Stark (#530) Portland, Oregon 97204 - Tel: 229-5307 FINAL ORDER RE: BOUNDARY CHANGE PROPOSAL NO. 2171 Annexation of territory Fr' to the City of Tigard. on Proceedings Proposal No. 2171 commenced upon receipt by the p Boundary Commission of a resolution and property owner consents from the City of Tigard on October 22, 1985, requesting that cer- tain property be annexed to the city. The resolution and prop- erty owner consents meet the requirements for initiating a proposal set forth in ORS 199.490, particularly Section (2) . Upon receipt of the petition the Boundary Commission published and posted notice of the public hearing in accordance with ORS 199. 463 and conducted a public hearing on the proposal on December 12, 1985 . The Commission also caused a study to be made on this proposal which considered economic demographic and p p economic, sociological trends and projections and physical development of the land. The Commission reviewed this proposal in light of the following statutory guidance: "199.410 Policy. (1 ) The Legislative Assembly find that : (a) A fragmented approach has developed to public ser- vices provided by local government and such an approach has limited the orderly development and growth of Oregon' s urban areas to the detriment of the citizens of this state, (b) The programs and growth of each unit of local gov- ernment affect not only that particular unit but also the activities and programs of a variety of other units within each urban area. ( c) As local programs become increasingly inter- . governmental, the state has a responsibility to insure orderly determination and adjustment of local government boundaries to best meet the needs of the people . • (d) Local comprehensive plans define local land uses but may not specify which units of local government are to pro- , vide public services when the services are required . (2) The purposes of ORS 199.410 to 199. 519 are to Final Order - Page I I ,..„ ..,.,, ,..:; ;,uz'.,mix _ °«.•'F.r.�:. • , r (a) Pride a method for guiding th`e- creation and growth !.•. of cities and special service districts in Oregon in order to prevent illogical extensions of local government boundaries; (b) Assure adequate quality and quantity of public ser- vices and the financial integrity of each unit of local gov- ernment; ( c) Provide an impartial forum for the resolution of local government jurisdictional questions; and (d) Provide that boundary determinations are consistent with local comprehensive planning, in conformance with state- wide planning goals. However, when the proposed boundary commission action, is within an acknowledged urban growth boundary, the state--wide planning goals shall not be applied. The commission shall consider the timing;, phasing and avail- ability of services in making a boundary determination. 199.462 Standards for review of changes; territory which may not be included in certain changes , In order to carry out the purposes described by ORS 199.410 when reviewin a petition for a boundary change, a boundary commission shall consider economic , demographic and sociological trends and projections pertinent to the proposal, past and prospective physical development of land that would directly or indi- rectly be affected by the proposed boundary change and the 1. goals adopted under ORS 197. 225. " The Commission also considered its policies adopted under Admin- istrative Procedures Act (specifically ,. • 193-05-000 to 193--05- 015 ) historical trends of boundary commission operations and deci- sions, and past direct and indirect instructions of the State Legislature in arriving at its decision . IOW THEREFORE IT IS ORDERED THAT the territory described in Exhibit "B" and depicted on the attached map, be annexed to the City of Tigard as of the date of approval. J Exhibit "A" Proposal No. 2171 a , FINDINGS On the basis of the study and the public hearing the Commission found that : 1 . The territory proposed for annexation contains .80 acres, is vacant and is evaluated at $36,000. 2. The property owners petitioned for annexation to obtain municipal services. 3. The territory is within METRO and the acknowledged regional Urban Growth Boundary. 4. The territory is designated Urban on the Washington County Comprehensive Framework Plan. The City and the County have adopted an Urban Planning Area Agreement (UPAA) . This ter- ritory is Active n g Area within which ch the City is responsible comp rehensive planning and for the coordination and planning for the provision of urban services. The City' s Comprehensive Plan Map identifies the territory as Low Density Residential. City zoning for the site is R-4. 5, 7, 500 sq. foot minimum lot size . • 5 The territory remain within the Unified. Sewerage Agency which provides treatment and maintenance of all lines 24 inches and o"; er . Collector sewers are provided by the City and the City has an 8-inch sanitary sewer line in SW 92nd and has Avenue at North Dakota Street which can serve development on the property. The territory is paying $0,33/$1000 A.V. to retire bonds issued by the old Metzger Sanitary District A which was absorbed by the Unified Sewerage District when it was created. 6. The territory is within the Metzger Water District . An 8. inch main in SW North Dakota Street can serve the site . Annexation to the City will not affect water service as Tigard does not have its own water system. Metzger obtains its Water from the City of Portland with which it has a 25- year contract to purchase water . ? The territory is currently served by the Washington County Rural Fire Protection District No . i Annexation ;��:�:�: not affect this service as Wash. Co .
