Item #3 states: "Each phase of the development shall be reviewed and approved by the Planning Commission. At the time- of approval of each phase, the densities and uses shall be approved. Item #8 states: `'Approval of any lots to be subdivided shall be through the Subdivision Ordinance procedures: • Item #15 states: "There shall be dedication of twenty-five (25') feet from centerline (thirty-two (32') .feet improvement) on SW Naeve Street with half street improvement where applicable. Ite,r, #17 states: "Internal street improvements will be designated at the time of N:e platting of the subdivision. Item #18 states: "There shall be no occupancy without public water and sewer. Item #19 states; "A copy of the deed restrictions and covenants shall be attached to the approved plan to help insure conformity With planned densities. 4. Applicant states in his narrative that 1,250 units Were approved. To date, 1,034 units have been built. Project A will add 138 units, Project B will add 11 units. This means that Project C, to be developed in the future, may be allowed to construct hot more than 67 units, (Page 1 - Applicant's narrative) 5, Item #3 of Ordinance 73-5 clearly states that the Planning Commission shall review each phase of this development. Contrary to the applicant's narrative, this clause allows the Planning Commission to consider both density and land use. (Page 2 Applicant's narrative) 6. Substantial changes in the immediate area have taken place since 1973 relative to development and, therefore, traffic patterno. The proposed uses are compatible with the previously approved Planned Develop- ment for Summerfield. 2. Sewer service is a concern. The Unified Sewerage Agency has written a letter to the Public Works Director. (See letter attached) One of the difficulties is that if this present system fails, it effects an increasing number of people. The gravity line should be constructed now. 3. Naeve Road will serve this development phase and is now substandard (unpaved) . A right-of-way dedication is necessary. 4. 109th Avenue south to Summerfield Drive is substandard. A right-of-way dedication is necessary. III. STAFF RECOMMENDATION: Staff recommends approval of this Phase XIV review with the following conditions 1 Naeve Road be improved to local street standards along the entire northern property line including frontage on Tax Lot 1200, Tax .Map 251 10D. Full street improvements are to be made. Necessary right'^'of-way dedications are to be made to the City. 2. 109th Avenue be improved to local street standards from Summerfield Drive to the intersection with Naeve Road. This particular application is coming to the Planning Commission under a Zone Change Application at the request of the City of Tigard staff. In a spirit of cooperation the Tualatin Development Company has agreed to make this particular „ application in this method. However, we wish to clarify at this „, time that the development plan is comparable and relates to the original concept plan. That development of the planned unit development has been continuous and expeditious with no delays occuring between phases. We feel with expeditious development the Tualatin Development Company has a vested interest and expectation of obtaining the density hereby submitted. The question of density and land use is not subject to review in this application. We feel that the planned development process parallels the sub-division process and that under ORS 92.040 it is clear that once a City • approves an application and tenative plan that the approval is "bindingo upon the City and that the City is committed to approve , the final plan if compliance is shown. PROJECT DESCRIPTION • The subject site consists of 11.25 acres. It is bound to the north . by S.W. Naeve Road, to the east by S. J. 109th, to the south by Summer- field Retirement Center. Part of the project boundary surrounds the existing Willow Brook aprtments. Part of the North boundary surrounds and oversized parcel hear Naeve Road. Three basic housing areas are projected for the property. Project "A" will include 138 condominium units and support parking. Project "B" will include 11 single family home sites and project "0" is designated as a future housing site to be de-teloped at a future date. Project "A" is a proposed londominum structure containing three ,:nit types. The units contain kitchen, dining facilities and living area, interior utilities and a choice of one or two bedrooms. :Each living she has an exterior patio or balcony for sedetary exterior' living. The building will contain an elevator and general lounge areas at its two main entry points which occur at the change of direction of the structure. The building will be thee stories on the south side and southwest of the structure include large terrace areas and more . i active outdoor recreation facilities. A swimming pool will be placed ' to the south parking lot of the structure located for convenience for the residents of this structure as well as Willow Brook Apartments and other apartments to the south of Summer2ield Drive. The individual floor plans of the units are intended to provide all neceSsary living arrangements in a minimum space. Center lounges are to allow social interaction with the tenants of the building. The buildings will be centrally accessible at two points to the public and a door lock security System and T.V. monitoring system will allow all residents to soreen visitors prior to allowint,' ••••••••••••.....7•••••• •••• • • • Pago -3- Exterior design considerations submitted on Drawing No. Three illustrate the character of the structure to be developed. The structure changes direction three times in the plane to break the linear quality of the building length. To avoid monotonous repetition on the exerior, decks and patios will be handled as aditive elements establishing a series of terracinr, effects that will take into consideration wind, sun and weather orientation as well as assisting in developing individual appearances of units at active living areas. It is anticipated that the structure would be approximately 27° high on the south exposure and 23' high on its ' north exposure. 