Commercial Tigard, Oregon 97223 Dear Bill: .• 1 got a copy of the TDC - USA Agreement from Chuck Leibert at USA today, and I enclose a photocopy of the agreement. I have studied the agreement. I do not see anything in the agreement that would permit TDC to shift the existing 1- Summerfield flow away from the King City plant to the Durham plant or hook the new units up to the Durham plant without paying the regular hookup charge that USA collects. Every- ! one agrees that we are talking about a lot of money. If what TDC has in mind is that it will pay some number of • hookup charges less than the number of units to be delivered ..1 to the Durham plant, you should make some arrangements to ' discuss the mr,..tter with USA. I have got involved in this only because Ed Waldon, our acting City Administrator, ' became aware of a proposal for a disposition of the sewer problem that was inconsistent with his understanding of . what was expected for future development in that area. The question is basically one that concerns TDC and the I Unified Sewerage Agendy. The City of Tigard doeS have an interest in the collection of hookup fees, as it receives a percentage of the fees collected. WILLOUGHBY, CHIEF OF POLICE, FOR ASSISTANCE RENDERED BY THE PUEBLO POLICE DEPARTMENT IN CONNECTION WITH A TASK FORCE STUDY AND REPORT ON THE TIGARD POLICE DEPARTMENT. • (a) City Administrator recommended that Resolution No 75-40 be adopted. (b) Motion to adopt: Councilman Cook; seconded by Councilman Moore. Approved by unanimous vote of Council. 13. NPO #1 & #2 REZONING - CITY OF TIGARD • Request by City of Tigard for approval of x'ezoning of lands within the boundaries of the NPO #1 Plan for the Ash Avenue - °e #2 w { � Downtown Area and the NPO ��2 Plan for the Greenburge Brookside Area to conform with the adopted Ccrrprehensive Plan as amended. Request approved by Planning Commission, Public Hearing was opened at 8:00 P. M. It vas noted by the Mayor that ther e. were two NPO areas proposed for rezoning and that each one would be handled separately under the public hearing. II (a) The City Planner explained the proposed rezoning to bring the zoning into conformance with the adopted plan. He pointed out that no land was being considered for rezoning to a more intense use at this titre. Mr. Ernest McCall, Great Western Chemical Co, reiterated the previously expressed concern regarding an ordinance amendment protecting previously existing conditional uses. Martha Davis felt her property on Greenburg Road would be downgraded if the zoning was accomplished in that area. Cross Examination by Council. The Hearings were closed. (c) ORDINANCE No 75.35 AN ORDINANCE RECLASSIFYING CERTAIN LANDS WITHIN AN AREA OF THE CITY OF TIGAED HERETOFORE DESIGNATED AND KNOWN AS THE "ASH AVENUE - DOWNTOWN PLANNING AREA" AS HERETOFORE DELINEATED tY "NEIGHBORHOOD PLANNING ORGANIZATION PLAN No 1" PLAN KNOWN AS 4 1. The motion died for lack of a second. t (j) Attorney Fred Anderson requested a statement by the Council that demonstrated approval or concurrence with the ordinance which was requested to be drawn to protect grandfather rights. Attorney Bailey stated that such a statement would he appropriate. No action was taken by the Council although there appeared to be concensus of Council along the lines requested. G. ma Bonn & Kenneth Bunn Request for approval of a zone change from R-7 (single family residential) to R-7 Planned Development, and for preliminary plat approval for an 8.5 acre, 70 dwelling unit (two family house). Planned development proposed to the south of S. W. Murdock Street, and extending north along S. W. 109th Avenue to S. W. Canterbury Lane. (Tax Lot 8800, Washington County Tax Map 2S1. 10AD). Application denied by Planning Commission. Public Hearing opened 8g00 P. M. (a) Planning Director noted that the Council packets contained minutes and Staff Report, utilizing proposed plan of development, aerial map and slides the Planning Director outlined the facts of the situation. Testimony by proponents Mr. Jack Annand requested the Council table the appeal request. Mr. Bunn advised Council that if the original county approved PR approval is in effect that they would like the application for their appeal withdrawn. If it is not in cffect then they request the Council to table this appeal request. Testimony by opponents Mrs, Davenport spoke in opposition to the proposal and stated she did nto tart trees cut and houses on adjacent property at a high density. IS To Tigard Planning Commission From Dick Bolen ,Subject: NPO #2 Rezoning , Date: June 17, 1975 The rezoning of NPO #2 was tabled at the June 3, 1975, Planning Commission meeting due primarily to the testimony given by Dr. Davis and his attorney, Art Tarlow, that his property north of Greenburg Rd. and west of 95th Avenue should retain its present A-2, multi-family zoning designation. The reasons given for not changing the zone from A-2 to R-7, as proposed by the NPO #2 Plan, can be summarized as follows: 1. The surrounding properties are developed into primarily multi-family uses. 2. The county has recently approved a zone change to multi- family use, permitting 20 units to the acre on property to the northwest of the Davis property. 