LLP N C A R B C E R T I F I E D * May 14, 2008 FILE COPY Mr. Brian Blalock Building Official City of Tigard Building Services 13125 SW Hall Blvd. Tigard, Oregon 97223 RE: WinCo Foods Remodel 7501 SW Dartmouth St. BUP 2008 -00079 Tigard, Oregon Dear Mr. Blalock: Following in accordance with Section 104.10, Modifications, of the 2007 Oregon Structural Specialty Code, this letter shall serve as a formal request to allow for the addition of the existing WinCo Store to exceed the allowable area increase of 60,375 square feet. The existing WinCo Store is part of a series of buildings adjacent to each other at the shopping center site and is a fully sprinklered building with a full alarm system. The original building was constructed in 1993 under the 1991 UBC (with 1993 OSSC amendments), Type II -N Construction, Occupancy Group B -2. The existing square footage for the WinCo Store was 85,098 square feet with unlimited area increase. When Petersen ®Staggs submitted drawings to the City of Tigard Building Department for the remodel and addition, we proposed 12,632 square feet of additional building, increasing the total from 85,098 s.f to 97,730 square feet. This submittal was under the 2006 IBC with 2007 OSSC amendments, Construction Type II -B, Occupancy Group M. Because the existing WinCo building and the shopping center was recognized as one structure, separation on all sides, fully Sprinklered and surrounded and adjoined by public ways or yards not less than 60 feet, WinCo was allowed unlimited area increases per Chapter 5, Section 507.3 of the 2007 OSSC. During plan review process, Mark Van Domelen, Plans Examination Supervisor, contacted our office to inform us that after researching the building and site, WinCo was not allowed unlimited area increases under the current code due to a lot line adjustment that was recorded after the fact, separating the WinCo /GNC from Petsmart. After some investigating from our end and details from Mark, there was a Lot Line Adjustment(s) performed on this site in 1994 under the Planning case MLP94- 00020. One such lot line now runs North -South along the West (left) wall of the Petsmart and adjacent to the GNC shops, the latter being part of the WinCo expansion. 5200 W. This negates the unlimited area increases that WinCo was previously allowed prior to the lot line adjustment. Per Table 503 of the 2007 OSSC, A Type II -B, Occupancy Group M building has a basic allowable building area of 12,500 square feet. When factoring in the allowed area increases due to frontage and automatic sprinkler system protection per section 506, you are allowed an additional 47,875 square feet. This leaves WinCo with a total allowable area of 60,375 square feet, with an existing building at 85,098 square feet. WinCo has essentially been over the basic allowable area since 1994. WinCo had no prior knowledge of this Lot Line Adjustment and have no records to show this documentation. Had this information been known prior to the start of Design, a possible different approach would have been logical. Allowing WinCo to expand by approximately 12,600 square feet would be without detriment to the existing store size, as it already is over the allowable area by nearly 25,000 square feet. In addition, WinCo fully intends to meet all Code requirements at the expansion area. The existing automatic fire sprinkler system shall extend into the expansion area. Prior to the Lot Line Adjustment, the WinCo building would have been allowed unlimited openings between the store and Petsmart. By definition of the code, WinCo must now provide 8" thick CMU with a minimum 2 -hour rating per Table 720.1(2) of the 2007 OSSC at all new (west) exterior walls. Our current submittal confirms WinCo's compliance with all other Code mandated regulations and Local Authorities necessary to obtain approval for the proposed expansion and we respectfully request your approval in accordance with Section 104.10 of the 2007 OSSC.
