My opinion is that it is an outright permitted use in the old zone, as of the old zone, and I'll tell you why. I think we are talking here about what the courts' have called a vested right. And I point , to the leading case of Oregon called Clackamas County v Holmes; What I term in the vernacular, the chicken case. In that case, s o me people who were in the chicken processing oessbus inI s bought a very large tract of land in the unincorporated area of Clackamas County, in about 1965° These dates are approximate. The ' original conditional use permit was approved in September of ' 1973. It permitted the construction of a number of duplexes . in an R-15 zone. Apparently at the time of the application ' for the conditional use permit all of the owner's property was in one large lot. Thereafter the owner filed a preliminary plat subdividing the lot into ten 15,000 square foot building sites for single family residences and eight 8,000 square foot p i. v... .proposal Te a._. rovalpof building sites duplex building sites. That was apparently finally approved on November 5, 1073 pp building . �•: of 8,000 square feet for duplexes in an R-15 zone was an error. The Tigard Zoning Ordinance does not permit the development of duplexes on 8,000 square foot lots in R--15 zones.
