The work would occur within the 100 ;ear flood plain of the Tualatin River and would involve landfc n alterations. The site is outside the zero foot rise floodway. City staff recommended conditional approval of the request. The applicant accepted the conditions of approval. No other person testified. FINDINGS ABOUT SITE AND SURROUNDINGS A. Site size and shape The site of the proposed demolition and construction is roughly a square with 33 feet on a side. It contains about 1000 square feet. B. Site location ; The site of the proposed demolition and construction is within Cook Park east of a roadway and parking area that extends from the south end of SW 92nd Avenue. C. Existing uses and structures The site is currently a restroom containing about 900 square feet and 10 stalls. The eastern portion of the park contains the playground and picnic area. The western portion of the park contains two soccer fields and two baseball fields. An access road from SW 92nd Avenue and parking facilities wind through the center and eastern portions of the park. Approximately 14.5 acres of the park, along the Tualatin River and in the southwest corner of the park, are undeveloped and remain in their natural heavily wooded state. Proposed uses and sutures The applicant proposes to remove the existing resign and to replace it with a new structure containing about 800 square feet and 6 stalls, E. Existing and proposed vegetation Scattered trees and grass are located throughout the picnic and play areas of the park and around the existing restroom facility. Existing trees in the vicinity of the restroom will be preserved and about 7 new trees will be planted around the restroom building. F. Topography and drainage The site is flat and is in the 100 -year floodplain of the Tualatin River. The floodplain elevation is 126 feet above mean sea level (nisi). The restroom site is at about 120 feet msl. The site is within the floodplain fringe and not within the zero -foot rise floodway. G. Plan designation and zoning : The site is designated Low Density Residential and is zoned R -4.5 (Residential). H. Public services and utilities : The site can be served by public sanitary sewer and water and by power utilities. The storm sewer is about 90 feet south of the site. I. Streets and access : The site in within Cook Park next to an access road and parking. The access road continues south from SW 92nd Avenue and winds east and south through the site to dead ends. The roadway passes directly west and east of the restroom site S.W. 92nd Avenue is a minor collector street on the City's Transportation Plan Map. It extends from Durham Road to the entrance of Cook Park, although south of Kneeland Estates and Tigard High School, it serves largely as a dedicated park road. The street has a 24 foot wide pavement within a 50 -foot right of way with streetlights but not curbs, sidewalks or storm drains. J. Surrounding land uses Tigard High School and the Kneelaid Estates Subdivision are north of the park A dairy farm is immediately east of the park. The Tualatin River forms the southern boundary of the park. Tualatin Country Club is further south. III. APPLICABLE APPROVAL CRITERIA & DEVELOPMENT S'T'ANDARDS A. Chapter 18.50 (R -4.5 zone). Chapter 18.50 contains the regulations of the R -4.5 zone including setback, parking and landscaping provisions. A commtinity recreation use is a conditional use in the zone pursuant to section 18.50.040. Chapter 18.130 subjects enlargement or alteration of an existing conditional use to Conditional Use and Site Development Review. However, per Section 18.130.060, this is a minor modification and, therefore, is subject only to the Planning Director's approval. Page 2 - Hearings Officer acer decision SLR 90 -0013 (Cook Park Restroom) B. Chapter 18.84 (Sensitive Lands Review). 1. Chapter 18.54 contains the regulations for land subject to sensitive lands review. Sensitive lands review is intended to implement flood plain protection measures and to protect rivers, streams, and creeks by minimizing erosion, promoting bank stability, maintaining and enhancing water quality and fish and wildlife habitat, and preserving scenic quality and recreational potential. Section 18.84.015(A) allows community recreation uses such as parks in areas_ subject to sensitive lasi:is review. Section 18.84.015(C) requires Hearings Officer approval of landforn alterations or development in the 100-year floodplain 2. Section 18.84.026 requires use of designs, materials, and practices that minimize flood damage and the potential for damage. 