A Proceedings on Proposal No. 1944 commenced upon receipt by the Boundary Commissio o. of a resolution and property owner consents from the City of Tigard an August 12, 1983, requesting that certain property be annexed to the city. The resolution and property owner consents meet the requirements for initiat- ing a proposal set forth in ORS 199.490, particularly Section (2) . Upon receipt of the petition the Boundary Commission published and posted notice of the public hearing in accordance with ORS 199.463 and conducted a public hearing on the proposal on September 15, 1983. The Commission also caused a study to be made on this proposal which considered economic, demo- graphic and sociological trends and projections and physical development of the land. FINDINGS (See Findings in Exhibit "A" attached hereto) . REASONS FOR DECISION (See Reasons for Decision in Exhibit "A" attached hereto) . ORDER On the basis of the Findings and Reasons for Decision listed in Exhibit ".A", the Boundary Commission approved BOUNDARY CHANGE PROPOSAL NO. 1942 as modified on September 15, 1983. NOW THEREFORE IT IS ORDERED THAT the territory described in Exhibit "A" and depicted on the attached map, be annexed to the City of Tigard as of the date of approval. The territory proposed to be annexed consists of two parcels totalling 2.83 ac. , one single family residence, an estimated population of 2, and is , evaluated at $99,100. i 2. The property owners desire to annex in order to receive city services. I There are no plans to develop the vacant property at this time. 3. The territory is within Metro and the acknowledged rc , ,onal urban growth boundary. 4. The territory is designated Urban Intermediate on the County Plan map, and zoned RS-1, one-acre min. lot size. The territory is within the Tigard '. +, Urban Planning area, the area outside the Tigard city limits within which growth will be directed over the next 20 years. Washington Co. has agreed to the city's planning area. 5. The city's comprehensive plan designates these parcels as Medium High .. Density Residential. Under existin g zonin g, once annexed to the city, the j. • parcels would be zoned A-20, 20 dwellings/acre. Under the new zoning • ordinance which is being prepared, the zoning would be R-20, with the sane number of units permitted per acre. 6. The territory which is developed (TL 1400) is served by a septic tank. The Tualatin Rural Fire Protection District provides fire protection to the site Annexation to the city will have no effect.upon fire service as the district serves the City of Tigard. There is a station just south of Fischer Ra. , approximately one mile from the site 9. Police protection and other city services will be available upon annexation. 10. According to the UPAA between the City and the County, the City agreed to annex the full right-of-way for roads contiguous to territory being * ' annexed to the city, rather than annex just to the centerline of the road. The city has proposed modifying this annexation proposal to include all of SW 108th, from Durham Rd. south to the Tualatin River, where the road ends. The city's Public Works Director prefers to take the entire length of SW 108th, rather than just a portion of SW 108th to ensure control over road improvements. REASONS FOR DECISION On the basis of' the Findings the Commission determined that: 1. The proposal should be modified to include all of SW 108th from Durham Rd. south to the Tualatin River, consistent with the UPAA between the City and the County. 2. The annexation is consistent with regional planning, county planning, the 4 city°s adopted urban planning area, and the property owner's wishes. 3. Annexation of the territory allows the property owners to go forward with their plans in a timely fashion. i• 4. Annexation to the city is required in order to assure uitamate sewer service to the site. VICINITY INFORMATION The surrounding property is developed as large lot single family residential. The property to the north is zoned A-20. The land to the southwest and east ie atilt. Within Washington County. SITE INFORMATION: There is a single family residence on the property, a barn and some out buildings. The property slopes to the south. There is a drainage swale along the western edge of the property. There are several trees along the drainage swale. The remainder of the property is field grass. B. APPLICABLE COMPREHENSIVE PLAN POLICIES: 2.1.1 THE CITY SHALL MAINTAIN AN ONGOING CITIZEN INVOLVEMENT PROGRAM AND SHALL ASSURE THAT CITIZENS WILL BE PROVIDED AN OPPORTUNITY TO BE INVOLVED IN ALL PHASES OF THE PLANNING PROCESS. All property owners within 250 feet of the property were notified of this application. In addition, a notice was published in the Tigard Times on June 30, 1983.
