Hall Street - Portland, Oregon 97201 - Tel 229-5307 RECEIVED FINAL ORDER MAY 12 1975 CITY OF TIGARD RE; BOUNDARY CHANGE PROPOSAL NO 799 - Annexation of territory to the City of Tigard. Proceedings on Proposal No 799 commenced upon receipt by the Boundary Commission of a petition from property owners on February 28, 1975 requesting that certain property be annexed to the City. The petition meets the requirements for initiating a proposal set forth in ORS 222. 170 and paragraph (a) Section (3) of ORS 199.490. Upon receipt of the petition, the Boundary Commission published and posted notice of the public hearing in accordance with ORS 199.463 and conducted a public hearing on the proposal on April 2, I 0 1975; The Commission also caused a study to be made which considered economic, demographic and sociological trends and projections and physical development Of the land. FINDINGS 40 On the basis of the public hearing and the study the Boundary Commission found that 4 1. The territory to be annexed is contiguous to the City and contains .5 acres, 2 single family dwellings and an estimated population of 6 perSohs. 2 The property owners request annexation to obtain city Services in order to r,edevelop the property with an office building. 3. The Washington CoUnty Framework Plan identifies the territory as "urban" and the City of Tigard Comprehensive Plan designates the territory as "Residential-Commercial" which according to the plan ". , . is intended to accomodate higher-density dwelling structure8, including high rise apartments, combined with a range of compatible office and business uses, " 4. The City has an 8 inch sewer line approximately 125 feet west of the territory which can be extended to serve the territory, The City has the ability to supply other municipal services to the territory including police Page 1 - VINAL ORDItR (1- .‘a protection, street lights, and street maintenance, planning and zoning and building inspector. 5. The territory is in the Wetzger Water District which has a water line in the vicinity of the property and the territory is in the Tualatin R.F.P.D. for fire protection purposes. 6. Several owners of adjacent and nearby property have signed petitions in favor of annexation but the petitioners desire • annexation immediately because of time deed lines in consumating the sale of the property. REASONS FOR DECISION o On the basis of the findings the Commission determined that) 1. The proposed development is compatible with the city's Comprehensive Plan for the area. 2. The City has the ability to provide an adequate quantity and quality of needed municipal services to the territory. • 3. The adjacent properties were not considered for inclusion to this proposed annexation because of the petitioners time deadline but the CoMMission is desirous of corr51dering a new proposal to annex adjacent and surrounding property. ORD r on the basis of the findings and reasons listed above, the Boundary Commission approved BOUNDARY CHANGE PROPOSAL NO 799 on April 2, 1975. This shall be accomplished before further occupancy permits may be granted, 3. No retail sales or drop-in customer service or pick-up and delivery excepting that purely incidental to a per- mitted or conditional use for which approval has been secured. 8. No commercial vehicles shall be stored or parked overnight on the site, 9. No outside storage of materials, vehicles, waste products, or debris shall be permitted. 10. No corrosive chemical fumes, opaque smoke, noxious vapors or exhaust eases will be emitted from, any activity on the site. 11. Noise generated on site will conform strictly to ''Quiet Zone" standards promulgated by the State of Oregon EQC. 12. No more than one nameplate of less than 10 sq. ft, mounted flat on the building wall above the window line will be permitted for each enterprise. D. The parc61 of land comprises approximately .5 acres of land. (2) The Tigard Community Plan adopted July 26, 1971, classifies the entire Tigard triangle area as a • residential and commercial use. The Tigard Triangle Plan, not adopted by the City, does classify this parcel as an office park development. Thus , this land does comply to the intended use as described. (3) Previous studies and building trends have indicated an expanding commerdial growth towards soUthWest Tri-county area and spedifically the Tigard area. This zone change would be compatible to the trend in the area and would further expand this commercial growth. As a function of this growth it would help broaden the • tax base for the Tigard community and extend the employ- ment potential. (4) This parcel of land lies in the Tigard triangle within close proximity to the major freeway network of 1-8 and 1,..241.7 . Traffic is dispersed to the freeways through either the Haines Road interchange or the 72nd street interchange. The subsequent developMeht of 'Farmers InSUrande Co. , Lamb-Weston, Lincoln Investment Co. , and Allstate Insurance Co. has set a trend of doMMerCial development in WhiCh this proposed zone change Would he compatible. Other zoned areas are a part of a large lease complex but would not facilitate private owner- , of an office facility. .e (6) This parcel of land is located in an area which is in the process of drastic change of use. The existing residential is primarily located to the north of this property. The tiieffic pattern serving this property is along lialiret.L.Rdad and Hampton Road which does not pass through established residential neighborhood. The proposed project will be screened and landscaped along adjacent residential zones. Thus, minimal impact on adjacent properties is intended by this zone change.
