The resolution and property owner consents meets the requirements for initiating a proposal set forth in ORS 199.490, particularly Section (2). A ** Upon receipt of the petition the Boundary Commission published and posted notice of the public hearing in accordance with ORS 199.463 and • conducted a public hearing on the proposal on March 12, 1901. The Commission also caused a study to be made on this proposal which con- t sidered economic, demographic and sociological trends and projections and physical development of the land. Planned DeVelopment" Zone. At the same meeting, the Planning Commission approved Sensitive Lands Permit, M 9-80 to constrict a sewer line through the floodplain. On April 10, 1980, the Boundary Commission approved the Smith Annexation involving Tax Lots 1200 and 1300. The City of Tigard Ordinance No 80-41 approving the annexation passed on May 19, 1980. FINDINGS OF FACT: • . A portion of Phase II (Tax Lot 1400) has not been annexed to the City. The City Council passed a Resolution on January 12, 1981 to send the annexation proposal to the Boundary CommiSsion. The annexation should appear before the Boundary Commission in March. r+ 2 The site has been zoned R-7PD in Conformance with the City of Tigard Comprehensive Plan. 3. Characteristics of the Site The subject property consists of two tax lots that total 5. 64 acres 7 located approximately 1 ,000 feet south of S.W. Bonita Road between S.W. 79th Avenue and S.W. 76th Avenue. No structures currently exist n the property. The land generally slopes from S.W. 79th Eastward at a grade of approximately six percent to seventeen • percent. The elevation at the southwest corner is approximately 190 feet sloping to 126 :eet at the northeast corner, a distance of 700 feet. The major physical site characteristic is its proximity to Fanno Creek just east of the property. The north- east 1.55 acre is identified by the Washington County Department: of Public Works as being located within the • 100-year flood plain. Fanno Creek serves as the collecting point for the storm drainage from this area. B. Land Use The property is zoned R-7. It was annexed to the City of Tigard by Ordinance 80-41 and Boundary • Commission Final Order 41576. At the present time there is no intense Urban development on lands adjacent to the property. C. Existing Urban Services Urban services for the site are available from several jurisdictions. 1. sanitary Sewer - Sewage collection and treatment is available from the City of Tigard through an agreement with the Unified Sewerage Agency of Washington County. Collection is provided by means of the Fanno Creek Interceptor located approximately 300 feet to the east. Storm run--off will he handled pursuant to existing City regulations. 4. Schools - The property is located in Tigard , 6 School District 23J. Therefore, a total of 16 dwelling units will be bwlt .on the 16 lots. These units will be one and two-story structures. 3. Circulation - Neighborhood streets are used to provide access to all single-family lots. Sidewalks will be provided on all streets. • 4. Open Space - More than one and one-half acres • on the northeast part of the site .are designated as passive open space. This area lies within the l00'-year flood plain and represents 27 per cent of the site. B. Program Elements 1 . Public Facilities o Sanitary Service - The Fanno Creek Interceptor exists just east of the property, and is the sanitary waste collection system for the area. /t is maintained and operated by the Unified Sewerage Agency. Public sewers will be extended from the interceptor and extended to each dwelling P unit as part of the site improvements. This local collection system will drain by gravity and be maintained and operated by the City of Tigard. o Storm Drainage - Storm drainage facilities will be designed by registered engineers to the Specifications of the City of_Tgard. Maintenance Will come under the jurisdiction of the City. The systeM will be designed to be gravity operated. st, -4- o Water Supply - Water will be provided by the Tigard Water District. Design of the internal distribution system will be by that jurisdiction' s staff. o Street Lighting - Street lighting of the roadway areas will be in accordance with the requirements of the City of Tigard. Portland General Electric Company will provide the design and the layout of the lighting system and underground service. Prior to development, a light standard will be selected which will be utilized throughout the project. o Transportation - Streets will be designed and constructed to the standards of the City of Tigard. 2. Community Facilities o Schools - The development site is located in Tigard School District 23J. This particular development will have no significant impact on the school system. o Libraries - The development site is served by the Tigard Public Library, which is funded by the City of Tigard. Staff has indicated that the facilities, while somewhat crowded, are adequate for future residential growth. The passage of the serial levy in May, 1978 insured adequate funding for the next five years. This serial levy will fund increased oeprating expenses, including staffing and books. o Protection - A full range of City services became available from the City upon annexation. Both city police and fire departments are able to provide adequate protection to the proposed development. t) (ft • 3. Market Analysis • The 1978 market demand for new housing units in the Portland Metropolitan area has been forecasted at 19.,600 new units. - 11 ,700 single family (62. 9%) ; 6, 900 multiple-family (37. 1%) . . This means that at the minimum there is a demand for 5,684 housing units in Washington County and 882 units in Tigard. Recent local real estate activity only bears out these figures as most new housing made available in the area is either pre-sold or sold in an average of 20-30 days • from going on the market. 4. Development Program o Ownership - Single Family lots will be sold to individuals or builders. The lots purchased by builders will in turn be sold to individuals as a place of residence. o Schedule - The development is scheduled to be constructed in two phases. The 16 single family lots will begin • development within four months of approval and be completed 4, within one year. The area designated as "future development" on the preliminary plat will be developed with the property adjacent and to the west. 0 Operation and Maintenance Proposal - The single family area will be operated as any city subdivision. The public land will be the responsibility of the City with individual property owners responsible for their own property. Bonita Road between S.W. 79th Avenue and S.W. 76th Avenue. The property is zoned RU-4 according to Washington County zoning. It was annexed to the City of Tigard by Ordinance 80-41 and Boundary Commission Final Order 01576. The RU-4 Zone is an urban residential district for single family detached housing. The minimum lot size is 7 ,000 square feet, This zone change request is required in order to bring this property into conformance with the City of Tigard zoning designation, which is R-7. The minimum lot size in the zone is 7,500 square feet. Obviously, this designation is a less dense use than the existing RU-4 zone. CONFORMANCE The Development Plan calls for residential, and the proposed zone change conforms to this designation.
