That 10 feet of right-of-way be dedicated to the city with half • street improvements along the frontage of the property on S.W. 98th prior to issuance of building permits. 2. That 60 feet of right-of-way be dedicated to the City with full collector street improvement along the frontage of the subject site for the creation of S.W. APPLICANT'S PRESENTA- TION was made by Craig Cowles, 13505 S.W. Village Grenn Drive, Tigard, who simply requested Commission approval of the request. There was no PUBLIC TESTIMONY. COMMISSION DISCUSSION AND ACTION: speaker raised the question of avail- ability of sewer in the light of Condition No. 3 and the assertion in Findings of Fact No. 6 that sewer service is available off S.W. Ash Street. Selby explained that because of delays sometimes amounting to several months in sewer hookups, Recommendation 3 was included to insure adequate capacity was indeed re that ade uate sewer inquired available when the _property was actually developed. Less Biggins asked why the street cannot be improved prior to development, explained again by Howard, who enlarged on the funding sources for Tigard streets and problems connected therewith. In response to a question, Staff explained plans for the extension of Commercial Street as the property is developed. i" The President asked Mr. Rohl to explain the phrase ''condominium-style". The phrase, he thought, might be a misnomer. In discussion with and among the Commissioners it was brought out that what is contemplated is 40 townhouses in buildings containing from three to seven or eight units each, with common areas owned and maintained by a townhouse association. In the sense that each house- holder will own a lot only slightly larger than the ground on which his common- wall un,' t is situated, it would be more accurate to call them simply townhouses. Mr. Rohl in REBUTTAL then responded to the various points voiced in opposi- tion public testimony. John Havery of Tigard inquired in general whether the developer of a Plann- ed Development approved for a density less than permitted by zoning could later develop to the maximum density allowed by the zone. The site has two single family units with a heavy consitration of trees 1' throughout the site The topography slopes gentle from the north to • south and has a minor wet lands area on its south end. 7. The surrounding land uses are single family with vacant and open space P arcels on all sides. The com p rehensive plan designates the properties to the west of the subject site as multi-family. To the south is the Southern Pacific Railroad tracks. South of the tracts is an industrial area. The areas north and east are designated "Single-family". The area adjacent south of the subject site was also designated as "Multi- family" 20 dwelling units per gross acre (condominium-style). 8. Traffic to and from the site will be served by S.W. 98th and a future extension of S.W. Commercial Street from the southbast. S.W. 98th is a city street with approximately 16 feet of paving in good condition. However, there are no curbs or sidewalks. S.W. Commercial will be created from the intersect'ion of S.W. 95th Avenue west to S.W. 98th when the property adjacent south of the subject site is developed. The Corn- prehenS ve Plan designates S.W. 98th as a local street having 50 feet of might-of-way and S.W. Commercial Street as a dollector street with 60 feet of right-of=-way. S.W. 98th presently has 30 feet of right-of-way. 9. Sewer and water is presently on site with ample capacity for the pro- posed forty dwelling units. I/. Conclusionary Findings: • 1. S.W. 98th is presently in substandard condition to manage the increase traffic. Therefore; ten feet of right-of-way with half street improve- ments will be necessary. 2 Since there are significani�. vegitation on the site, the site development must be designed to preserve the trees wherever possible. 8.