3. Section 18 84.040 provides landform alterations subject to sensitive lands review must comply with the following criteria: a. Land form alterations shall preserve or enhance the floodplain storage function and maintenance of the zero -foot rise floodway shall not result in any narrowing of the floodway boundary; b. Land form alterations or developments within the 100 -year floodplain shall be allowed only in areas designated as commercial or industrial on the comprehensive plan land use map, except that alterations or developments associated with community recreation uses, utilities, or public support facilities as defined hi Chapter 18A2 of the Community Development Code shall be allowed in areas designated residential subject to applicable zoning standards; c. Where a land form alteration or development is permitted to occur within the floodplain it will not result in any increase in the water surface elevation of the 100 - year flood; d. The land form alteration or development plan includes a pedestrian/bicycle pathway in accordance with the adopted pedestrian/bicycle pathway plan, unless the construction of said pathway is deemed by the Hearing Officer as untimely; e. The plans for the pedestrian/bicycle pathway indicate that no pathway will be below the elevation of an average annual flood; E The necessary U.S: Army Corps of Engineers and State of Oregon Land Board, Division of State Lands approvals shall be obtained; and g, Where land form alterations or development are allowed within and adjacent to the 100 -year floodplain, the City shall require; the dedication of sufficient open land area within and adjacent to the floodplain in accordance with the comprehensive plane This area shall include portions (If a suitable elevation for the construction of a pedestrian/bicycle pathway with the floodplain in accordance with the adopted pedestrian/bicycle pathway plan. C. Applicable Comprehensive Plan Policies, 1. Policy 201.1 provides the City will assure citizens will be provided an opportunity to be involved in ail phases of the planning process. Policy 3.2.1 provides that the City will prohibit any development within the 100 year flood plain that would result in any rise in elevation of the 100 -year floodplain. 3. Policy 3.12 provides that the City prohibit development in the floodvvay but may allow development in the floodway if the alteration preserves or enhances the function and maintenance of the zero -foot rise floodway; Policy 3.2,1 also provides that the City may allow limited specified development in the floodplain outside the zero -foot rise floodway. 4. Policy 3.2.3 provides that development is within the 100 -year floodplain outside the zero-foot rise floodway is conditioned upon specified requirements. 5. Policy 3.5.3 provides that the City has designated 100 -year flood plains of the Tualatin River as greenway and that development within the 100 -year floodplain shall be conditioned upon the dedication of sufficient open land area for greenway within the floodplain. 6. Policy 4.2.1 provides that all development within the Tigard Urban Planning Area shall comply with applicable federal, state and regional water quality standards. IV. HEARING, TESTIMONY, NPO & AGENCY COMMENTS A. Hearing. The examiner received testimony at the public hearing about this application on January 28, 1991. A record of that testimony is included herein as Exhibit A (Parties of Record), Exhibit B (Taped Proceedings), and Exhibit C (Written Testimony). These exhibits are filed at the Tigard City Hall. B. Summary of Testimony. John Acker summarized the staff report and recommendation and acknowledged the City would comply with the recommended conditions of approval. C. NPO & Agency Comments 1. The Engineering Department, Fire District No 1, Tigard Water District, and City of Tualatin reviewed the proposal and offered no comments or recommendations. 2. The Building Division recommended that plans be reviewed and approved before construction of the restroom. V. EVALUATION OF REQUEST A. Compliance with Chapter 18.50 (R-4.5 zone). The proposed use complies with Chapter 18.54, because it is listed as a permitted conditional use in the R -4.5 zone, and because it complies with the requirements of the zone concerning setback, parking and landscaping. Since this is a minor modification of an existing conditional use, pursuant to Section 18.130.060, a Conditional Use application is not required, and the proposed minor modification can be approved by the Planning Director. The proposed development will reduce the built area within the flood plain. Therefore it will maintain or increase the storage capacity of the flood plain, will not result in narrowing of the floodway boundary, and will not result in an increase in the water surface elevation of the 100 year flood. b. A landform alteration in the 100-year flood plain is permitted in a residential zone for a community recreation use. c. A. pedestrian/bicycle pathway is not timely because the Pedestrian/Bicycle i Pathway Plan does not identify the subject site as the location of a planned path segment. About 2000 feet of pedestrian/bicycle path is being built along the Tualatin River as part of waterfront improvements in the park. d. The applicant plans to have the restroom comply with floodproofing techniques required in Chapter 18.84.26. Review by the Building Division is warranted ensure such compliance occurs. e. Approval of The US Corps of Engineers and Oregon Division of State Lands is not required, because the proposed. w'o'k is not within a wetland or within the river's channel. f. Dedication of open space is not necessary because Cook Park is already owned by the City. C. Compliance with applicable Comprehensive Plan Policies. 