92 covered parking spaces shall be provided and ILtre open spaces shall be provided. The main entry of the building will contain an area for visitor parking and a turn-around drop-off. Project "B" will be 11 single family lots to contain housing types of the same or equal to the existing residential structures in the re- mainder of the Summerfield Planned. Development. The property directly to the east of this area has been developed as a single family and from tne stand point of maintaining street character through the circulation system of Summerfield it was determined to develope both sides of the street in a like manner. II,PACTS Public services are available to the property at this time. The unified Sewage Agency of Washington county verified connection capacity in a letter to Frank Currie of February 12, 1980. Fire and. Police De- partments have anticipated the Summerfield density since 1973. No children will be introduced to the school system. Tri-Piet now pro- vides bus service on Summerfield Drive. Commercial services such as variety stores, supermarket, banking, doctors ' and dental officeS, restaurants etc. exist in the King City shopping centor and professional center and new space is being provided at the Summerield Commercial Center. 4; The project places single family housing against single family housing on the east, multi-family housing against multi-family housing to the south and the west. The future development pattern of the property north of Naeve Road is not yet trended. The set back for the proposed multi-family structure is 140 feet suppling more than adequate room for landscape and visual bulfering, The most impacted property is the single family residents which shares street front along the north property line created by Naeve Road. lane existing single family residents now has a serene and quiet piece of open pestual space surrounding its boundaries. However, this residents is located on approximately 1.07 acres of land within the area of the City of TiE;ard destined for intense residential development. Although this introduces a change to the residential character of this one single family house it • also benefits then the entire area and the partioular'land owner cf \ Page -4_ this particular parcel. The proposed plan creates an orderly convenient, and efficient relationshop between different land uses. It provides a set of conditions which will tend to maintain relative stability and predictability in the highest practical level of building development, • maintenance and repair for properties surrounding the development thereby utilizing property values and encourageing sound investment and future development of this particular property. To consider the impacts on this 1.07 acres as a single family dwelling would be considering , the impact on anachronism. The parcell is subject to very intense development in the near future. Drawing number 5 shows a land intensity impact graph comparing an interpretation of the 1973 approval to our current request. In terms of the total number of units, the density per acre, the total population, and the number of automobiles and thus auto trip impact on the surrounding transportation system we feel the requested plan as less an impact on the community than shown on the original plan map. In counting the number of units in the entire area including he Willow Brook Apartments we assumed, each dwelling print shown for apartments was two story and each townhouse was a single story. Witnin the area bounded by Naeve Road and 109th and Summerfield Drive in this • vicinity the total number of units was 238. 57-anitr; have already been developed, in the Willow Brook Apartments giving a ttal to be developed , 181. In our proposal has shown we are proposing 15 dwelling units. This equates the number of units per acre as a comparison of 16.08 to 14.75. This over all approval for the Summerfield PUD in exihibit B assumed an • average of 1.9 persons per dwelling unit. We feel that in apartment living the number of people per unit would be slightly less than the overall, project average. Assuming 1.77 people per dwelling unit we • show a comparitive population figure of 320.6 people vs. 293.1 that we are requesting. Introd'ucing a housing type in the community with smaller dwelling units , zero maintenance and high privacy and security will introduce the oppor- . tunity for single adults and people with two residents to estabilish in this community. Considering that we feel it is fair to consider 0. the original proposal as havinr,' 1.75 automobiles per household to this proposal which would probable 1.3 automobiles per household in terms of street impact this would give a comparison of 316.75 autos on the streets vs. 215.8. The City of Ticard planning staff requested a traffic impact analysis from • a traffic engineer. Because of the comparison of the original concept and the propsed concept ,plan, and the fact a study was prepared for the • Summerfield Commercial Center we feel a traffic study is not necessary. :)• • Paff,e -5- • The original design and construction of Summerfield Drive and streets surrounding the area are generally as shown on the original concept plan. Summerfield Dive itself is designed to standards fax exceeding the City of Tigard collector streets standards and allows no parallel parking along the street. The street also is designed as a parkway and has controled access points to it. Traffic circulation has been improved by deleteing all but one of the individual driveways that face Naeve Road. Thus the overall impact of automobiles to the immediate circulation system is more controlled and less intense than projected at an earlier date. The previous traffic study by CH21:1 Hill considering the growth of all vaconat land impacting 99W projected a 2 percent growth of traffic per year between the years of 3.978 and 1985. Durham Road is anticipated to have a 5....percent growth rate per year. Our proposal indicates a total number of cars added to the area of approximately 215.8. Per the OH214 Hill traffic study conducted previously this report indicates that only 10 percent of the traffic generated by a similar facility would impact , the arterial system at peak hours. As Naeve Road develops in the future with more development to the north a certain amount of traffic will then route to 99W via Waeve Road.
