AGREEMENT (a) City Administrator reviewed the history of the cable T.V. issue over the past year and explained that at this point there is a draft inter-govern- ment cooperation agreement which will form a Commission of representatives to request and evaluate proposals. He pointed out that this would save money by sharing costs and provide a higher degree of expertise than Tigard could acquire on it's own, He requested that Council review the proposed agreement and suggest any amendments. n 1. (b) After discussing the provisions to allow the City to pull out of the agreement (at any time on 10 days notice), Council requested that this be placed on next week's agenda. 10. DESIGNATE CITY OFFICIAL FLOWER (a) Mayor explained the request from the Garden Club and pointed out the silk sample and catalog pictures of the flower. (b) Consensus of Council to place this on next week's agenda and to invite Garden Club members to attend. 11. UPDATE Off' TIGARD - METZGER ISSUES (a) Planning Director reported that representatives of Metro, Washington County, Metzger and the City had met to discuss the Metzger issue. He went on to say that the Washington County Urban Planning Area Agreement would be signed Tuesday and that the City may be requested to present a proposal to. Metzger regarding provision of City services. He concluded by saying that the proposed growth boundary would remain at Pfafflu, 12. AMENDMENT TO NEIGHBORHOOD PLANNING ORGANIZATIONS RESPONSIBILITIES AND MEMBER- SHIP STRUCTURE Via) Planning Director reported that the request for a change in this system ' had come from the NPOs due to declining participation. He explained that this amendment would reduce the membership from 12 to 7 and would delete the requirement from petition signatures. He concluded by recommend- - ing approval, (b) Council discussed their desire to retain the petition requirement to ,. validate the person's representation of the community# Consensus of Council to amend and place this on next weeks agenda. 3 - GAIN REID PROJECT ON KATHERINE STREET (a) Planning Director reported that Tax Lot 200 had been partitioned in, Washington County Circuit Court by a divorce decree (into tax lots 200 & 201). He stated that the City had not been informed of this action. He went on to report that the proposed development on t:a}t' lots 100 and 200 Would have only office spaces facing the reaidentiai neighborhood. Planning Director stated that he will request that the developer go through the City's minor land partition process to clear up the status of the lots. 14. WASHINGTON COUNTY MUSEUM (a) Planning Director explained the Washington County request for a contri- . bution to the museum fund from Tigard in the amount of $2,500. (b) Consensus of Council to refer this to the Budget Committee. • 15. ANNEXATION OF LANDS TO THE TIGARD WATER DISTRICT • (a) Planning Director reported that this will provide for automatic annexation to the Water District of lands which are annexed by the City, He recom- mended approval. (b) Consensus of Council to approve. 16. OTHER (a) Planning Director read a draft letter to Mrs. Sharp regarding John Tigard House for the Mayor's signature. Council authorized sending the letter, (b) City Administrator reported that we are scheduling intervieWs with the , . Selection Committee for .iudget Committee vacancy. (t) City Administrator brought to Council's attention the memorandum regard- ing Budget Committee meetings, (d) Public Works Director reported that CH2M Hill has requested that the City pUt pressure on the Corps of Egiteers to provide the information needed in the CH2M Hill report. He indical!ed that the CH2M Hill report has been waiting for this information for more ihan six months. In the alternative, I request that the City Council reconsider the matter on the basis of the record below, alone, without giving any consideration to the public testimony at the council meeting, and that the council be requested to make a journal entry in its official record on reconsideration, that the decision as to Condition #4, rendered on reconsideration, was made without regard to the public testimony erroneously received in evidence. While Mr. Reid and the City Council may be able to reach an amicable resolution of the disputed Item #4 , the "clock" keeps • running on my previous zone change for the adjacent Tax Lot 100 and its subsequent eXtension. I clearly face an April 13, 1980 deadline. Both Mr. Reid and I are in agreement with the conditions of Ordi- nance No. 80 as it was presented to the City Council. Ordinance No. 80 embodies all the terms of the zone change previously given II • to Tax Lot 100. This previous zone change is also acceptable to Mr. Reid and me. In the face of an impending deadline, I would request that you give me formal direction a8 to how I might protect and extend my previous zone change, if the resolution of ZCPD-2-80 rung