Location: The drainageway is located south of Durham Road, west of the Rebecca Park Subdivision, and east of SW 113th Avenue (WCTM 231 15A, Tax Lot 1800 and WCTM 231 15AA, Tax Lot 6800). Zoning: R-4.5 (PD) (Residential, 4.5 units/acre, Planned Development) and R-25 (Residential, 25 units/acre). DECISION: Notice is hereby given that the Planning Director's designee for the City of Tigard has APPROVED the above request subject to certain conditions. The findings and conclusions on which the decision is based are noted below: A. FINDINGS OP FACT 1. Background Tax Lot 6800 is public open space created through the approval of Rebecca Park Subdivision by the Planning Commission in December, 1988 (Zone Change Ze 88-05, Planned Development PD 88-05, Subdivision S 88-08, Variance V 88-36). A pathway through the parcel providea pedestrian access to the wooded drainageway from SW ChateaU Lane. Tax Lot 1800 along with the adjacent Tax Lot 1700 to the north were involved in a recent Site Development Review approval for construction of a 172 unit apartment complex to be located at the southeast corner of Durham Road and SW 113th Avenue (Site Development Review SDR 90-0003). No other land tide or development applications regarding these properties have been reviewed by the City of Tigard. 2. Vicinity Information The subject parcels are adjacent to other properties zoned with the City's R-4.5 zone to the oast, and the City's R-25 zone to the north. Propertied to the south and WelSt are zoned by Washington County with th. R-5 (Residential, 5 units/acre) zoning district. Single family residences are iodated on properties to the weat, south and east. The recently constructed Oak tree Apartments are located to the north on the northeastern branch of the ravine, the previously mentioned proposed 1/2 unit apartment complex Would be located to the north on the northwestern branch of the ravine. The ravine contains steep banks, is heavily wooded, and contains primarily native understory vegetation. The northern segment of the ravine branches into two sub-areas leading to Durham Road. The applicant proposes construction of .:, 344 foot long 8-inch sewer line within the ravine. The sewer construction is being financed through a local improvement district involving several parcels abutting the drainageway. The proposed sewer would extend from an existing 12-inch sewer line in Tax Lot 6800, northwesterly across an intermittent creek and northward to Tax Lot 1800. Only a short portion of the proposed sewer line would be located within the City of Tigard, approximately 60 feet on Tax Lot 6800 and approximately 15 feet on Tax Lot 1800. A separate p.rmit has been applied for from Washington County with r:,.gard to the area in which the sewer will cross lands under Washington County's jurisdiction. No area within the City of Tigard considered for construction is within the 100 year flood plain of the Tualatin River. 4. Agency and NPO Comments The Engineering Division has the following comments: a. b. reviewed the proposal and provides The applicant has submitted detailed construction drawings as well as a project description. The LID includes 2 parcels: Tax Lot 1800 is currently within the City, and Tax Lot 1801 which is outside of the City. The proposed line also crosses Tax Lot 1900 which is not in the City, or Within the LID, as well as a City owned parcel. The Engineering Division is not aware of any similar statements from the owner of Tax Lot 1900 or of any desire to connect to the proposed line. d. The proposed construction is a land form alteration within a drainageway that requires meeting the approval standards set out in subsection 18.84.040 C of the Code. The proposed construction meets these standards so long as scheduling, ground restoration, and erosion control is adhered to as described in the submitted construction plans and project description. The Building Division has reviewed the proposal and has comment,.d that a list of all properties that zre participants in the local improvement district must be submitted to the Building Division for future sewer hookup fee calculations. The Tualatin Valley Fire and Rescue District has review.d the proposal and has commented that although the District has no objections, the District would like to be informed whether any roads in the immediate area will need to be closed during the construction of the sewer ext.nsion. PGE, GTE, the Tigard Water District and the City of Tigard Field Operations Department have reviewed the proposal and have issued no comments or Objections. No othar comments have been received. B. ANALYSIS AND CONCLUSION ComMunity Development Code Section 18.84.015.8 states that underground Utilities are permitted in sensitive lands areas subject to obtaining permita from the applicable city review body. ComMunity Development Code Section 18.84.01500 requires that landform alteration or development within a drainageway not within a 100 year flOodplaln area be reviewed by the Planning Division subject to the approval criteria for a Sensitive Lands permit. Code Section 18.84.0406C Contains the following criteria whereby the Director shall make fihdingd when reviewing an application to approve a landfOrM alteration or deVelOpment within a drainageWaYi a. The water flow capacity of the drainageway is not decreased; d. Where natural vegetation has been removed due to land form alteration or development, the areas not covered by structures or impervious surfaces will be replanted to prevent erosion in accordance with Chapter 18.100, Landscaping and Screening: e. The drainageway will be replaced by public facility of adequate size to accommodate maximum flow in accordance with the adopted 1981 Master Drainage Plan; f. The necessary U.S. Army Corps of Engineers and 'state of Oregon Land Board, Division of State Lands approvals shall be obtained; g Where land form alteratione and/or development are allowed within and adjacent to the 100-year flood plain, the City shall require the dedication of aufficient open land area within and adjacent to the flood plain in accordance with the Comprehensive Plan. This area shall include portions of a suitable elevation for the construction of a pedestrian/bicycle pathway within the flood plain in accordance with the adopted pedestrian bicycle pathway Plan. The extent and nature of the proposed land form alteration and development that are necessary for installing the sewer line will not create site disturbancea which are greater than are necessary for construction. The