Based upon the file and the information which, you provided, it is my interpretation that it was the intent of the Planning Commission to allow full development of Phases I and II of the Park 217 project in accordance with plans submitted as long as the project was initiated within one year of approval, or as extended. A special list of Commercial and Industrial uses was an element of the City ' aPpr9Val. According to the record, construction of Phase I commenced on or aroiand."..:Inne of 1980, within the extension period granted by the Planning Commission in March', 1980. At that time of approval, City Code did not ipose • a time limit for completion of a project. Development of Phase I has taken • place in accordance with this plan and the recently approved second phase (SDR 13-84) .is consistent with the original Planned Development approval. .0. Although the City has now rezoned the land to C-G (Commerical General), it is my interpretation that as long as the intent of the PD is met with development of the use mix thatyas approved, the project may proceed despite the recent amendment to the property zoning designation. I find that the PD which you received did not have a.L.1,deadline for development activity, only that construction be iniated within one year. The Attached list of 'adjusted 'Commercial uses for Phase II" approved by the Planning Commission on July 7, 1981, remains in.affect. I hope this clarOies th*ellstatus,, of. the Park 217 project. This request was for a Planned Development (PD) designation for the two zones included in this parcel - C-3 General Commercial and M-3 Light Industrial.. This project went to the City Council as Ordinance 78-77 on November 27, 1978 and was approved. (Ref. file ZC PD 3-80 Park 217 Business Center.) No development took place on site and the property changed hands . In December of 1979 , Trammell Crow, Mr. Bruce Hosford, requested a one year extension of the PD-ZC 36-77 . The Planning Commission approved this extension. 1 Trammell Crow applied or a major change in a General Plan (PD) review in February of 1980. On March 18, 1980 the Planning Commission approved the application and added a condition "18 . Prior to the start of construction on Phase iI applicant shall submit to the Planning Commission a list of proposed commercial Uses. " On May 120 1980, the City Council reviewed this project and amended Ordinance 78-77 which included conditions of development. This amendment became Ordinance 80-38. A Site Design Review application was made (SDR 12-80) on June 6, 1980 and construction followed. The first majior tennant was the SOVA FurnitUre warehouse, followed by Several other retailer , a John Deer Tractor sales and service outlet and then Smith's Home Furnishings warehouse. ReceLtly Trammell Crow notified Staff of its intentiOn to Start construction of Phase II, zoned M Light Industrial. Under the code Section 18 .48 .010, warehousing, wholesale distribution or Sale businesses are allowed. It is clear from the original approval that the applicant asked for a combination of uses for this site, and waS granted the necessary approvals . Condition 18 was added to insure that Phase II be reviewed. Staff recommends that you authorize uses as °adjusted" and subject Phase II to Site Design Review. He explained the source of notification and did not know why Mr. Ja,ek was missed. Staff stated this would be checked into. The t stated legal notification through the local newspaper is allsthatis required, but that staff does try very hard to give mailed notification of such hearings to neighbors. Mr. Jack questioned the height of the buildings: he recalled previous statements that no building would be more than 17 feet high, which is probably lower than a two-story building. Saito explained the terrace effect, and asked for a 38-foot high building, calling attention to the previous approval of a five-story building. Anne Craig, 12360 S. W. Knoll Drive, described a drainage problem onto her property, and inquired about access through the project which. • had been previously arranged*, 'Saito stated the access would be provided ' , through one of their private drives rather than a public street. He described the drainage system to be provided, which would give better drainage both to the project site and Mrs. Craig's property. Wherever possible, businesses on Pacific Highway should be clustered and share common parking facilities and driveways. As new development occurs, the number of access points should not exceed the number necessary for proper on-site traffic circulation, and, where possible, should be combined with access to adjacent businesses. ' Policy 25 Limit the amount of commercial development to occur in the industrial area, allowing only some growth of existing retail and service commercial in the area. 4. The Plan will be developed in two (2) phases. The initial phase will encompass the development of all access ways, utility services and the construction of the southeasterly four structures within the site (Buildings 3, 4, 5, and 6) . Construction starts for Phase I of this project are scheduled for mid-1980 with anticipated completion by early 1981.