past April 13, 1980. Howard presented revised wording of Chapters 18.560170 and 18.72,030 for consideration. Tepedino raised the question of what objective measure might be included to eliminate the charge of "arbi trary and capricious'. It was agreed no satisfactory objective measure is practical. Smith preferred approval via a Staff process, but for only six months rather than a year, which was agreeable to Staff. This would require of the applicant a completely new application if substan- tial progress had not been made in 18 months. There was no PUBLIC TESTIMONY. It was the consensus that the ordinances as discussed and revised be submitted to the City Council for adoption. OTHER BUSYNESS: Howard reported he has asked the City Council to eliminate the Site Design Review Board. The reason is that an appeal from the Planning Directorts site design decision goes on appeal to the Site Design Review Board, whOse action is final„ No appeal can be taken to the City Council. Howard's proposal, on the other hand, is that an appeal from the Planning Director's decision would be appealable (Y. to the Planning Commission W and thence to the City Council. In discus- sion, Smith, an alternate member of the Site Design Review Board, stated his belief the Site Design Review Board is not an effective body. Howard suggested that annexations in the future be made with zoning in accordance with the Comprehensive Plan. This would eliminate one step. Mach Commission member would receive the staff Report as submitted to the Boundary Commission for revieW prior to the Boundary Commission hearing, together with the Zone Text Ordinance annexing the property to comprehensive zone. This would give the Commission members the opportunity y to have the applicant appear before the Cont- i ' mission if it is thought desirable, for whatever reason. Once the planned development has expired, the underlying industrial zone could be developed with any of the uses permitted in that zone. 5. The subject is relatively flat and vacant. Surrounding land uses consist of single family residence to the west and north, industrial warehouses to the south and east. 6. Sewer and water are available to the site off SW Katherine Street. , . 7. Traffic circulation will be available to the site off SW Katherine and T ga ra Street. SW Katherine is a City street with fort: (40') feet of right-of-way and is in substandard condition, has no curb or sidewalk and inadequate parking Width. The NPO 42 Plan designates SW Katherine as a local Street. II. CONCLUSIONARY FINDINGS: 1. The applicant has sufficiently addressed all the concerns of the preliminary and general plan reqUirementS stated in Sections 18.56.020 and 18.56.030 of the Tigard Municipal Code. 2 The plan indicates that Tax Lot 200 will properly blend with Tax Lot 100. However, the two tax lots should be consolidated into one to eliminate restrictive Uniform building code regulations. 4 . 3. The proposed use is in keeping with the NPO 42 Plan and the facilities are available to serve the business with standard imProvements. 4. The applidant has expressed a desire to redeive approval of the general 41/2 plan and program level 11 possible. III. STAFF R8COMMENbATION: Staff recommends approval of the zone amendtent from R-7 to M-APD at the general plan and Program level subject to the following donditions: STAFF REPORT TIGARD PLANNING COMMISSION • AGENDA 5.4/7.0 PD 2-80 February 5, 1980 Page 3 • 1. If substantial construction or development has not taken place within one (1) year of the effective date of this zone change, the property shall revert back to the present R-7 zone. • 2. Five feet of right-of-way be dedicated along the Katherine Street frontage for street improvement purposes. 4. That offices will be the primary use, with secondary uses of warehouse business subject -P.o the following critieria: a. Low traffic generatos b. Low generators of noise o. Non-labor intensive d. Uses confined to storage rather than manufacturing assembly and processing. 5. That Tax Lots 200 and 100 be consolidated into one (1) prior to issuance of Building Permit. 6. Personal reasons for opposition to zone change. A. Would de-value my property and make it less desireable for a family residence. B. • Would create additional hazards for my children by increasing traffic on the street and in the area. I was hoping t0 avoid problems such as this by living on a quiet dead end street, into I I Zmpac t on Neighborhood A. Taking into account the g proposed sicle- walk planned for the front of the site, I do notthink this is adequate to avoid traffic hazards to the many small children living on Kathrine street. Many of them catch school buses on the very corner that this increase in traffid will have its major impact. B.The existing roads do not appear in my opinion to allow sufficient access which a building of this type would require. C.