applicants state that the intent is to restore the ground surface to as close aa possible to its original condition. The applicants have submitted a detailed erosion control plan which is intended to limit erosion and stream sedimentation resulting from the ground disturbance. The applicants have noted that construction is planned for the anticipated dry season during the summer of 1990. Because the drainageway will be restored to its original contours after construction, this project is not anticipated to change the capacity of the drainageway for stormwater floW. The applicant's plans indicate that four alder trees will be r.moved from land under the jurisdiction of Washington County in order to construct the sewer extension. No tree reMoval has been indicated to be necessary within land under the City's juriediction. The applicants" sUbmittal notes that the area will be reseeded with grass seed and trees after final construction i Because the project will not disrupt the ability Of the drainageway to conduct etormwater flow, there is no need for replacing any public fadilitied. The proposed line connects to an existing 12-inch sewer line that lies in the major drainageway that crosses S.W. Durham Road between S.W..113th,Amenue and S.T. 108th Avenue. The proposed Sewer line will extend from the 12-inch sewer line 344 feet northwesterly up a branch drainageway to serve the area. Comment: The immediate affect on wildlife will be iinimal because of the insignificant size of the project. Wildlife will be temporarily displaced to adjacent areas duriag construction. The construction period should not exceed two to three weeks. Trees in the area have been mapped and identified on the submitted site Plan. The vegetation currently is minimal because of the density of trees along the ravine. The area will be reseeded with grass seed and trees will be planted after final grading of the construction area. The following are some methods that can be used: sprinkling haul and access roads and other exposed dust producing areas with water; applying dust palliatives on access and haul roads; sweeping of asphalt surfaces; placing wood chips or other effective mulches on vehicle and pedestrian use areas; and pre-wetting cut and borrow area surfaces and use of covered haul equipment. 11.4 STREET CLEAN UP The Contractor shall clean all spilled dirt, gravel, or other foreign material caused by the construction operations from all streets and roads at the conclusion of each day's operation. If in the opinion of the Agency, the contractor is not adequately restoring the disturbed areas behind the pipe laying operation, the Agency may stop the pipe laying operation until such time that the restoration of the disturbed areas are satisfactorily completed. 11.6 STREAM AND CREEK CROSSINGS Before any work may be performed altering or disturbing any waterway, the method of operation and the schedule of such work must be submitted to the Agency in writing and approved by the Agency. Work within the wetlands area as defined by the Oregon Department of State Lands shall be scheduled to take place as specified in the applicable permits for such work, and once started, shall be completed without interruption of the work. When the Contractor crosses a creek, materials from the trenching Shall be deposited above high water and behind riparian vegetation whenever possible. Excavation spoils and other deleterious materials, such as dirt, silt, cement, or petroleum products originating from the operations, shall not be allowed to enter stream channels nor shall such materialS be placed where they may later enter these areas. If such materials enter the stream the Contractor shall stop work on the project Until such time that the problem is corrected. Alteration or disturbance of the bank and ekisting riparian Vegetation Shall be minimized. Stream flows shall be diverted around the work by means of a cofferdam and culvert or other suitable alternative means that are approved by the Agency. Water pumped out of any excavation shall not be discharged directly in the waterway if the discharge increases the turbidity of the waterway by more than 10 percent, unless approved by the Agency. Trees or logs used for erosion control should be arranged parallel to each other, overlapped one-third to one-half, and permanently anchored against the bank. Instream debris or trees leaning over the waterway shall not be removed unless approved by the Agency. Stream width and hydraulic conditions must be considered and care taken when restoring the creek bank so that the restoration does not increase velocity and cause erosion to the opposite bank. 11.6.1 Bank ReStoration The Contractor shall maintain shaped waterway banks no steeper than 3:1 to stabilize vegetation without approval by the Agency. 11.1 HISTORICAL AND ARCHAEOLOGICAL AREAS When burial sites, buried damp areas; or Village sites, and other distinctive archaeological or historical items are UncoVered, the Contractor shall report the aie to the Agency and the state liaison Officer. Chapter 14 LANDSCAPE RESTORATION 14.1 SCOPE This section covers the work necessary for restoration of the landscape. 14.2 MATERIALS 14.2.1 Plants Plants shall be first-class representatives of their normal species or varieties. The branch system shall have normal development and be free from disfiguring knots, sunscald, injuries, abrasions of the bark, dead or dry wood, or other objectionable disfigurements. Trees shall have reasonably straight stems and be well-branched and symmetrical in accordance with their natural habits of growth. Grading of plants shall conform to the. "American Standard for Nursery Stock," as approved by the American National Standard Institute. Plants shall be free from plant diseases and insect pests. All shipments of plants shall comply with all nursery inspection plant quarantine regulations of the State of Oregon and the state of origin, if other than Oregon. Should it be necessary to substitute a plant of a different variety than the plant Material specified, the contractor shall secure approval from the Agency for the substitution prior to digging the plant. All ornamental shrubs or plants shall be balled and carefully handled and kept watered, and replaced in their original positions without damage. Lawn sod shall be handled in a similar manner. Wherever lawn sod cannot be saved and restored, the ground must be reseeded and cared for until a stand of grass is reestablished. Installation of sod is a substitute for reseeding lawn areas.