3. Due to surrounding development and increasing traffic volumes on Greenburg Rd. , the Davis property is no longer suitable for single family residential use. Following the testimony regarding Mr. Davis' property, the staff was asked to explain why this property is pro p osed for sin g le family use on the NPO #2 Plan, Staff explained that a major objective of the Plan was to conserve the existing single family residential development in the Greenburg area. Apartments were therefore proposed to be located on the periphery p p y of the single family area, in locations directly accessible to major arterials and shopping. In addition, staff pointed out that this peripheral location of multi-family development would provide a transition of use from the commercial development into the single family areas. NPO #2 plan text Policy #7 states: "Within the low-density residential area, duplexes will be allowed on lots less appropriate for single family homes, to include locations at street intersections and as buffers between multi-family and single family areas. " An additional issue concerned the county's action in approving a • zone change on a piece of property directly to the north and west for a higher density than the multi-family density prescribed by the adopted Tigard Plan. The question arose that if the City's plans were not going to be honored by the county, was it possible that the land in county zoning jurisdiction to the north and west would also be rezoned for multi-family use, in spite of Tigard's adopted Plan?' The county has been written a letter regarding this problem of conflicting plans and once again copies of the adopted City plans (with adopting ordinances) have been forwarded to the Planning Department in Washinrton County. Examples: development of a median divider in Pacific Hwy. ; development of a new sign code; encouragement of more and better landscaping on major streets; development of a civic center with recommendations from the Commission for how it should be developed, Where it should be developed and in what time frame; definition of the Cityis boundaries as a function of land use and of the City's growth and development and carry those definitions as recoMmendations to the Boundary RevieW Commission, City Council and Washington County, as well as other local govern merits; for the Commission to get into at active role with respect to attracting appropriate business and industry, rather than a passive role and simply regulating where and how they locateo 6. Staff Findings. 1. The proposed changes in zone are necessary to bring the zoning map into conformanco with the adopted NPO #2 Plan. 2. The proposed rezonings are proposed only for those properties which meet two conditions: A. their current zoning conflicts with the adopted land use plan B. The existing zoning will allow a more intense use of the land than provided for in the adopted plan. The effect of the above statement is that the. staff is recommending that the Planning Commission rezone where necessary to protect the adopted plan. For in$tance, a 0, piece of C-3 (Oeneral Commercial) property planned for commercial-professional deVelopment must be rezoned C-P (Commercial-Professional) to insure that it will develop as , • planned. Conversely, a piece of R-7 (Single Family Resi- dential) property planned for eventual apartment develop- ment may remain zoned. R-7 without endangering the Plan. In fact, property proposed to be zoned to a more intense land use must be evaluated to ascertain if the "timing" is right for development of the subject pi-operty. For example, is it adequately served by public facilities and streets; does a community need exist, etc. The proposed rozonings are grouped below according to the current zone and the zone being proposed to replace it • A. A-2 to R-7 -- Those properties are north of Oreenburg end west of 95th and from the end of Lomita to Hwy. 217.
