expire." TDC Section 18.350.030.B (emphasis added). As such, the approved DDP serves to implement the PD overlay zone designation by providing specific development authorization for a given site, and, accordingly, such detailed review and authorization is intended to remain in effect to implement the PD designation unless modified or expressly replaced with a new DDP authorization. 3. DDP approval is analogous to final plat approval, which does not expire. An approved DDP serves to provide specific implementation of an approved concept plan, subject to a demonstration of compliance with the earlier concept approval, and substantial . deviation requires reauthorization of the approved concept plan. DDP approval is similar to approval of a final plat, which follows and implements an earlier preliminary land division approval, provided consistency with the latter approval is demonstrated. Once approved, a final plat does not expire and remains in effect as a measure for specific development on the subject parcel or site. Absent such continued validity of the post- concept development authorization, the City, the applicant and interested stakeholders would be afforded little or no ongoing certainty regarding development expectations of the site and instead would be subject to repeated concept 37881- 0008/LEGAL 19399054.2 2 development requests. Likewise, since development may only occur in accordance with the detailed plan, a DDP approval should also not expire. III. CONCLUSION Given the express language of the TDC and the corresponding legislative intent to ensure ongoing implementation of the PD overlay designation and initial concept plan following DDP approval, the most reasonable interpretation of the applicable TDC code provisions is that DDP approval has no expiration.