1. The proposal complies with Policy 2.1.1, because notice of the application or hearing was provided to the neighborhood planning organization in the area and to owners of property in the vicinity of the site and published in the Tigard Times. No comments were received. 2. The proposal complies with Policies 3.2.1, 3.2.2, and 3.2.3, because the proposed landform modification is outside of the floodway and will not result in an increase in the elevation of a 100 -year flood. 3. The proposal complies with Policy 3.5.3, because the City already owns Cook Park. 4. In order to comply with Policy 4.2.1, a condition is warranted to require the applicant to submit an erosion control plan ensuring compliance with interim erosion control measures for the Tualatin River Basin as part of the grading permit application. VI. SITE VISIT BY HEARINGS OFFICER The Hearings Officer visited the site and area that could be affected by the proposed change, without the company of others. CONCLUSION DECISION The examiner concludes that the proposed use and associated landform alterations comply with the applicable approval criteria for a sensitive lands review permit in recognition of the findings and conclusions containd herein, and incorporating the Summary and other reports of affected agencies and public testimony and exhibits received in this matter, the examiner hereby approves SLR 90-0013, provided: 1. Before the applicant demolishes the existing restroom, the applicant shall apply for and receive a demolition permit, 2. Before the applicant stays grading or construction for the new restroom, the applicant shall: a. Apply for and receive approval of a building permit from the Building Division; and b. Submit and receive approval of an erosion control plan as part of the building permit submittal. The plan shall confer to "Erosion Control Plans - Technical Guidance Handbook, November 1989." An extension of 92nd Avenue pauses through the park. This access road passes directly west of the restroom site and continues south to the Tualatin River where it terminates. An additional paved road leads east just south of the site SW 92nd Avenue is a minor collector on the city's Transportation Plan Map. It extends from Durham Road to the entrance of Cook Park. South of Kneeland Estates and Tigard High School it serves largely as a dedicated park road. The pavement width is 24 feet within a 50 foot right -of -way. There are streetlights along the roadway but no curbs, sidewalks or storm drains. surrounding Land Uses: Tigard High School and Kneeland Estates Subdivision are north of Cook Park. A dairy farm is immediately east of the park. The Tualatin Country club is directly south, across the river, from the development site. III. APPLICABLE APPROVAL CRITERIA & DEVELOPMENT STANDARDS Chapter 18.50 (R --4.5 zone) Chapter 18.50 of the Community Development Code pertains to development standards that apply to the above zone. A community recreational use is a conditional use within this zone. Chapter 18.130 subjects enlargement or alteration of an existing conditional use to Conditional Use and Site Development Review procedures. However, per 18.130 a 060, this is a minor modification which does not modify the existing use and therefore it is not subject to a new Conditional Use review. B. Chapter 18.84 (Sensitive Lands Review) 1. Chapter 18.84 contains the regulations for land subject to sensitive lands review. No other comments have been received. V. EVALUATION OF REQUEST A. Compliance with Chapter 18.50 (R-4.5 Zone) The proposed use complies with Chapter 18.54 because it is listed as a permitted conditional use in the R-4.5 zone, and because it complies with the requirements of the zone concerning development standards. Since this use is a modification of an existing use. pursuant to Section 18.130.060, a Conditional Use is not required and the proposed modification does not require Conditional Use approval. B. Compliance with Chapter 18.84 (Sensitive Lands Review) The proposed use complies with Chapter 18.84 because: a. The proposed development will reduce the built area within the flood plain and therefore preserve the storage capacity of the flood plain, not result in the narrowing of the floodway boundary and not result in an increase in the water surface elevation of the 100 year flood. A landform alteration or development in the 100 year floodplain is permitted in a residential zone for a community recreation use • The adopted Tigard Park Plan does not identify a pedestrian /bicycle pathway in the vicinity of the subject site and therefore the proposed plan need not include a pathway. Approximately 2,000 Lineal feet of pedestrian/bicycle pathway is being constructed near the Tualatin River as part of a waterfront improvement project in they southern part of the park. The replacement structure within the project will be constructed using f loodproofing techniques required in Chapter. 18.84.26. U.S. Army Corps of Engineers or Division of State Lands approval is not necessary for this proposal.
